erect sign at 369 Elmira Road, Ithaca, New
York. Proposed dimension does not comply with
requirements of Section 7, Column 4. Is there

tion on Route 13, Curley's Chicken House.
and is in a B4 zone. The ordinance pro-
vides that was grant up to 250 feet.
There is a 50 square foot limitation.

Mr. Browns Where is a sketch on file.
Mr. Van Marters This would be on a piling. not attached to
the building?
Zr. Browns Yes. Between the highway and the building.
A sketch of the sign was showed to each member of the
Board and explained to them by Mr. Brown.
Mr. Van Marters There is no problem with regard to the
number of square feet.
Mr. Pfanns What are the approximate dimensions?
Mr. Browns 60 squarer feet and we would call it over
10 feet high.

Where does it stand in relation to the other
landmarks on either side?
A. Right across the street is TlacDonald's. We
will be located very similar to where their
sign Is located. In other words, between the
front of the building and the street. To the
north is a diner, an old building immediately
south of It is Georgi dolt family - an old
roadside fruit stand. This takes the place of
Lang's machine shop which is being removed.
Mr. Maeki : This Is on the Zang property?
Mr. Brown: Yes.
Mr. Ffann: Are there any other signs other than Mac
Donald's of a similar structure?
Mr. VanMarter: Jack Townsend and down the road there is Grand \
Union.

"R. CHAIRMAN: The next case is #669, appeal of Joseph Centini,
124 Coddington Road, Ithaca, New York for a
variance to the Zoning Ordinance for an addi-
tion. Proposed use does not ' nform with re-
quirement of Section 7, Column 2.
Mr. Centini appeared on his own behalf dpresented his
lams to the Board which were examined by each member.
Mr. VanMarter: This is in one of the more recently portiono of
land annexed to the City.
Pfann: There is no problem with the dimensions. The,
problem is only with the use, is that correct?
VanMarter: Right. This is an expansion of an existing
business.
Mr. Comstock: Where is this, on the west side of the building

Mr. Centini: It goes east (indicating on the map where the
addition will go).
Mr. Weavers Is there anyone here appearing for or against

MR. CHAIRMANx The next cave is #671, appeal. of Vincent
Giordano, 602-4 Hancock street, Ithaca, Neva
York. For a va.rlance and exception in Zoning
ordinance to erect addition to sales room and
warehouse as proposed dimensions do not conform
with requirement of Section 7. Column 13, 14
i and 16.
Mr. Vincent Giordano appeared on his oven behalf and pre-.,,
• sented his plans to the Board showing the proposed addition and
explained where said addition was to be located on the land.
Mr. VanMartere This is for an expansion of a non-conforming
use; to attach another building.

Mr. VanMarter: This is the warehouse we are talking about now
not the car wash.
Mr. Weaver read a letter addressed to the Board of
Zoning Appeals from the Ithaca mousing Authority elated.
Mr. Weavers Is there anyone else to be heard for or against
Mr. Giordano's appeal?
Mrs. Velma Jae �of 612 Hancock Street appeared and
presented a petition signed by neighbors of 602-644 Hancock Street
to the Board.
Firs. Jackson: I live with my mother at 612 Hancock Street.
She is a seri-invalid and unable to attend the
meeting. I am appealing to the members of this
Board on behalf of Mrs. Shippos and the other
residents who have signed a petition. I came
before you at the last meeting and was unable
to read this petition.'
I would like to say a few words on behalf of my
mother. Mrs. Shippos. I an appearing here on
behalf of my mother. Mrs. Shippos, a semi-
invalid. The only enjoyment she has out of life
is to be able to go out in her back yard. Who
would want to go outside and see a city dump.
I say this because this is what is being done
on the adjolning property. This has been

accomplished by using the adjoining property
for storage of building equipment. Mr.
Giordano has cluttered up the land and already
has started to clutter up the land behind the
house at 604 Hancock Street. It is our assump-
tion that P14r. "riordano is applying for a vari-
ance to the Ordinance and a building permit to
erect an addition to his building. We would
likes to krona exactly how much storage 13 in-
tended for this neer building. We are not
opposed to the erection of the building at 604
Hancook street but we are opposed to the way
the property is to be used. If Mr. Giordano
will build a building to house all of his con-
struction materials and get these materials off
from the various properties that he owns in
the neighborhood, we are all. for this. However,
If he is going to be granted a variance and not
do these things and Just clutter up more prop-
erty, we are opposed.
Dr. Baldinia What is your address?
Mrs. Jackson: 612 Hancock Street. She has lived there since

Mrs. Jackson: There is no 606. 608 is ov;rned by ,'yrs. Simmons'
who is here at this time. 606 is a vacant lot.

Mrs. Jaekson: .1 haven't seen. them.
Mr. heaver: This is the reason for going; out to the prop-
erty line, There would be no room for storage#
since it would be all in the building and there
would be no room for outside storage.
Mr. Giordano: All the building materials will be under the
building to be constructed.
Mrs. Jackson: Coes this include the matertFls stored on
property in the 200 block of First Street?
r. Giordano: A1.1 the property stored would be inthe building.
Mr. Giordano indicated to Mrs. Jackson and Mrs. Simmons

present' -building. I don't want him too close
to the house because the sun won't be able to

Giordano's building?

r. Giordano: There is A small house that I am going to tear
down.

Mr. Weaver: Would there be an additional driveway?

building?
Air. Giordano: about 4.000 feet. It would put everything
there now out of sight.
(Pere. Jackson: We aren t t opposed to the erection of the now

has said anything to me that It was bothering
them.

Mr. Weaver read to the public present at : the hearing a
resolutinn by the Ithaca Housing Authority dated March 3, 1966
Mr. Giordano: When I bought the old property, the house next
door that I am going to build this on, is worth
12,000. 00; I paid thsm $8,00C. OBJ. The land
behind is worth X2,000.00. I paid $8,000.00 fo
It. I thought I was improving the area a little .
My reason for this addition is to clean up the
storage. A construction company cantt operate
without the equipmant. T had to leave Third
Street. I had a piece of land that would have
done me the rest of my life. The State took the
property and gave me $2,200 for a lot 130 X 300-
1 had to go out and buy a similar property and.
asked permission to move wb ere 1 am now. Now
It is too small for me to operate there but I
am hoping to enlarge this thing so that I can
take care of everything inside.
Mr. Weaver: You were previously granted a variance?,,,,_,
1Ir. Giordano: Yes, when the State made me move because of

Vincenzo Giordano is appealing for a variance
to the Zoning Ordinance and an exception to erect
a car wash at 420-22 First Street, Ithaca, New
York, not in compliance with Section 7, Column
2, 13. Vincent xiordano is appearing on behalf
of his father, Vincenzo Giordano.
Mr. Giordano presented the plans for the car wash to the
embers of the Board and also explained them.

MR. CHAIRMAN: rhe next case is appeal 4673, appeal of Rudco
Construction Corp. , Mr. Anthony Beata as agent
for Clara C. Snyder, 310 Farm Street, .Ithaca,
New York, and an exception to the Zoning Ordin-
ance to erect garage at 310 Farm Street not in
compliance with Section 7, Column 11.
Mr. Anthony Licata appeared on behalf' of Mrs. Snyder and
presented plans for the proposed garage to the Board. ,..
Mr. Licata: This property Is at 310 Farm :street on the
corner of the alley which adjoins Farm Street
and ilarshall - betveen Aurora and Zinn. The
garage will face the alley; the rear of this
lot is on the alley; the front it on Farm
Street; parking is a problem and Fire. Snyder is
asking for permission to build this garage for
her tenants.
Mr. Comstock: '-low many cars is this garage for?
Mr. Licata: Three cars.

Mr. Pfann: This Is for the use of the tenants?

We are restricting, it to a three ear garage.

Mr. Licata: Four apartments. No one knows who owns the
alley. The neighbors chip in and keep it up
and have kept it paved.
Mr. VanXarter: The alley serves both, houses on Aurora and Linn
Streets and exists on two blocks from Farm to
Marshall and also serves in this case those
facing on Farm.
Mr. Weaver: Is here anyone here to speak for or against
this case? No .reply from the public. That Is

to bring my question here. I wonder If the

the Chestnut Rill Apartments, the driveway from
Chestnut Street down to the end of the parking
area.

Mr. Weavers We did have those figures.
Mr. VanIarters They are available but I don't have them here.
Le had the grade and also the distance that was
leveled.
,Mrs. Puck: This is one question I wanted the Board to con-
sider. T�',r. Mielchen's office did ome out and do
an average grade for this driveway and it came
to 14;9 which could at any one point be much
steeper than that. The maximum grade is 10%.

did the grade just from the drawings so I don't
consider his figures accurate. He didn't want to
put this in smiting in order to prevent any
family difficulties. He would do this if it is

necessary, if the Board didn't have figures on
It. I am concerned if a builder can violate the
ADD regulations. Mr. Neiderkorn assured me
that they would have difficulty doing further
building under the .TUU regulations. This was
brought before the Planning hoard and they
didn't seem too concerned about this. One
other point I would like to mention - is the
10 foot fzinimum strip that is called for in the
Aj+D rer ulatlons between the driveway and prop-
erty line and which I remember was waited in

the plans - it shows how the house would look

side there is an office used by an adjustor or

Mr. Lara read a letter to the Board. dated March 4th
addressed to the Board. of Zoning Pppeals from Luclana Lama.
Mr. Comstock: `.'here is a front entrance that extends beyond
the front: line of the building?
Fir. 1,amasm There is a step.
Mr. Comstock: How far out would that steD extend in front of
the propered structure?

Mr. Lama: About 2j feet. I would say about that much. I
have just one large step.
Mr. Comstock: How many steps up?
Mr. Lama: only one. If you take that into consideration
then we will consider that as going over the
71 feet from the line of the building.
Mr. Comstock: I was interested in the height.
Mr. heaver: Anybody else?
Mr. Pfann: My problem here may be answered by the state-
ment in which the net rental of $70.00 from
the apartment would be lost if he was forced to
use the apartment for his additional office
space and that it would be economically impos-
sible for him to operate if he went back there
to do this. Our problem Is probably not that
we wouldn't want to grant It; the question is
whether under the zoning ordinance and the rule
that apply to the Board of Zoning Appeals we
are able to grant it to you.
Kr. Lama: This item of $70.00 for us makes it economically
impossible because we are obtaining an addi-
tional loan and we note that In the item #2 we
have considered building In the back. By going
Inside we either have to use it all or just
out it up and the rest would be unuseable. I
have been driving all over, and i wish you would
do the same thing, and see how many homes are

within the 10 feet limit; take Fsty Street,
Washingtnri Street, Court Street take any

street - you can go all around to find one that
Is 10 feet back. I would still be 7f feet. If
we look at all the homes on Court Street I
would still be far behind so many of the houses
on the same street . or on Park Place, Washing-
ton Street which are within 1 - 2 feet from the
City line.
Mr. Comstock: What is the authorized setback, 10 feet?
Mr. Weaver: 10 feet yes.
Mr. Giordano: Today was the first time I had heard that the
old lady didn't like the storage in the
area of my property. I will still put a fence
there no matter what you decide. This woman
lives at 610. The construction lot is on Fifth
Street. Fifth extends back Into Bush 011. I

! will put a board fence up and paint it. The
! lot is there and is zoned commercial. Right
behind us is commercial property. She is
looking out her back door and looking on prop-
erty where I have cinder blocks stored. The
variance I want is on 602 .604 Hancock.
Mr. Pfann: Does the variance you have now pertain to the
building or the land?
Mr. Giordano: Both.

motion to grant appeal /#667, which motion was seconded by Mr.
Comstock. Written ballot taken by secretary.

Findingas Dr. Ba:ldint - The square footage of the sign
does not exceed the allowed 250 square feet ,allowed under
Section 7, Column 4.

After discussion by Hoard members it was generally agreed
that there was plenty of land surrounding the property in question
which was vacant and that fir. Centini wasn't bothering anyone in
the neighborhood nor did it create any hazard. Motion was made
by Dr. Baldini, that appeal #669 be granted, which motion was
seconded by Mar. Macki. Written ballot taken by secretary.
To grant: 4 yes - 1 no
Fines Dr. Baldini - It doesn't violate any lot re-
quirements and the non-conforming use already exists.

Appeal No.
After reading the petition to the Board regarding the use
of 602-604 Hancock Street and after discussion it was generally
agreed that parking not be allowed in front of the building in
question and that Mr. Giordano did have a particular hardship in
that he was Forced to move from his previous location where he had
ample space for his construction business. Motion was made by Mr.
Weaver and seconded by Mr. Comstock that appeal No. 671 be granted
with the specific provisions that no parking be allowed off Han-
cook Street in front of they new building; that the setback be ob-

to help finance his addition in that it would not be economically
feasible for him to use a portion of the apartment already existing
lbehind the present offices also felt that an addition would obstruct
he view for drivers stopping on Park Place to cross Court Street.

Mr. Pfann and :fir. Comstock didn't feel they were in any
position to made a decision relative to the Chestnut Hill Apart-
ments case. Dr. Baldini made a motion that a special executive
session for appeal No. 659 be held on Wednesday, March 10, 1966 at
7:30 p.m. in the conference room, second floor, of City Hall.
Motion seconded by INIr. Pfann. Carried.
There was also discussion that future meetings of the
Board of Zoning Appeals be held on the first Monday of the month
at 7:3Q,-,P-m. rather than 4;00 p.m. Motion made by Dr. Baldini and
carried unanimously.

It was agreed that the members did have enough informatio

public hearing might be desirable. �

Discussion centered around the possibility that the Beard

the Army Reserve Center.

the lot south of Williams Brook.

The Board of Zoning Appeals did meet Monday, March 14th
at 500 p m. In an adjourned session with the following members
present : Chairman Conley, Maeki, Comstock, Weaver, Baldini and
Van Harter.
Mr. Van Marter did advise that the City Attorney did rule
that the whole lot must be considered and that the total had to be
considered to make the ADD appeal valid.
Discussion centered around the fact that inasmuch as there
Was an exception that this Board could not rule other than to deny,

�of Hector Holding Corp. for a Special Permit under ADD, appeal : 659
be denied. Reason: on advice of City Attorney that ADD permit does
