HomeMy WebLinkAbout1984-11-20M TOWN OF DANBY PUBLIC HEARING ON PROPOSED LOCAL LAW REGULATING THE MAINTENANCE OF REAL PROPERTY November 20, 1984 A public hearing was held November 20, 1984 at the Danby Town Hall, 1830 Danby Road, Town of Danby. The purpose of the hearing was to consider the adoption of proposed local law regulating the maintenance of real property in the Town of Danby. The meeting was called to order at 7:40 PM. Board Members present: Councilperson Dorothy Roberts Councilperson Mary Oltz Councilman Ric Dietrich Councilman Edward Shay Supervisor Mildred Miller Others present: Raymond Mayo, Robert Maycumber, John C. Shepardson, Robert D. The town clerk read the notice of public hearing as advertised in the Ithaca Journal. Supervisor Miller opened the meeting to the public for their viewpoints. Robert Maycumber said he would like to see the proposed junk law as well as the present zoning ordinance go to public referendum. John Shepardson felt the new junk law is the sole descretion of the zoning officer and doesn't feel this is fair. Carol Sczepanski asked why put another law into force that will not be enforced. She feels the town should enforce what they have now, not add to it. John Shepardson, Sr., if the people are not happy with the way the town is now, then they do not have to live here. Donald Graham explained the duty of the zoning officer in connection with the enforcement of the junk law is to go to the landowner with the complaint received or viewed, and gives the landowner 30 days to answer the complaint either to rebut it or to correct the violation. The landowner in violation will initially answer to the zoning officer. If the zoning officer is not happy with the outcome, he then turns the matter over to the judge. Robert Maycumber said he has lived in Danby nearly all his life and likes the way the town looks. Raymond Mayo said Danby is a farming community and the new people that have come to this area want to change the town to suit them. He doesn't feel there is any need for zoning in the town and would like to see it done away with. Walter Sczepanski explained he serves on the planning board who drew up the junk law, and he is not in favor of the law. But he felt the law should be brought before the public to hear their comments. John Shepardson questioned what the costs are in having zoning in Danby. He feels the town has to pay unnecessary costs for lawyer fees, etc. Edward Inman questioned what has the zoning officer enforced so far. • C • • m Public Hearing, Junk Law, November 20, 1984 Page 2 Carol Benjamin said the planning board was directed to draft the junk law, she also is not in favor of the law but warted to hear from the residents on their views. Pamela Clermont, town attorney, explained the junk law was drafted from the Ithaca Junk Law. She explained she talked with the zoning officer in the community where this law is being enforced and he explained they had very good luck with enforcing it. They had good cooperation between citizens and zoning officer. In most instances under this law, the zoning officer was able to come up with some kind of compromise and negotiate a satisfactory solution. Mrs. Clermont explained the zoning officer does not have any power under this law, other than to file a complaint. The majority of the people in attendance were not in favor the junk law, and would like to see this go to vote in the election. They would also like to see the present zoning be put to vote at the same time. of adopting November ordinance Supervisor Miller closed the meeting to the public at 9:00 PM and announced a special meeting will follow to adopt the 1985 budget and discuss the veteran's exemption. The purpose of the meeting was to discuss setting a public hearing date for Veteran's Exemption and to adopt the preliminary budget for 1985. Supervisor Miller said she reviewed the preliminary budget due to the dissatisfaction among residents at the November 12 public hearing because of a 24% increase. She lowered the tax increase from 24% to 8% by reducing the Federal Revenue Sharing Town Hall/ Parking Lot amount to $2,000 and putting $4,000 into General Fund. She cut $7400. from Highway Machinery and Road Repair Account and placed unexpended balance of $40,000 into the highway account. Supervisor Miller explained the fire district did not lower their budget as presented at the public hearing. Robert Maycumber felt the highway superintendent should be paid more in comparing his salary among area town highway superintendents. He felt the salary should increase to $17,500., an $840. increase. Several residents were in agreement. Councilman Dietrich explained the board members had discussed the present salary with Mr. Babbitt during their budget workshops and Mr. Babbitt agreed to the salary of $16,660. He felt the town board should observe what he can do as highway superintendent before giving him a raise. supervisor Miller said a resolution is needed to adopt the preliminary budget. RESOLUTION 443 ADOPT PRELIMINARY BUDGET AND FEDERAL REVENUE SHARING BUDGET FOR 1985. Moved by Supervisor Miller, seconded by Councilman Shay. Roll call vote: Dietrich - aye Oltz - aye Roberts - no Shay - aye Miller - aye Councilperson Oltz said although she voted yes on the budget, she did not approve of Supervisor Miller changing the salary figures after she and Councilperson Roberts made other recommendations. Supervisor Miller said the for veteran's exemption to Councilman Dietrich moved the public hearing in the prior to the regular town Roberts. Carried by a vot board needs to set a public hearing date Danby property owners* to authorize the town clerg to advertise newspaper for December 10, 1984, at 7:30 PM board meeting, seconded by Councilperson e of five ayes and no noes. • • Special Meeting, November 20, 1984 The Town Clerk said she feels the dog warden, Lorraine Bard and her assistant, Justin Glass should be deputized. The board agreed the town clerk should check with Albany on this matter and to follow through if needed. At 10:10 PM the meeting was adjourned.
