Sovocool, Councilman Verl Rankin, Jr., Councilman Gordon C. VanBenschoten, Councilman Arrived late: Robert F. Walpole, Town Justice Absent: Benjamin J. Buck.o, Toxin Attorney Also present: Art Clark, Fred Shafer, Ronald Peck, Doug Staley, Robert Brown, Laura Haughn, Leland. Cornelius, friary Evelyn Dempsey, Nancy McGuerty, Carol Eisenburg Mr. Sovocool moved to accept minutes of September 5th and 11th meetings as mailed. Seconded by Mr. Rankin. Ayes - Sovocool, Rankin, VanBenschoten, Robinson Claims #219 to #236 of the Highway Department and #226 to #251 of the General Fund were presented for audit. ?#1r. Sovocool moved that the bills be paid and the Clerk instructed to draw warrant for them. Seconded by Mir. VanBenschoten. Ayes - Sovocool, Rankin, VanBenschoten, Robinson Zoning Officer reported. six building permits and two trailer permits were issued in September. fir. Ronald Peck was present to discuss Building Permit denial because of set back of 38 feet from road right -of -way instead of 55 feet from B of roadway per zoning. He indicated notice of hearing was published the required 10 days prior to variance hearing and he had a petition signed by several neighbors who had no objection to his building a garage and at the hearing no one from the public was against it. Appeals Board vote was split - -two, for and two against. Mr. Peck called Mr. Hoy requesting another hearing and Mr. Hoy said it had to be posted in paper another ten days before another hearing. Mr. Peck asked the Town Board if they could do anything and how long it could, be carried. out. Town Board indicated no objection from neighbors makes no difference; it's the Board of Appeals judgement. Torm Attorney is out of town and. matter will have to be discussed with him. No one from Planning Board, is going to attend N.Y. Planning Federation Conference on October 15 -17 in Monticello, Supervisor Robinson brought to 'the attention of the Board the 1979 Youth Program Renewal due October 15, Youth Recreation Project is $3200.00 with $1600.00 reimbursed by state aid. Town is eligible for $1400.00 of state aid for Youth Services providing they budget $2800.00. The question arose as to whether Village anticipates putting more in. Supervisor Robinson indicated she had not talked with Village yet. Per. Sovocool moved to table and look into budget picture before making any commitments. Mr.. VanBenschoten agreed to a second, Discussed adopting Dog Ordinance for which a public hearing was held prior to Board Meeting. After much discussion by the Board and the Public over what the fees were going to be used for and how much the Town gets for issuing a license (25¢), and where does the $1939.63 go that the County returns to the Town, Supervisor Robinson explained that it goes into the General Rund and we are in the hole $1000.00. Mr. Sovocool felt we should come up with figures before adopting. Mr. Rankin moved to adopt as per hearing notice. • RESOLUTION N0. 16 - ORDINANCE RELATING TO OWNING OR HAP3 0RINIC AN UNLICENSED DOG i Moved by Mr. Rankin, seconded by Mr. Sovocool Aye - Verl Rankin, Jr. Aye - Ellard. L. Sovocool Abstained.: Gordon C. VanBenschoten Absent - Robert F. Walpole 1. License: Any person a resident of the Toi-rri of Groton who owns or harbors a dog six months of age or older shall immediately make application for a dog license. No license shall be required. for any dog which is under the age of six months and which is not at large. 2. Fee; The license fee shall be as follows payable to the Town Clerk of the Town of Groton (a) For each Male or Spayed Female Dog $4935 (b) For each Unspayed Female Dog $9.35 3. Violations: 1. It shall be a violation for any owner who fails to license any dog and pay the license fee as provided in Section 1 and Section 2 of this ordinance. 2. The violation shall be punishable upon conviction by a fine not to exceed Ten Dollars ($10.00). The ordinance adopted June 2, 1969, is.hereby repealed. Mr. Sam MacNeil and Mr. Frank, Satterly arrived. i'''Ir. MacNeil had no informa- tion on dogs for the Totem. Mr. Satterly explained the dog monies received from the County by the Town goes back into General Fund to lower tax rate. ® Mr. MacNeil will have more dog information shortly. The public felt we were double taxing taxpayers. Mr. Satterly introduced Mr. MacNeil as. Chairman of the County Board of Representatives and indicated Mr. John Murphy, County Treasurer, was unable to attend. Mr. MacNeil reviewed current County budget including revenues and expenditures. His intention for the budget presentation was to solicit :Local input for the 1979 County budget. Supervisor Robinson indicated the greatest need for the Town was road repair including West Groton Road., a portion of Champlin Road and Peruvll.le Roads. It was recommended that a, letter from the Town to Bill Mobbs be *.mitten requesting some attention be given to these roads. Also Lafayette corner problem is a septic system leaking and Bill Mobbs is discussing with Health Department. Mr. MacNeil also reported. on progress of Peru & Route 33 intersection. He indicated Mr. Ray Kovak had reviewed hard. facts and statistics. Analyses at this time is that the State put up signs on Route 38 and County install steepness of hill and dangerous intersection signs. Also, banks to be removed to,improve visibility. Indication at this time is no blinker light. Mr. Satterly reported that the Board of Representatives recommended that Route 96 realignment be a four lane highway with overpass over railroad. He also indicated to Mr. MacNeil that the Town and Village had adopted leash laws on the assumption of cooperation from the SPCA in, enforcing. Mr. MacNeil indicated he had no answers to questions as of yet from SPCA. Discussed fire calls to County (Walpole & MacNeil.). Need larger control center. Have no room for three bay emergency at present facility- -needs enlarging. Cost is $780,000 for control center with,$285,000 possibly coming from State Grant. Mr. Satterly stated Father McNamara had. inquired as to getting the speed limit changed. on Route 38 from 55mph to 40 mph due to church and the increased traffic at a high rate of speed. Mr. MacNeil suggested Town write or call Fred Grout of the State Highway Department in Ithaca'at 272 -1471 to find out procedures to take. Board received a letter from Tillage of Groton requesting Town of Groton to consider exempting their stater system from Town taxes. Ido action was taken. Supervisor Robinson has received a letter indicating that John Murphy, Tompkins County, gave LVRR preferential rights to Towns and Villages. ® Supervisor Robinson is to T,rrite letter to Mr. Clarkson of the N.Y.S.D.O.T. indicating our interest and intended use of LVRR property which at this time is for recreational purposes.
