HomeMy WebLinkAbout1983-07-11• �J 0 TOWN OF DANBY TOWN BOARD MEETING MINUTES July 11, 1983 The regular meeting of the Danby Town Board was called to order at 8:07 PM at the Danby Town Hall, 1830 Danby Road, Town of Danby County of Tompkins, and State of New York on July 11, 1983. Board Members presents Councilperson Mary Oltz Councilperson Dorothy Roberts Councilman Ted Merritt Councilperson Sylvia Hiney Supervisor Mildred Miller Others present: Florence Starr, Frank Haskins, Joel Gagnon, Ed I'•'I. Roberts, Evelyn Eisenberg, Herb En4aman, Roy and Mary Caster - line, Roger Hite, Rolland Manley. Supervisor Miller requested the June 13 m &nutes be corrected to have the following addition. "Carried by majority vote. Mrs. Cler- mont will write up the special permit for Mr. Henion with contin- gencies that were apparent from the FFA and State. Councilman Ted Merritt made the motion to accept the June 13 min- utes as corrected, seconded by Councilperson Dnrrnthy Roberts and carried by unanimous vote. Councilperson Mary Oltz asked that her name as in attendance at the June 27 laublic Hearing be deleted as she was absent from the meeting. June 27 Public Hearing minutes were approved as corr- ected. Supervisor Miller is requesting resolution to pay Karl Oltz every two weeks during the mowing season. He is helping mow the ceme- teries in Danby. She has paid him $111.00 so far. RESOLUTION #21 Roll call vote: Hiney Merritt Oltz - Roberts Miller aye - aye aye - aye - aye PAY KARL OLTZ $111.00 AS PRESENT EXPENSE AND TO PAY HIM ON A BI- WEEKLY BASIS UNTIL END OF MOWING SEASON. Motion made by Councilperson Dorothy Roberts and seconded by Councilperson Sylvia Hiney and carried by unanimous vote. Communications: 1. Letter from New York State Electric & Gas Corporation list- ing names of employees to contact in case of gas leak in Danby Area, 2. Letter from Betty Melchen donating $100 to the Town in appreciation for the fine care of the Adams' Settlement Cemetery and also donation of $25 from Mrs. Edgar Mandeville for the care of Mandeville cemetery. Both women complmented Mr. Ed Slights for his previous care of the cemeteries as well as the present caretakers. Privilege of the Floor: County Representative, Florence Starr reported the Jail Study Committee has received the report on jail conditions. This re- port reccommends that a new jail be built. Sites mentioned are near the airport and off Route 96 on the old hospital property. The Jail Study committee will make a presentation of their de- cisions sometime in August. Commissioner Brennan informed the Human Services Committee that they may be a million dollars short by the end of the year in Social Services. She also reported Tompkins County Health Department will contract for lab services with the following state certified laboratoiies: Cornell Univer- sity and Friend Lab in Waverly. Expenditure: $6,000. Town Moard Meeting Minutes - July 11, 1983 Page 2 Evelyn Eisenberg requested permission to put a trailer on her property for herself. Supervisor Miller explained Mrs. Eisen- berg will need to speak with Zoning Officer who will present the request to the Board of Zoning Appeals. Zoning Officer Frank Haskins reported he has issued five new building permits for new buildings in June. Edward M. Roberts reported former caretaker, Ed .Slights has been Me Close to privilege of floor, Old Business; At last month's meeting, Councilman Ted Merritt questioned if TV Franchise contract had expired. Supervisor Miller reported fran- chise runs until 1988 with privilege of extending an additional five years. Supervisor Miller read letter from Tompkins County Traffic Safety Board in regards to a letter they had received from Columbia County Traffic Safety Board. Their letter pertains to deter- mining maximum speed limit on town and county roads. Columbia County's concern was present procedure for obtaining reduced speed limits, ie: lengthy time frames that such request takes. Columbia County traffic board is encouraging town boards to adopt local resolution requesting change in NYS vehicle and traffic law, articles 40 and 41. General discussion followed as to how long it takes to get speed limits on certain roads now. Decision on above resolution will follow later in the meeting. Committee Reports: Environmental Management Council: Herb Engman reported that there will be discussion of control Program of Hogweed at their next meeting. The weed is apparently toxic to some people. The only way to control this weed is through systemic root appli- cation. He also mentioned that on the Federal Income tax re- turns there was a box you could check for contribution to "Re- turn Gift to Wildlife% The EMC has been concerned as to what the State is going to do with this money. There are 47 pro- grams that the money could be used for, as reported by the De- partment of Environmental Conservation. Herb felt that some of these programs are not what people have contributed their money for. He also reported that Tom Tran is sponsoring a bus route . in to Ithaca for summer school students. The bus will be stop- ping in tow places in Danby this summer. He left a schedule to be posted. Community Council - Councilperson Sylvia Hiney reported 48 scholorships for camp were received. Each child received 160 funding towards their camp fee. Senior Citizens: Councilperson Dorothy Roberts reported the Senior Citizens are seeing a play in Corning. Pond Committee: Ed Roberts mentioned the spillway at pond is in need of repair. Also the pond is very weedy. Roger Hite mentioned putting copper sulfate in to get rid of the weeds, and it won't hurt the fish. Cemeteries: No report Water District: Roy Casterline reported each watershed will now have to pay for their own lab samples. He also voiced con- cern to the fact that George Armstrong is not covered by work- man's compensation. Could he be put on payroll so he would be eligible for the coverage. General discussion followed as to how town could pay Mr. Armstrong. George works for Roy when he is away. Roll call vote; Hiney - aye Merritt - aye Oltz - aye Roberts - aye Miller - aye Carried by a vote of four ayes and one nol Supervisor Miller reported Rolland Manley would like to serve on the planning board as there is an opening. Councilperson Dorothy Roberts made the motion to approve Mr. Manley's position on the Planning Board and seconded by Councilperson Sylvia Hiney and carried. Term of office is seven years. Supervisor Miller said Mr. Manley will need to resign his post as town constable. The Board will neede!to find someone to fill this position. Supervisor Miller reported the Board will need to reappoint MFT Edgar Oltz to the Board of Zoning Appeals for another five year term. Councilperson Dorothy Roberts made the motion to reappoint Mr. Oltz and seconded by Councilperson Sylvia Hiney and vote carried. Also the term for Edward M. Roberts is up and Mr. Roberts needs to be reappointed. Motion made by Councilperson Mary Oltz and sec - onded by Councilperson Sylvia Hiney and carried. Highway Superintendent Hile reported highway department will not be able to use salt brine. The State has stopped Arco from allow- ing towns to haul salt brine. In place of the salt brine, towns will need to use dust oil grprocessed oil). He said this is emE pensive. Mr. Hile said the mower keeps breaking down and feels town should look into purchasing a new one. He knows of a mower that is for sale by the State; a John Deere tractor with side mounted mower prices at $10,893.58. General discussion followed as to what funds are available for this. He mentioned this mower is a state bid and town would not need to bid out for such trac- tor. Councilperson Mary Oltz felt town should. Roger also re- ported he knows of a road tractor, 1973 Mack that is for sale by an individual owner in Syracuse. This tractor is needed to haul towns low -boy. The sale price for this vehicle is yt.11,500. Gen- eral discussion followed condition of this road tractor. • Supervisor Miller presented plans of Bruces Planned Unit Develop- ment. Bruces' Business is for sale and purchase price is $75,000. She has talked with town attorney about this property and town can make purchase offer subject to permissive referendum. There is quite a time element involved in this. There is no well drilled at the business site only at Mr. Bruce's residence and because of this Supervisor Miller suggested Town make a purchase offer of only $55,000 Councilpersons Mary Oltz and Dorothy Roberts felt an engineer should look into whether town should purchase this land for the highway department. General discussion followed as to whether Bruces' buildings are feasible to house highway equipment. It was agreed the town should spend $250 to hire someone to do study on this. Councilperson Mary Oltz said she wondered what chance the town would have in selling the present Highway department prop- erty. Town Board Meeting Minutes - July 11, 1983 Page 4 Warrants* Highway Warrant #7 in the amount of $3,388.69 was approved to be paid. Motion made by Councilperson Dorothy Roberts and secon- ded by Councilperson Sylvia Hiney and carried by unanimous vote. General Fund #7 in the amount of $737.82 was approved to be paid. Motion made by Councilperson Mary Oltz and seconded by Council - person Dorothy Roberts and carried by unanimous vote. ;Jest Danby Mater District #7 in the amount of $152.90 was app- roved to be paid. Motion made by Councilman Ted Merritt and seconded by Councilperson Sylvia Hiney and carried by unani- mous vote. Federal Revenue Sharing Abstract in the amount of $1,000 was approved to be paid. Motion made by Councilperson Sylvia Hiney and seconded by Councilperson Dorothy Roberts and carried by unanimous vote. Councilperson Dorothy Loberts mad$ the motion to acdept the Supervisor's reports as presented and seconded by Council - person Teary Oltz and carried by unanimous vote. General discussion followed as to what funds would be avail- able to use towards the tractor /mower and road tractor that needs to be purchased. Although there are funds available to some extent in the highway accounts the money should stay in for emergencies, payroll, etc. Supervisor Miller suggested financing would be more beneficial at this time. Councilman Ted Merritt made the motion to authorize -town clerk to advertise for bids for road tractor, seconded by Council - person Dorothy Roberts and carried by a vote of five ayes and no noes. RESOLUTION #23 AUTHORIZE TOWN CLERK TO ADVER- TISE FOR BIDS FOR 1973 MACK 10 WHEEL TRACTOR. BIDS TO BE OPENED AND READ AUGUST 91 PRIOR TO REGULAR TOWN BOARD MEETING 7:30 PM. Roll call vote: Hiney - aye Merritt - aye Oltz - aye Roberts - aye Miller - aye Supervisor Miller would like resolution to authorize her to spend money for a study on feasibility of Bruce's Business for use by Highway Department. RESOLUTION #24 AUTHORIZE SUPERVISOR MILLER TO SPEND $500 AS MAXIMUM TO HIRE SOMEONE TO DO STUDY ON BRUCE'S PLANNED UNIT DEVELOPMENT FOR USE BY HIGHWAY DEPARTMENT. Motion made by Councilperson Dorothy Roberts and seconded by Councilperson Mary Oltz and carried by a vote of five ayes and no noes. Roll call vote: Hiney - aye Merritt - aye Oltz - aye Roberts - aye Miller - aye Councilman Ted Merritt made the motion to adjourn the meeting at 10:25 PM and seconded by Councilperson Mavy Oltz and carried.
