Re: Supplemental Agreement for State Street Retaining Wall
On September 7, 2016 and September 5, 2018 Common Council authorized $816,400 for
the design and right of way phases of a federal-aid capital project to reconstruct a very
large retaining wall in the 400 block of East State/MLK Jr. Street, and in the 2019
Budget, Common Council authorized an additional $3,735,000 to cover the construction
and construction inspection (C/CI) phases of the project. For both phases, we are
certain to get 80% reimbursed with federal transportation funds. Additionally, we have
received $104,715 in state aid to defray the local share of the design and right of way
phases. We are concluding our engineering and acquisition phases and need to next
execute a supplemental agreement with NYSDOT for federal funding of the C/CI
phases of the project. No additional funding authorization is needed at this time
because funding for these phases were included in the 2019 City Budget. I do not yet
know how much state aid will be made available to help offset the local share. If they
commit to 15% of C/CI, the City’s overall share of the project will be about 5% or
$245,315 of the estimated total project cost of $4,551,400. If they make no commitment,
the City’s overall share of the project will be about 18% or $805,565. It is likely to be
somewhere in between and I hope to know this number before the Common Council
meeting on August 7th.
Please find enclosed a proposed resolution for the supplemental agreement to cover the
construction and construction inspection phases of the project. We expect to bid the
project late this fall for 2020 construction.
