HomeMy WebLinkAbout1984-07-24• • TOWN OF DANBY PUBLIC HEARING CABLE TELEVISION FRANCHISE AMENDMENT JULY 249 1984 07 A second public hearing was held July 24, 1984 at the Danby Town Hall, 1830 Danby Road, Town of Danby, Tompkins County, New York. The purpose of this hearing is to consider amendments to the cable television franchiGe previously granted to American Cable Television Corporation." The meeting was called to order at 7:45 PM. Board Members present:. Councilman Edward Shay Councilman Ric Dietrich Councilperson Mary Oltz Councilperson Dorothy Roberts Supervisor Mildred Miller Others present: Lee Haefele, Walter and Carol Sczepanski, David Benson, Georgia Griffith, John Grow. Carol Benjamin, Audrey Hardesty, Fred Thayer, Milton Todd, Charles Robinson, Kathy and Rick Eckert. The legal notice as advertised in the Ithaca Journal was read by the Town Clerk. L��' Supervisor opened the meeting to the public and the following views were expressed. Carol Benjamin expressed dissatisfaction . to some of the new programs offered by the cable commission in addition to poor reception with certain stations. Mrs. Benjamin said she would not be in favor of a basic rate increase. Charles Robinson spoke against a cable rate increase due to his dis- satisfaction with the change in channel selections. Audrey Hardesty felt the cable commission should get their billing system straightened out before offering a cable rate increase. Carol and Walt Sczepanski voiced concern over confusion in trying to find their favorite programs now that the cable service has changed the channels to offer new programs. Walter wanted to know what would happen if the Town turned down the cable commission's request for the increase. Georgia Griffith said the cable ser�7-ice would offer options. The cable service would consider increasing the package prices now offered or offer "a -la- carte" packages. v Fred Thayer was not in favor of the increase. He explained there are many fixed - income families who couldn't afford this increase. Milton Todd asked if West Danby residents would ever have a chance of getting cable service. Georgia Griffith explained Rick and Kathy Eckert from West Danby offered to go to the residents with a survey type questionaire drafted by the cable commission and get signatures from those that were willing to pay a specified hook -up price to get this service. So far, the Eckert's were able to get 54 signatures. Supervisor Miller closed the public hearing meeting at 9:15 PM and announced a special meeting will follow the hearing to make a decision on the rate increase and discuss other town issues. Supervisor Miller said she needs a resolution to approve town's responsib- ility in maintaining the streams if work is done in and around them. RESOLUTION # 28 MEMORANDUM OF UNDERSTANDING, BETWEEN THE DEPARTMENT OF ENVIRONMENTAL CON- SERVATION OF THE STATE OF NEW YORK AND THE TOWN OF DANBY FOR THE PERIOD JUNE 25, 1984 TO DECEMBER 31, 1984 Moved by Councilman Dietrich, seconded by Councilperson Roberts. Roll Call Vote: Councilman Dietrich - aye Councilperson Oltz - aye Councilperson Roberts - aye Councilman Shay - aye Supervisor Miller - aye Supervisor Miller said there is $16.36 in interest and penalty due on the transport permit fee that was paid in June. She said this needs to be paid otherwise the state will continue to add interest and penalties to the initial amount of $250.00 Councilperson Roberts moved, seconded by Councilperson Oltz, to authorize the supervisor to pay the interest/ penalty due on the transport fee. Supervisor Miller said the state returned t salt brine permit. According to the state, with a population under 3,000. The highway changed to $4,726.50 to correct to refund. seconded by Councilperson Roberts to change to $4,726.50, carried unanimously. he check for $25.00 for the no fee is charged to towns fund total for June will be Councilperson Oltz moved, Highway Fund Warrant #6 total Councilman Dietrich and Councilman Shay suggested a letter go to Dick Watts to inform him the town will deduct half the cost of repair to the tanker, from total amount of his bill for purchase of the tanker by the Town. Pierce Welding will be repairing the tanker. Supervisor will draft the letter. Supervisor Miller said the bill for the town audit arrived and should be paid. The bill totals $1,800.00. RESOLUTION 29 TRANSFER MONEYS FROM CONTINGENCY ACCOUNT A1990.4 TO GENERAL FUND ACCOUNT TO PAY BILL FROM CIASCHI, DIETERS - HAGEN, SCHAUFLER & MICKELSON IN THE AMOUNT OF $1800.00 FOR AUDIT OF TOWN BOOKS FOR YEARS 1982 & 1983. Moved by Councilperson Oltz, seconded by Councilman Shay. Roll call vote: Councilman Dietrich - aye Councilperson Oltz - aye Councilperson Roberts - aye Councilman Shay - aye Supervisor Miller - aye Councilperson Oltz said she was in favor of the increase in basic rate requested by the Cable Commission per town attorney's review of the franchise amendment. Councilman Shay said if the town does not approve the increase, the basic rate will stay the same which will not affect those on fixed incomes. Those with package deals will pay a little more. 0 n 1 27 Special Meeting, July 24, 1984 Page 2 After lengthy discussion and the general feeling of the public in attendance at the public hearing the following resolution was offered. RESOLUTION X630 BASED ON MAJORITY OF PEOPLE IN ATTENDANCE AT THE PUBLIC HEARING HELD JULY 24, 1984, WERE UNANIMOUSLY IN FAVOR OF NOT GRANTING THE CABLE FRANCHISE AMENDMENT. Moved by Councilperson Roberts, seconded by Councilman Shay. Roll call vote: Councilman Dietrich - no Councilperson Oltz - no Councilperson Roberts - aye Councilman Shay - aye Supervisor Miller - aye Councilman Dietrich asked the board for approval to pursue possibilities of town purchasing half of the Danby School and land for highway building and municipal offices. Councilperson Roberts, Councilperson Oltz, and Supervisor Miller felt the issue should be dropped and to concentrate on looking for land for town use.
