Board Members Present: Councilperson Sylvia Hiney Councilperson Dorothy Roberts Councilperson Mary Oltz Councilman Ted Merritt Supervisor Mildred Miller • Others present: Frank Haskins, Don Graham, John Benjamin, Edward Shay, Herb Engman, Edward Roberts (Bald Hill Rd.), Edward Slights, Roy Casterline, Glenn Casterline, Garry Huddle, David Benson, Florence Starr, Ithaca Journal Re- porter, Carol Sczepanski, Mr. Gartlein, Gay Huddle, Roger Hile, Jim Hovanec, Lori Bard. Supervisor Miller opened the meeting with the Pledge of Allegiance. Communications: 10 Resolutions were read from County Board of Represen- tatives. A. Establishing County Equalization Rates. Danby (102.71) B. Apportionment of Mortgage Tax. Danby ($6,992.40) Co Workers Compensation Budget & Apportionment - Mu- tual Self- Insurance Plan. Danby ($36,989,297 - full value, full value apportionment, $107.77) D. Apportionment of Election Expenses. Danby ($654.84) 2. Letter. from Community Council President, Charlene Testut. On November 2, 1983 a resolutinn.,.was approved to move the wooden gym structure from Danby School to South Hill School, 3. Letter from Tompkins County TV Cable Commission. Meet- ing held on October 27, 1983 and motion was passed to suspend dues. Motion passed to hold one (1) meeting per year. Next meeting will be June 21, 1984, 7 :30 PM Town of Ithaca Building, 4. Letter from Eva Mae Musgrave. Due to increased de- mands, Mrs. Musgrave is resigning as Town of Danby Rep- • resentative to County Youth Board, effective December 31, 1983. Supervisor Miller requested Federal Revenue Sharing Budget • as presented at November 14 Public Hearing Meeting be corrected under Youth Recreation the amount should read $500 each - Danby and West Danby. A correction to be made for November 14th regular Town Meeting minutes. Change wording on Resolution #31 from Board Members to Town Employees. Supervisor Miller re- ported at November 14th meeting Mr. Don Graham said there is County money available for stream maintenance for Danby. She explained there is no money available as no one applied for it at time it was needed. Mr. Graham explained all money for 1983 is spent. However there will be appropriation for 1984 ($20,000) and encouraged Town to put in proposal for funding of stream maintenance. County Board Representative Florence Starr said a request in dollar amount should be made soon and directed to Mr. Frank Liguori. Town Board Meeting Minutes - December 12, 1983 EM Councilperson Dorothy Roberts moved to approve November 14th Public Hearing Minutes and November-Regular Meeting Minutes as corrected, seconded by Councilperson Mary Oltz and carried unanimously. Privilege of the Floor: County Representative Florence Starr reported Tompkins County Hospital (old) has been sold. The new Tompkins County Jail will be located in City of Ithaca. The Fire Prevention and Bu�.lding Code for the County has been passed on to the State for enforcement. Supervisor Miller mentioned town of Danby has opted to do their own enforcements. Supervisor Miller asked Town Clerk to read letter she received from James Brennen from Dept. of Social Services. Mr. Brennan is seeking names for appointment on Social Services Advisory Council for 1984. Jim Hovanec spoke regarding his feelings that Danby School should have been purchased by the Town. Herb Engman reported he attended his first BZA Hearing in Danby. He is concerned over the proceedings of the hearing. Mr. Eng- man presented a letter shish he in turn will send to the BZA chairman requesting a review of the matter pertaining to con- struction for a hunting camp on Hill Road. Copies of letter voicing all violations were presented to Board Members. Close to privilege of the floor. Committee Reports: Environmental Management Council: Herb Engman reported the committee for Danby Pond dam matter met and will be setting up a meeting with State Parks personnel soon. The state is proposing the dam at Danby Pond not be repaired until end of 1984. summer. Mr. Engman suggested town take over the control and review of the area's wetlands. Supervisor Miller said a letter to proper officials would be beneficial. Mr. Engman will do this. Economic Opportunity Council': Councilperson Sylvia Hiney re,- ported only one - thire of county wide food distribution was re- ceived. Community Council: Councilperson Mary Oltz reported Council is still seeking new officers for 1984. President Testut will serve until a new president has been appointed. Board of Zoning Appeals: Edward Roberts reported that each case presented to the BZA Board is considered on its own merits. The latest hearing pertained to a hunting camp on Hill Road owned by Gene Johnson and leased through Cotton Hanlon. There were no people present ether than Mr. Engman to voice against this camp's presence. The owners were unaware of any zoning en- forced in Danby. The owners are aware of violations and took care of the matters. In the fall the BZA board held a hearing regarding Hubert Dorn property. Mr. Dorn is selling most of farm and property line had to be redrawn so Floyd and Rose Dorn can have life time use of home and right ow way use of driveway. Received 54 dogs for the year, adopted out 41, 9 dogs redeemed by owners, one dog was put to sleep and one died from injuries. She has dealt with 169 calls. Miss Bard voiced concern that she had had no luck with Ithaca Journal to get anyone to write an article about her dog warden duties or to place free advertisemtn for dog adpotions. She also f6els she should be paid $5.00 per day for dog warden services as she has figured out she is present- ly making $2.00 per day. Miss Bard:Jwould also like to im- prove her dog run and gave prices for the cost. She questioned raising dog impoundment fees to $10.00 com- pared to $7.50. Board members agreed too much is involved • to change this local law and will keep fees at $7,50 for present time. • Supervisor Miller said a resolution is needed to allow town clerk to not mail back tax receipts unless taxpayer sends self - addressed etamped envelope. • • RESOLUTION # 36 AUTHORIZE TOWN CLERK /RECEIVER OF TAXES FOR 1984 INSERT WITH TAXE'�.BILLS A NOTE STATING THAT RECEIPT WILL NOT BE MAILED UN- LESS A SELF ADDRESSED STAMPED ENVELOPE IS ENCLOSED WITH PAY - MENT. CANCELLED CHECK IS YOUR RECEIPT. Motion made by Supervisor Mildred Miller and seconded by Councilman Ted Merritt, Roll Call Vote: Hiney - aye Merritt - aye Oltz - aye Roberts - aye Miller - aye Supervisor Miller would like board approval to attend Super- visor's and Legislator's annual winter conference in Bing- hamton January 22 thru 25, 1984. Motion made by Council - person Dorothy Roberts, seconded by Councilperson Mary Oltz and carried unanimously. Supervisor Miller said a resolution is needed to transfer monies from reserve account (A872) to the dog warden account to pay bills. RESOLUTION # 37 TRANSFER $61.44 FROM RESERVE ACCOUNT FOR DOG CARE,_ A872 TO GENERAL FUND ACCOUNT 03510.4 TO PAY BILLS. Motion made by Councilperson Sylvia Hiney and seconded by Councilperson Mary Oltz. Roll Call vote: Hiney _ aye Merritt - aye Oltz - aye Roberts - aye Miller now aye Supervisor Miller said a resolution is needed to accept Roger Hile's resignation as highway superintendent. Letter of res- ignation was read by Town Clerk, RESOLUTION #38 REGRETFULLY ACCEPT THE RESIGNATION OF ROGER HILE AS HIGHWAY SUPERINTEN- DENT, EFFECTIVE DECEMBER 31, 1983. Motion Councilperson in the amount of $3,703.53 was approved e by Councilperson Dorothy Roberts and Miller and carried unanimously. A public hearing was hearing was held by the Town Boardof the Town of Danby at the Danby Town Hall, 1830 Danby Road, Ithaca, New York, on December 12, 1983. The purpose eof.this hearing.-'�will' be to hear all interested persons to consider a.proposal.made by the Ithaca Theater Lighting, Inc. to the Ithaca City School District for the purchase of.the Danby School. The hearing was called to order at 7:40 PM. Board Members present: Councilperson Sylvia Hiney Councilperson Dorothy Roberts Councilperson Mary 01tz Councilman Ted Merritt Supervisor Mildred Miller Others present: Mark Malkin (Ithaca Theater Lighting) , Willie Pierce (Ithaca Theater Lighting), Edward Shay, Herb Engman, Edward Roberts, Edward Slights, Roy Casterline, Glenn Gasterline, Garry Guddle, David Benson, Florence Starr, Ithaca Journal Reporter, Carol Sczepanski, LhrisGartlein, Gay Huddle, Edward Roberts (Danby Rd.) Roger Hile, Gary Lindenbaum. The advertisement for public hearing was read by the Town Clerk, Supervisor Miller introduced Mr. Gary Lindenbaum, assistant administrator for Ithaca School District, Mr. Lindenbaum explained the Danby School has been leased to. Ithaca Theater Lighting who in turn has made a purchase offer to the School District for purchase of the school. The financial statement of Ithaca Theater Lighting has been reviewed and several meetings between Ithaca Theater Lighting and School District will follow. Mr. Lindenbaum turned the meeting over to Mr. Willie Pierce, President for Ithaca Theater Lighting. Mr. Pierce explained ITL was formed in 1974 by four Cornell graduates. ITL builds computers that control television and stage lighting. They employ 20. A purchase offer .amounting to.$75,000, has been made for the building and surrounding acreage. Mr. Pierce stressed ITL would like to make the gym and grounds available to residents under controlled conditions. Mr. Pierce pointed out the roof is in need of repair amounting.to $125,000 to 150,000. Financing of roof will be done out of own operating expenses over different stages. Resident Herb Engman inquired as to whether chemicals are being used. Mr.. Pierce explained ITL is only an assembly house and if chemicals are used they'are bio- degradable.. The only chemicals that would be used would be light chemicals used in: cleaning and in very low quan tities. The chemicals are disposed of through septic system. Out of this meeting the committee will make recommendations to the school board. The board will then vote and if vote is positive then -it means they have voted to,approve-sending.it to re- zoning. In turn another public hearing will take place, it will then go back to school board for final decision. With-no further comments the meeting was adjourned at 8:00 PM.
