HomeMy WebLinkAbout1984-02-13Town of Danby Town Board Meeting Minutes February 13, 1984 The regular meeting of the Danby Town Board was called to order at 8;20 P.M. at the Danby Town Hall, 1830 Danby Road, Town of Danby, Tompkins County, New York, February 13, 1984. Board Members present: Councilman Ric Dietrich Councilperson Mary Oltz Councilperson Dorothy Roberts Councilman Edward Shay Supervisor Mildred Miller Others present: Roy and Mary Casterline, Roy Hornbrook, Ken- neth Coddington, Ithaca Journal Reporter, Helen Mundel, Herb • Engman, Florence Statr, Donald Graham, Edward M. Roberts. Communciations. 1. Tompkins County Municipal Officers Assosciation's first meeting of 1984 will be held February 22. Senator Steve Riford and Assemblyman Sam McNeil plan to attend this meeting to exchange viewpoints about Govenor's Budget proposals and legislative positions. 2. Tompkins County Youth Bureau: Youth Board is having an orientation session at the Holiday Inn from 4 to 8 PM, February 22. They will present a brief presentation on where the youth and youth services are in Tompkins County. 3. Letter from Senator Sam McNeil announcing their annual pub- lic hearing on February 23 in the Board Room of the County Court House. The hearing will be on the Govenor's proposed 1984 -85 State Budget. 4. Letter from NYS Department of Transportation announcing reconstruction of Rte J54/96, portions of Spencer -West Danby and Ithaca -West Danby, 5. Minutes of West Danby Water District Meeting were presented. Johnny Sill was reappointed to the Board of Water Commission- ers for another five year term. Privilege of the floor: County Rep. Florence Starr reported they will have a public hearing February 21 on new local law (42) to amend the local law on annual income of elderly on a sliding scale. Close to privilege of the floor: Committee Reports: Youth and Community Council: Councilman Ric Dietrich reported he and town clerk mailed vouchers to Albany for matching funds on State Aid for Youth Recreation for 1982 and 1983. Mr. Dietrich reported Community Council is looking into other services for the community and will meet with interested people who would like to learn more about youth and youth services. Fire District: No report Water District and SeniorxCitizens: Councilperson Dorothy Rob- erts reported she spoke with Roy Casterline and the water table is staying up. In response to the County Health Department's request that West Danby have an emergency plan for pump break. down, Mr. Casterline said the manufacturer of the pump has someone on call day or night to come in to repair the pump. Water could also be hauled in by a tanker in an emergency sit- uation. Town Board Meeting Minutes - February 13, 1984 Page 2 The board members questioned the resolution ( #24) in 1968 re- guarding rental of fire hydrants by the water department. Councilperson Dorothy Roberts also said Senior Citizens are planning trips for this year. Environmental Management Council rep. Herb Engman reported there is concern by the EMC for the Return a Gift to Wildlife Pro- gram by the State. Questions have been raised as to how all this money will be used. EMC is looking further into this matter. Mr. Engman reported County is pleased with the out- come of the bottle bill. There is less litter as a result of this. The Jennings Pond Dam Committee is meeting with. the Finger Lakes State Parks people. The State Park feels it will be another year before work can be completed on repair of the dam. Some options raised by the committee are, the consul- tants should find that the dam is not dangerous. Another option would be to fill the pond up to allow swimming ac- tivities this summer or allow an alternative swimming area. The committee did learn one of the mean problems with the dam is the spillway is not large enough to allow flood - type water thru. Mr. Engman said Landstrom Gravel Company is asking to open a second gravel pit near the landfill. This shouldn't be of concern to Danby as the landfill is located in Tioga County. But this could encourage further gravel pits in Danby. An- other problem is 48,000 gallons of water are taken out of Michigan Hollow Creek a day between months April and October, three days a week to be used in washing the gravel. Mr. Eng- man is concerned if further pits are opened more water will be needed, which could pose a problem. Highway; Councilman Ed Shay reported a new dump truck is needed. Ken Coddington has located one in the price range of $63,000 for the truck and $8,000 for the dump body. The truck was brought to the town hall for the board members to look at prior to the meeting. Supervisor Miller said adver- ti4ement for bid for this particular item needs to be done. Bid opening will be February 28 at 5:30 PM at the Town Hall. Councilman Ed Shay said a spreader is needed. Mr. Coddington received a county bid for a Fox Spreader from Seneca Supply for $4,592.38. Councilman Shay also said a Tanker needs to be purchased this year. Councilman Ric Dietrich suggested purchasing a tanker from the fire department. Mr. Coddington said if a tanker is purchased from the fire department and its mounted on a truck, then they will be stuck with a truck they do not need. If it is just a tank it will be mounted on one of the department's dump trucks, which in turn will tie up a dump truck. Mr. Coddington suggested purchasing a trailer to haul the tanker on as the trailer can be used for many other purposes. After further discussion, Council- man Ed Shay will bring a list of advertised used equipment for sale to next meeting. Mr. Coddington said a tanker is needed by May for dust control on area roads. Planning Board: Don Graham reported he attended County Plan- ning Board meeting in January. At this meeting, New York State Department of Environmental Conservation discussed with various municipalities about flood planning manage- ment and what municipalities must do to qualify for partici- pation in the National Flood insurance program. Each munic- ipality needs to prepare a flood hazard boundary map and must be presented to DEC and passing of local law enforcing flood planning management control. Danby had maps drawn in 1974, however they are incomplete. Mr. Graham has a set of instructions fo follow for flood damage prevention local law which towns need to go by. Supervisor Miller said this should be discussed with Plan- ning Board first. Mr. Graham said this willibe done pending town board's position on this matter. E �J Town Board Meeting Minutes - February 13, 1984 Page 3 Mr. Graham reported Stuart Stein, who chairs a committee appoint- ed by County Board of Representatives to reapportion the districts in the County for purpose of electing County Representatives. Mr. Stein expects to present reapportionment plan to County Reps this summer. Don presented tentative map of reapportionment which shows Danby /Caroline district has not changed. Their goal is to come as close as possible to 5800 persons in each of the 15 dis- tricts in the county. Mr. Graham said Paul Sarokwash from village of Lansing succeeds ion Anderson as chairman of the County Planning Board. Edward Roberts reported he has talked with Pete Curry, head of Ithaca City School transportation, who said transportation can be provided to transport children downtown for swimming this summer at a cost to be determined at a later date. Council- man Dietrich said TomTran is also available for this use. Supervisor Miller said this is a matter for Community Council. • Supervisor Miller said board approval is needed to reappoint Gloria Benson as deputy town clerk. Motion made by Council - person Mary Oltz, seconded by Councilman Ed Shay, carried unanimously. • Supervisor Miller said Nancy Weitzel would like to serve on the Planning Board. Motion made by Councilperson Dorothy Roberts, seconded by Councilperson Mary Oltz, carried unanimously. Miss ;°Yeitzels's term will expire January 1987. Supervisor Miller would like to appoint her husband as her deputy. General discussion followed and the board agreed to look further into this before approving the appointment. Supervisor Miller said applications for Zoning Officer are being reviewed and an appointment will be made soon. Supervisor Miller reported on the possibility of having zoning° permits and special permits signed by two people. After dis- cussion the board agreed a resolution is needed. RESOLUTION #12 EFFECTIVE AS OF THIS DATE, FEBRUARY 13, 1984, ALL ZONING PERMITS AND SPECIAL PERMITS GRANTED WILL BE SIGNED BY THE SUPERVISOR AND ZONING OFFICER, OR BZA CHAIRMAN. Motion made by Councilman Ric Dietrich, seconded by Councilman Ed Shay. Roll Call Vote: Dietrich. - aye Oltz - aye Roberts - aye Shay - aye Miller - ave Supervisor Miller said a resolution is needed on new planned unit developments that are drawn up. RESOLUTION #13 ALL PUD AGREEMENTS WILL BE DRAWN UP BETWEEN THE TOWN BOARD AND ONE OWNER FOR ONE USE. THESE WILL BE INTRODUCED AS A RESOLUTION WITH ALL INFORMATION AND ALL RESTRICTIONS CAREFULLY STATED. THE RESOLUTION TO BE DRAWN UP BY THE TOWN ATTORNEY, TOWN CLERK WILL NOTE VOTES OF TOWN BOARD ON RESOLUTION AND ATTEST TO SAME. OWNER WILL BE ASKED TO GIVE A SIGNED STATEMENT TO THE TOWN CLERK THAT HE ACCEPTS THIS RESOLUTION AGREEMENT AND WILL ABIDE BY ITS RULES. Motion made by Councilperson Mary Oltz, seconded by Councilperson Dorothy Roberts, Carried unanimously. Highway Fund #2 in the amount of $x10,069.57 was approved to . be paid. Roy Casterli.ne said he would like the toUm board to concentrate on clearing up the eyesores in Danby and getting the trailers out that should not be in Danby. Councilperson Dorothy Roberts made the motion to accept the Supervisor's reports as presented, seconded by Councilperson Mary Oltz, carried unanimously.
