TOWN OF DANBY
PUBLIC HEARING
Local Dog Law for the year 1984
September 10, 1984
A public hearing was held September 10, 1984 at the Danby Town Hall,
1830 Danby Road, Town of Danby, Tompkins County, New York. The purpose
of this hearing is to consider the revised clog law, which will supercede
Local Dog Law for the year 1976, if adopted. The meeting was called to
order at 7:40 PM.

Others present: Florence Starr, Mr. & Mrs. William Shippos, Edward
Roberts, Herbert Engman, Helen Mundell, Donald Wright, Roy and Mary
Casterline, Donald Graham, Joel and Sarah Gagnon, Pamela Clermont,
Paul Smith, Judd Leonard, Jean Grossmann, Vera Schilling, Fritz
Daemen - VanBuren, Donald Wright, Jr.
The legal notice as advertised in the Ithaca Journal was read by the
town clerk. The Supervisor opened the meeting to the public and the
following views were expressed.
Attorney Pam Clermont discussed
the two major
changes in the former
dog law.
Section
8,- penalties
stipulates first
violation is punishable
by penalty
of not
more than $25.00,
second violation,
not more than
$50.00 and
not more than $75.00
for the third
and all subsequent
violations,
or by
imprisonment
for a term not
exceeding five days.
The other
change,
was addition
of dog adoption
fees under section 9.
Mr. Daemen - VanBuren and Mr. Shippos both expressed concern over dogs
running at large and dogs continuously barking at night.
Mr. Wright and son, Mrs. Grossman, Ms. Schlling all expressed concern
to dogs continuously barking.
Attorney
Clermont explained
to the
residents
if they are unable to
contact
the dog warden, they
should
call the
town clerk.
Herb Engman favored adoption of the new dog law.
The meeting was closed to the public at

The regular meeting of the Danby Town Board was called to order at
8:12 PM, at the Danby Town Hall, 1830 Danby Road, Town of Darby,
Tompkins County, New York, September 10, 19840

Councilperson Oltz moved to approve the July 24 Public Hearing minutes
and the July 24 Special Meeting minutes as presented, seconded by Council-
person Roberts, carried unanimously.
Councilperson Roberts moved to approve the August 13 minutes as presented,
seconded by Councilman Dietrich, carried unanimously.

looking for
another jail
site.
Michael Loehr reported he presented application to Don Graham for special
permit for a planned unit development in regards to the Ithaca Children's
Trust's purchase offer for the property at 1820 Danby Road.
Sarah Gagnon requested if a ramp could be constructed at the front entrance
of the Town Hall so that the handicapped could enter the building with
less trouble. Mrs. Gagnon is in a wheelchair.

William Shippos requested if the highway department could cut back the
weeds from the road located at corner of.Brown. Road and Station Road.
The visibility is poor there.
Judd Leonard would like to meet with the board members in private to
discuss a zoning issue.

Committee Reports:
EMC: Herbert Engman reminded residents of the pesticide cleanup day,
September 27, 11 to 7 PM at the Tompkins County Airport.

Committee Reports: continued
Youth: Councilman Dietrich reported at last community council meeting
they discussed next year's summer recreation program. The council
hopes to put on several fall events to raise money for a community
center.
Highway: Mr. Coddington reported they have surface treated Gunderman
Road and Muzzy Road.
Senior Citizens: Councilperson Roberts reported the group is planning
a trip to New Jersey next month.
Cemeteries: Ed Roberts reported he has been keeping the grounds mowed.
Planning Board: Don Graham reported they did not have a regular meeting •
in August. The Board did have a work session on Sept. 6 with members of
the town board to review the proposed new junk law. Attorney Clermont
is presently clarifying some of the changes made to the law.
Water District: Roy Casterline reported Wallace & Tierney have not put
the rods in the water tank as yet.
New Business:
Councilperson Oltz made the motion to appoint Roy Casterline to the
position of Water Plant Operator for the West Danby Water District effective
Sept. 2, 1984, seconded by Supervisor Miller, carried unanimously.
Supervisor Miller reported she has received a letter from the Federal
Revenue Sharing stating all facilities must be accessible to the handi-
capped persons if towns are to receive moneys in the future. She would
like board approval to work with Ed Roberts to determine what additional
work is needed to meet the requirements. She reported there is $9,000.
in Federal Revenue Sharing budget for work on the town hall. She also said
the Fire Department buildings will need to be accessible to the handicapped
also.
Judd Leonard mentioned he would like board's permission to purchase a
handbook from American National Standards Institute, Inc.. This hand-
book explains specifications for making buildings accessible to physically
handicapped people. Councilman Dietrich moved to authorize Mr. Leonard
to purchase two copies of the handbook not to exceed the price of $45.00,
seconded by Councilperson Oltz, carried unanimously.
Supervisor Miller said a resolution is needed to adopt the new dog law.
Councilperson Oltz would like the word "repeal" replaced with the word
"supercede" throughout the law and to change the wording under section 8,
redemption fees, delete the word,
it and put in "or other fees,"*

Councilperson Oltz made the motion to authorize Judge Paul Smith to
attend Justice School in Nevele, N.Y. Oct. 7 - Oct. 10, seconded by
Councilperson Roberts, carried unanimously.
Councilperson Roberts moved to authorize Kenneth Coddington to attend
Highway Superintendent School at Swan Lake, Spetember 18 - 21., seconded
by Councilperson Oltz, carried unanimously.

Sharing Handbook. The handbook explains all aspects

At this time, the board met with Judd Leonard in executive session.
Supervisor Miller explained upon returning from executive session that
they discussed a zoning problem and authorized Judd Leonard to pursue
the matter further, before a decision is made.

Councilperson Roberts moved to approve the Supervisor's report as presented.
Seconded by Councilperson Oltz, carried unanimously.
Supervisor Miller said there will be a budget workshop September 18 at
6:30 PM at the town hall.
Supervisor Miller said the board should meet to discuss the fire and
building codes. They should work to make our codes corrulate with the
state codes.
