BALDIN I EDISCN JCNES, Building Commissioner & Secretary THE CHAIR: Opens meeting and advises Appellant that with only five members present and voting, four affirmative votes will be necessary for the granting of an application. ROGER B. SOVOCOOL: We will move ahead on No. 878. THE CHAIR: Tonight we have 'for consideration Case No. 878, the Appeal of Joseph T. and Cordelia Mae Scaglione of 313 Lincoln Street, Ithaca, New York, for a variance for use as barber shop at 313 Lincoln Street, under provision of Section 7, Column 3, in an R-3 district. MR. SOVOCOOL: I am Roger Sovocool, appearing here for Joseph T. Scaglione, the Appellant. And we have Mr. and Mrs. Rudy Sebastian here and Mr. Sebastian wishes to occupy the premises being asked for as a barber shop, and he will be available for any questions which you might have regarding his operation. Mr. Scaglione has a piece of property, located at 309-311- 313 East Lincoln Street, which is now occupied by a small restaurant, called Mae's Kitchen, called this after his wife' name, which is a family operation. Next to the restaurant in part of the same building was Nan's Beauty Shop, which operated there since 1966 and moved out in February of this year. This property was formerly in a commercial zone, but is now zoned R-3, and so constitutes a non-conforming use. The property does have around it a number of commercial + areas. Next door is a laundromat; just down the street on Aurora Street, a barber shop, a restaurant, a small store, over the years. Going from Aurora Street towards Tioga Street, Fletcher's was on the corner but they have just moved out. You then cross over on Tioga Street and there Farrell has a place for repair and storage of washing machines. So we find we have quite a few commercial buil- dings in the area. n1 . 30VOCOOL: 1-Ir. Sebastian wants to run a small barber shop; he will �.. probably close at 5:30 or 6:00 o'clock; he will be closed on Mondays; there will be no Sunday operation, no traffic alazard; he anticipates a small service to the nieghborhood type of business; there will be one chair. I do not see how this poses any safety or traffic problem. No structural changes are necessary, no excess lighting, no machinery operating, so we do not need to worry about loud noises or any hazard to the neighborhood. In fact, probably the operation would be very similar to the one run as Nan's Beauty Shop. MISS MARTIN: I take it when the beauty shop started, he came for another variance. Each time there is a change in business, do you come before the Board? MR. SOVOCOOL: Every time there is a change in use, as I understand. I am appearing for Edward P. Abbott in this appeal. I do have a letter dated April, 1966, in which he said "Use of premises for Nan's Beauty Shop is a conforming variance". That oon- tinued until February of this year. MISS MARTIN: Is this the same location as where there was a leather goods shop? MR. SOVOCOOL: No, that was where Boice was. .MISS MARTIN: Wouldn't there be less traffic? liouldn't a different type of operation cause fewer people coming and going? MR. 30VOCOOL: I would assume a specialty shop might attract people from outside the City, whereas Mr. Sebastian is asking for a neighborhook type of shop. 1R. LUCENTE: What signs would you want? PR. SEBASTIAN: Just lighted signs, not flashing. MR. JCKES: He knows he will be permitted up to 50 feet. THE CHAIR: Will this be a Union shop? MR. SEBASTIAN : Yes. MR. ROGAN: There is another part of that building. Do you have to come back for a variance too on that? MR. 30VOCOOL: I assume he would have to come back. THS'' HAIR: This is in an R,-3 residential. Is there any one to speak in favor? None. Is there any one to speak in opposition to this appeal? None.
