Pierson Town Clerk MINUTES OF TOWN BOARD MEETING HELD MONDAY, AUGUST 61 1979 , AT 7:30 P a M * Those present: Teresa M. Robinson, Supervisor Gordon C. VanBenschoten, Councilman Ellard L. Sovocool, Councilman Benjamin J. Bucko, Town Attorney Arrived Late: Verl Rankin, Jr., Councilman Absent: Robert F. Walpole, Town Justice Also present: Mary Evelyn Dempsey, Robert Williams, Robert Brown, Nancy McGuerty, Carl Francis, Mr. & Mrs. William O'Conner Resolution #25 was amended to read ,job title "Recreation Activities Specialist ", and Resolution #26 was amended to read ,job title "Manual Services Workers ". Moved by Mr. Sovocool to accept minutes of previous meeting as amended. Seconded by IsIr. VanBenschoten. Ayes - VanBenschoten, Sovocool, Robinson. Claims #178 to #207 of the Highway Department and #175 to #201 of the General Fund were presented for audit. Mr. VanBenschoten moved that the bills be paid and the Clerk instructed. to draw warrant for them. Seconded by Mr. Sovocool. Ayes - VanBenschoten, Sovocool, Robinson. Board voted unanimously -to recess for executive meeting at 7 :4o P.m. Board meeting reconvened at 7:45 P.hi. Supervisor Robinson stated that the executive meeting was a personnel matter and no names would be given out now for County Youth Board Representative. Zoning Report - 8 building permits issued. and 5 letters written. James Lockwood is in violation of zoning ordinance with old trailer, junk cars and new trailer is undersize. Sherry O'Brien has not complied since his Special Motor Vehicle Repair Shop License was denied and has gone by time for court appeals. John Anderson does not have his junkyard license and is in violation. Attorney Bucko was authorized to take J. Anderson to ® court but Atty. Bucko indicated that sheriff did not serve papers in time and 'therefore will have to process again. Robert Williams was sent a letter by Zoning Officer to clean up junk. Mr. Williams stated he dad not receive letter but is cleaning up. He also asked about Haxry Strong's old place on Smith Road that was never filled in after a fire. This does not fall under Zoning butt Unsafe Buildings Law. James Jenson on Chipmans Corners Road has not obtained a building permit. Edward Isluzzy on Sharpsteen Road has an undersize trailer - -has been taken care of. RESOLUTION NO. 28 - APPROVE C014TRACT FOR CA3LE TV LINE EXTENSION TO McLEAN=,CORTLAND ROAD RESIDENTS Moved by Mx. VanBenschoten, seconded by Mr. Sovocool Ayes - VanBenschoten, Sovocool, Robinson, Rankin RESOLVED, that the Torn Board approve the contract with Ceracche and residents on McLean- Cortland Road for Cable TV Line Extension. 7.8 RESOLUTION NO, 29 - CHANGE SEPTEMBER BOARD MEETING DATE Moved by Mr. Rankin, seconded 'by IoIr. VanBenschoten Ayes - VanBenschoten, Sovocool, Rankin, Robinson RESOLVED, that the regular September Board Meeting falling on Labor Day be changed to the following Monday, September 10, 1979 @ 7 :30 P.M. At 8 :00 P.M. a Public Hearing was held. to consider increase in income limitation for 50 percent tax exemption for real property owned by persons 65 years of age or older. Decision was tabled until next meeting. .Discussed proposed new Ag District on the (Jest side of Town. Individual farmers have tentatively agreed to put their farms into the district which will protect their farm land for 8 years. A final hearing on Ag District will be held August 14 at the County. Discussed new dog law and the role of -the Local Government in implementing the new law. Moved by Mr. Rankin to appoint Itr. Robert Chapman as Dog Enumerator. Seconded by Mr.. VanBenschoten. RESOLUTION NO. 30 - PROPOSED 1980 TO1,4M HIGHWAY IMPRO'&1MEDIT PROGRAM Moved by Mr. Rankin, seconded. by Mr. Sovocool Ayes - VanBenschoten, Sovocool, Rankin, Robinson BE IT RESOLVED, to proceed. with 1.980 Town Highway Improvement Program to include one mile of Salt Road north from McLean- Peruvi'lle Road. Leland Cornelius reported on.the mining school he attended at Broome Community Colledge to become an instructor for all Highway Employees. They must get 24 hours of instruction before next April. Must be done on Town time. RESOLUTION NO, 31 - AUTHORIZATION FOR TOWN AT 0PJIEY TO BRING ACTION AGAINST ZO,`IING VIOLATORS Moved by Mr. VanBenschoten, seconded by Mr. Sovocool Ayes - VanBenschoten, Sovocool, Rankin, Robinson RESOLVED, that the Town Board does hereby authorize Town Attorney to bring court actions against John Anderson, Sherry O'Brien, James Lockwood and James .Jenson for zoning violations per Mr. Robert Brown, Zoning Officer. Supervisor Robinson reminded committees that it is getting time for input into budget. Kenneth Roberts resigned verbally effective this date from his position as Town Constable to continue his education out of State . Air. Rankin moved to accept resid ation, seconded by Isr. VanBenschoten. Ayes - VanBenschoten, Sovocool, Rankin, Robinson. Discussed having a Town Picnic for Highway Employees, all Boards and Officials and their families to be held Monday, August 27 at 6:00 P.M. at Sykes St. Park. Committee consists of BenBucko, Robert Walpole, :Leland Cornelius and Gordon VrLnBenschoten . Supervisor Robinson received a letter from Mr. James Curtin, Architect. He has agreed to draw schematic design for this building for a set fee of $4,225. If it proceeds to construction, he will live up to the proposed agreement. Mr. Rankin moved that the Town enter into contract with Architect for the $4,225 schematic design. -- Defeated without a second to motion. It was noted that the West Groton Polling Place ha.s been accepted by the County Election Commissioners. Frank Satterly reported that County is working on preliminary budget and would like Town to reserve time at next meeting to get our input or our feelings one, Dogs - informational only - -will be discussed at next Mondays meeting; heard nothing on McLean Project; Boardman House - -CETA to strip inside. Supervisor Robinson informed board the new equalization rate for 1978 is 105.85. 0 79 RESOLUTION N0. 32 - TRANSFER $200.00 FRO11o1 A1990.4 to A1620.1 and $100.00 FROM B 1990.4 to B 8020. 1 Moved by Mr. Sovocool, seconded by Fix. VanSenschoten Ayes - Mr. VanBenschoten, Sovocool, Rankin, Robinson RESOLVED, to transfer $200.00 from Contingency Fund A1990.4 to Custodian Fund A1620.1 and $100.00 from Contingency Fund B1990.4 to Secretarial Fund B8020.1. Review of monthly reports: 1) Zoning Officers - 3 building permits issued and a letter written to Francis White to apply for a Motor Vehicle Repair Shop Permit. Supervisor Robinson indicated attorney Bucko wanted a resolution from 1' board to file criminal complaint against John Anderson. Board, wants to knot.* reason for filing criminal action. Moved by Pir. Walpole to table action until we hear from Attorney Bucko. Seconded by Mr. VanBenschcten. Ayes - Unanimous. 2) Fire report, Town Justice Report and. Town Clerk's Report were reviewed. Supervisor Robinson read letter of resignation from Zana Kane who worked on the Groton Youth Committee. Moved by Mr. Walpole to accept, seconded by Pir. Rankin with clerk to send letter of thanks. Ayes - Sovocool, Walpole, VanBenschoten, Rankin, Robinson. Discussed previous hearing held on income limitation for aged. Supervisor Robinson stated it would affect a very minimal amount of properties - 10 or 12. Some discussion was held.as to the amount to raise it to noting it will not go into effect until. 1981. RESOLUTIO14 N0. 33 - INCREASE INCOME LIMITATION FOR 50f TAX EXEMPTION To $8000 iv 1981 Moved by Mr.. Sovocool, seconded by Mr. Walpole Ayes - Sovocool, Walpole, VanBenschoten, Rankin, Robinson RESOLVED, that the Town of Groton would increase income limitation for 50 percent tax exemption for real property owned by persons 65 years of age or older to $8000 in 1981. Moved by Mr. VanBenschoten to amend Resolution No. 31 indicating James Jenson is not in violation of Zoning Ordinance since he had purchased a building permit. Seconded by Mr. Rankin. Ayes - Sovocool, Walpole, VanBenschoten, Rankin, Robinson. No action was taken to appoint a Constable since one is sufficient for the time being.
