conform with requirements of Mise► 7, Columns 2 and 4 in an 1-3 tone.
11RDUN I May it-please the Court, I as attorney for Mir. VIIIlaw who
can not be hones`°_tonight due to the fact that he is out of town, and Mr. John
Pitts is altar appearing as broker. Mr. Williams is the proprietor of the
Cayuga Electric whose pet location is on deet Buffalo Street, and we ask
this Board to take judicial, notice of the way that business Is carried on. fir,
William is contract purchaser with bars. Mildred Rocker. With respect to these
premises they are located at 305 Best Lincoln Street, premises tient have a son
conforming use as gar as an R•3 tons is concerned. The Rocker Rag Business

has bee* carried on there for a good amber of years, but now it is a hardship
for Mrs. Recker to carry on this business since 'Nr. Rockers Beath, and if this
property is not sold under the existing contract it will be as eyesore In the
area. The contract is subject to the toning lav of the City of Ithaca and it
is necessary to obtain a permit to carry on as a business. atherwlsa the pur-
chase offer will be null and void. With respect to the present building it has
a 'frontage on Lincoln Street of 132 feet, a depth of 194 feat; the existing
building is 3000 square feet, and is 30 by 601, and has a setback from this stre t
dine of 19 feet on Lincoln Street and 21 feet on Wi l loo avenue. The prepbsed
building will be 54 by 100 and also have a set•baeck feces the street ltae of 19
feet adn 11 feet from the westerly line„ all of which dimensions are within the
roquireaents of the toning lav as we now have it at a minimum of 10 feet. The
back arena will be 115 feet in depth and 73 feet at the rear of the proposed
addition for which the appiicot oa: is now before the Board. The tarred land area
is 23,688 square feet'The building area with the addition will be 8000 square

Q. Is it fair to say that you.oa>rry on a wholesale lumber business on a larp
seals, perhaps the largest in Ithaca?
A. Yes.
Q. Moes your area hav* certain limits?
A. It is not strictly local. It extends to Cheawng County,, Tompkins County,
T ogs County and all surrounding counatiesw and emanates from this loc&tiom.
Does thin company carry on an advertising ea"iga?
A. Us, we have a 12-page pamphlet going out this week, and we advertise in
the Ithaca Journal every other week and we are on the tadio and we send
out mailers.
Q. Do you have any permanent situ presently on your premises?
A. A semi-permanent, about 4 by S. sign on our building, with the word,
"8rossman{s" facing Route 13, but it can only be "on if you ride up
Third Street.
Q. Is there any permanent sign there, facing new Route 13?
A. No.
Q. Can you give us a description of the physical properties of your busiuoss
the dimensions on 137
A. Approximately 309 plus.
Can you give a rough idea of the acreage of your property?
A. Not off-hand. I would say between three and a half to four acres„ macre
or less.
Q. How many buildings an this land?
A. Three. Two are warohousesx one is a combination store, warehouse and office
bounded on Route 13 by a link !once, a stats fen**.
Q. Have you boon approached by advertisers to erect signs an your property?
A. Yes.
Q. Have you accepted their offers to rent advertising space?,
A. Ho, I have denied thea.
Q. Who are the neighbors doyen there?
A. Haverstick and Winkelman.
Q. Is then any other business situated in this particular block?
A. No, across on Route 13 is the City of Ithaca barn and the Ithaca Junk Company.
Q. I shore you Appellant#s Exhibit 4, marked for identification, and can you
tell urs what is in that photograph?
A. _ Ithaca Junk is diagonally across from our yard.
Q. I show you Appellant's Exhibit 69 marked for identification. khat is that?
A. A cinder pile belonging to the City of Ithaca located at the Ithaca barns
directly parallel to our property aearsss the street on Route 13.
Q. sow you Appellant' 5it 5, marked or cat on, and CAVA you
tell us what that depicts?
A. That depicts the Ithaca baxn and the pole an Route 13, which is parallel
to our yard across the street from us toward the south.
Q. What zone are you presently in at your location?
A. 1-1.
Q. Do you feel that it is essential for you to have a sign of this size
situated on this place of business?
A. Yes, ons reason --- we happen to be on Route 199 which has a speed limit
of fifty miles an hour to Dey Street, where It diminishes to forty miles
an hour, but Day Street Is at a bend from left to right and when you take
that bend that is the first sight you have of our lumber yard. At that
speed before you know it, you are by the yard. We have had many comments
from various customers as well as contractors and people from out of teem
who did not kwm where we were located; also people in inquiring as to
why they could not find us and when could they see the lumber; that it
could belong to any one, but if they come to look for Grossman's it does
not mean a thing. But this is the place they are looking for. Management
has decided that we do need a sign. We called on our sign man In Massa-
ahusetts- to recommend a sign that one can see at the gate of speed they
are traveling on Route 13. He submitted a sign much larger than 230 square
feet. They want to be We to Identify the location iumodiately, but
we spoke to Mr. Van Darter he gave us the Informstion that we can not
exceed 250 square feet and we reported back that that was it and complied
with Dir. Van Martens recommendation. That is basically the reason we nood
the sign there.
Q. Did you say it was the recamoondation of your sign expert - was a sign in
ezooss of 250 square feet room ended?
A. Oh, yes.
Q. Did your company actually produce a sign And send it to your place ;
business to erect?
A. Yee, that is the sign.
Q. That sign is in excess of 230 square feet?
A. Right.
Q. I show you Exhibit 2 marked for identification,, and will you tell us Ata
that Is?
A. That some sign we put up to take a photograph at the exact location we
Intend to place a sign.
Q. Approximately how far away?
A. Approximately 200 yards more or less. The picture was taken from the higimey.
Q. I show you Exhibit 3 - tell us what this is?
A. The son sign which I took close up from the highway.
Q. Do they fairly and accurately show the sign as being where it should be
placed in proper position?
A. Exactly.
A. Yes, over 2S feet from the highway aright of way,
Q. I show you Exhibit 1 and tell us what this shows?
A. This to at about 100 yards, taken an flouts 13.
Q. Do all of these last three photogarphs fairly and accurately show the
sign as It would be seen by a motorist passing by?
A. Eptly.
Appellant's Exhibit 8 marked for identification
Q. I show you a survey nap, narked for identification, as Exhibit S. Can

MARGA=T ANACrNEST: I am owner of the College Motor Lodge. I am an east

hill merchant and directly involved as a neighbor where
this sign would be. I am concerned about my motor lodge.
(Looks at Exhibit 11) I have this problem in the motor
lodge, that I as very difficult to find and you can see
that my sign is recessed from Exhibit 11. I an afraid
that another sign would make tt more difficult. I had
been advised by Mr. Orcut from wham I bought the property
that it was his understanding that was the and of the
commercial sone and at that time it was all clear looking' '
up the avenue. I might also state that Mr. Sady
requested a variance, you will find that it was for another
kind of stere. I felt that a different business would
have been an asset. I did not know what the variance wA a
for at the timet that it was for a liquor store. I as
definitely opposed to this now that I have seen the"
exhibits.
HAZEL WIBSRt I an Mrs. Hazel Weber and I have a very nice home at
302 Collage Avenue. I object to a big sign there too
because I think it will spoil all those houses through
there. I can't see but what a sign this also would cood
` over the sidewalk because Mr. Sedy•s store Is -pmostically
right up to the sidewalk.
MR3. JOSEPH WN: I want to say that at the time we applied for a variance
for the liquor store that I wrote the letters and mile
them out and my husband went to every one in the arms a
told them it was to be a liquor store and it was the ft at
one and that we had the first idea of the 1# oto**4
I also want to call attention to the fence next to our
house that is blocking the view of our store window, t6it
was erected without a permit. Exhibit 6 here depicts a
fence blocking the view of my store window on the north
side and it was actually built without a permit. The
store goes back into the building.
MRS. ANAQNOSTs I must amplify that issue. The situation on the fent*
was dat it was build because the house was in such dis-
reputable condition. People complained about the feat*
and on investigation a letter was written to at tky the
Building Commissioner, that if I lowered it 24 inches I
W15-
would be in compliance. When Mr. Sady completes his
work, thaw I can lower it. This is my fence. I do
have a record on file that it most come down 24 inches
and I shall see that it is done.
MRS. WIS": When I signed Mr. Sao's petition I did not realise this
was going to be a liquor store.`
CRAMI This to an application for a sign.
MR. SADY c When I approached them I told tie exactly what that
store was going to be.
NR, VAN 1lSTUs Mr. Sady approached me in regard to a permit to *root a
sign, &ad it was only then that he discalsed that rather
than being re-coned he had been granted a variance pr*vi
ously. this is the Implication of the sign • it was out;
at this time that he discovered that along with the
business there was no permit for a sign which he con-
sidered adequate for the business.
