HomeMy WebLinkAbout1980-02-04MINUTES OF TOWN BOARD MEETING HELD MONDAY, FEBRUARY 4, 1980 AT 7:30 P.M. Those present: Teresa M. Robinson, Supervisor Francis P. Carey, Councilman Gordon C. Va.a ensQhoten, Councilman Ellard. L. Sovocool, Councilman Verl Rankin, Jr., Councilman Absent: Benjamin J. Bucko, Town Attorney Also present: Mr. & Mrs. George Lavrence, Mr. Joseph Pataki, Leland Cornelius, Robert Brown, Frank Satterly, Mary Evelyn Dempsey, Nancy McGuerty John Maines Mr. Sovocool moved that minutes of previous meetings (12/27, 1/7, 1/11) be approved as mailed. Seconded by Air. VanBenschoten. Ayes - Carey, VanBenschoten, Sovocool, Robinson (Rankin not present). Claims #7 through #33 of the Highway Department and #9 through #34 of the General Fund were presented for audit. Mr. Rankin moved that the bills be paid and the Clerk instructed to draw warrant for them. Seconded. by Mr. Sovocool. Ayes - Rankin, Carey, VanBenschoten, Sovocool, Robinson. Board reviewed monthly reports of the Town Clerk, Town Justice, Fire Report and Zoning Officers report. New officers of the Fire Department are Robert Walpole, Chief; Jim Shurtleff, Deputy Chief; Will Davie, 1st Lieutenant; Alike Shurtleff, 2nd Lieutenant. Zoning Officer issued two building permits -- R. Tillotson and L. Griep; letter to Griep; variance was granted to Marvin Torok; variance denied. to Neil Morris for sales of snowmobiles and motorcycles in an agricultural zone because he failed to show practical difficulty or unnecessary hardship other than what was self - inflicted. Supervisor Robinson read. George Bushnell's letter of resignation from the Appeals Board due to working second shift. Floyd Fouts' term ends in !March at which time he will retire. Two replacements are needed on 'the Appeals Board. Town Board will think about and make appointments at next meeting. Supervisor Robinson read letter from Historical Association regarding Stevens Road bridge being removed by County. Since it was built by the Groton Bridge Company in 1910, they feel it should. remain in the Township. Three possible locations it could be used are over Owasco inlet near the site of its manufacturer, crossing the inlet from the railroad depot to the Senior Citizen complex. A second location is across inlet from Main Street parking area to Conger Boulevard Park, end the third is the replacement of the old bridge, located on Cayuga Street, which crosses the inlet adjacent to R & H Pontiac dealership. Airs. Arlene Brown, President, would like consideration from the Town to preserve, and use, bridge where it had its "roots ". Supervisor Robinson indicated. Mr. Mobbs would be meeting with interested people on Wednesday, February 6 at 1 :00 P.M. in the Town Hall to discuss bridge. Supervisor Robinson read application of Mr. Joseph Pataki to construct a two car garage which was approved by the Zoning Officer. Date of application: August 15, 1977; Date of approval: August 17, 1977; Letter from Zoning Officer to Mr. Pataki dated October 1, 1979 indicating he was in violation of zoning ordinance by living in building and that he must get a building permit for residence; Memorandum from Attorney Bucko to Zoning Officer; ® Letter from Attorney Bucko to Mr. Pataki dated January 29, 1980, regaxding Violation of zoning ordinance. Mr. Pataki arrived and Supervisor Robinson informed him that we had. just gone over letters sent to him by Zoning Officer. and Attorney. T. Robinson: Mr. Pataki, would you like to state your case? J. Pataki: I have three alternatives and, don't know what to do until spring. 1) put trailer in, 2) build onto existing building, or 3) sell out and move. Lot is almost 12 acres. I have a drawing of what we have in mind- -drawn up a couple years ago. Mr. Pataki. showed Board plans. It is a temporary residence for now. Foundation was there and I built garage there. Lot is 300' x 225' or 12 acres. I have lived in garage since September 1. ej T. Robinson: You should. get a permit for house. The enforcement officer might allow you to live in garage for a short period of time. J. Pataki: Will my assessment change if I live in garage? T. Robinson: It's assessed. as garage and you're living in it as a house. G. Lawrence: Qestion on general procedure - like Mr. Pataki applied. to build a garage, does Zoning Officer follow up on these? T. Robinson: Yes, R. Brown I do ?mow now that he is living in it. I wrote a letter i : n October. G. Lawrence: Now long does it take to act upon. T. Robinson: Leiter was received in mail Januaxy 29, 1980. • G. Lawrence: Why hasn't something been done before this? Zoning Officer must have known about it. Did Mr. Pataki :apply for a house number? R. Brown: House numbers are fire nui4bers and can be used for any building. G. Lawrence: Did you check on additions ?........Three additions put on•garage ......limitation some place according to our ordinance. T. Robinson: The property and problem is Mr. Patakis........ G. Lawrence: Someone is at fault - - - - -I It should have been brought to the attention of......... L. Sovocool: ....... M. Lawrence: As soon as he has a. house number and mail was delivered someone should have known he was Living there. G. Lawrence: In other words, someone has to bring it to someones attention before anything is done. What you're saying is he can stay there. T. Robinson: He has to have a building permit and go through procedures. M. Lawrence: What are the restrictions to add. on? G. Lawrence: No permit for 100 square :L''eet........ . M. Lawrence: Anyone can bul.ld any number of addtions........... G. Lawrence: Board of Health issues...... ... Was letter of October read to board? T. Robinson: It was presented to board. Mr. Pataki will have to get a permit. within two or three days. G. Lawrence: No one would :,pant to build beside the building that Joe lives in. M. Lawrence: How long do you wait......? R. Brown: When I went up with building number, Mr. Pataki showed me his proposed plans. .....I can't get things moving........ G. :Lawrence: Why? R. Brown: Ben Bucko is out of town......... T. Robinson: The point is now to get a permit for home so enforcement officer a' has something to judge on. {Board's feeling was to get permit • ' whether it be temporary or not. Temporary residency depending on what it is.} • J. Pataki : I might go travelling, add on, or ad.d siding on front......... T. Robinson: Time starts from time he applies for a permit. M. Lawrence: Can he continue to build building, ........... on that permit? Temporary with no R. V. Brown: Rankin: If square footage is not He could either go to a permanent home. enough, trailer or he has to �o to Appeals Board, make that building into a R. Brown: . Zoning does give people around a building. the right to build little buildings (Some discussion was held on the above statement and zoning book was referred to by board members and public to see if additions could be added without perkit. It was unclear to the board as to what "as required.) V. Rankin: I suggest we consult our Attorney on this matter, 0 T. Robinson: Mr. Pataki, you must apply within a couple of days for a permit to live in present residence or until you construct a trailer. T. Robinson: We'll continue with our board meeting. As Supervisor of the Town of Groton, I proclaim February 3 through 9 as Cub Scout Week of America in the Town of Groton. Proclamation read.: Whereas the Cub Scouts having celebrated their 50'th year on February 8, 1980, as paxt of the Boy Scouts of America, Whereas the Young men in our community have participated in this wonderful organization, Now therefore I, Teresa Robinson, Supervisor of the Town of Groton, New York, do hereby proclaim -the week of February 3 through February 9 as Cub Scout Week in our Town. Supervisor Robinson presented the following 1.980 contracts and amounts for payment: 1) Day Care Center - $100; 2) Groton Fire Department - $19,700; 3) Groton Ambulance - $12,000. Mr. Rankin moved that contracts be paid, seconded by Air. Sovocool. Ayes - Rankin, Carey, VanBenschoten, Sovocool, Robinson. ® Mr. Frank Satterly reported that a meeting was scheduled this week on Groton Bridge with Town and Village people invited; talked with TomPayne regarding concerns of lbresa & Colleen regarding incorrect addresses on taxes -- suggested t7eresa bring up at municipal Officials Meeting and Tom will attend; he has his files established in Town }fall; he is Chailman of Social Services and on Budget and Administration committees in County. Supervisor Robinson noted the tremendous difference the new drapes had. in keeping out the cold. Also, one other problem is doorway area. cold -- -wants estimates on complete doorway at end of counter and plexiglass built into counter. Verl Rankin and Francis Carey are on building committee and were appointed to look into door and enclosure. Bob Walpole was originally going to look into and they will check with him. Also, Claude Holden explained operation of front heater which needs repair and we have found no'one to work on it yet. Leland Cornelius presented to board literature on a 10-wheel-dump truck he would like to purchase this fall. It will take about seven months to get it at an approximate cost of .$72,000. Board looked over literature and tabled matter until next meeting. There being no further business, 1*1r. Rankin moved to adjourn meeting, seconded by Mr. Carey at 9:00 P.M. Colleen D. Cornelius,, Robert Pray, Lyle Raymond, Roger Gleason, Peary Evelyn Dempsey, Nancy McGuerty Some discussion was held, on the minutes of the previous meeting regarding Mr. Joseph,Pataki's garage -home. Atorney Bucko indicated that the Zoning Ordinance states 840 sq: ft& is required. for a hoarse. It does not specify is living space. The Mobile Home Ordinance specifies a 14 x 60 or 12 x 70 trailer or 840 sq. ft. Attorney Bucko will clarify Mr. Pataki's situation with Mr. Brown and report at the next board meeting. Mr. Sovocool moved. that the minutes of February 4 be approved as mailed. Seconded by Mr. Carey. Ayes - VanBenschoten, Carey, Sovocool, Rankin, Robinson. V. Claims #34 through #64 of the Highway Department and #35 through #60 of the General Fund were presented for audit. Mr. Rankin moved that the bills be paid and the clerk instructed to draw warrant for them. Seconded by Mr.. VanBenschoten. Ayes -. VanBenschoten, Carey, Sovocool, Rankin, Robinson. Monthly reports from the Town Clerk, Fire Department and Justice Court were reviewed. Also the Town -Clerk'srAnnual Repart was reviewed. Letter was read from the Benson f'ami'ly thanking all who assisted at the time of their fire. Letter was read from Cera,cche indicating an increase of $1.00 in Home Box. Colleen Pierson, Town Representative to the County CATV Commission reported on ,meeting held .February 28 at which the Supervisor had requested assistance a
