HomeMy WebLinkAbout1978-05-01I, C] u Mrs. Leora Robison representing the Village Tennis Court and Swimming Pool committee was present to ask for assistance from the Town in initial grading and. 6 inches of fill (crushed stone) to be hauled in. They have been turned down four or five times for State funding because of insufficient funds. Intend to do project anyway. Currently have $15,000 on hand for project. ;Tillage has offered to do part of work and hopefully Town will. be able to contribute. Town will take into consideration and let Mrs. Robison know in a couple of days. Town Directory is finished and Post Office is going over for any changes. Should be ready for printing in four or five days. Dogs - Mr. Walpole recommended that '.Gown Board take immediate action for assistance in enforcing our Dog Control Law. Mr. Bill Brothers of the SPCA was present to assist us in resolving our problem. SPCA's contract with county allows them to pick up only untagged dogs. If we hire our own Dog Warden, State law does not permit both Local Warden and SPCA service. SPCA is understaffed and cannot provide increased patrol services, Mr. Brothers suggested, that the Town consider a contract with the SPCA to pick up untagged dogs, enforce leash lair and patrol certain hours in the Town of Groton. This would be an additional expense to Town with County getting proceeds. After an hour of discussion, no solution to our problem was reached. Attorney Bucko will meet with Mr. Brothers to discuss alternative routes to take prior to Tompkins County Municipal Officials' Meeting, Mr. VanBenschoten moved to put up for bids to sell one (1) 1963 Chevrolet ton pickup truck and one (1) 1967 Chevrolet 2 ton pick -.gyp truck with bids being opened May 1, 1978, at 8 :15 P.M. Seconded by Mr. Sovocool. Ayes - Walpole, VanBenschoten, Sovocool, Rankin, Robinson Mr. Cornelius reported. that Mr. William Casolara was doing surveying for our Mining Permit at a cost of $385.00. Work is progressing smoothly. Mr. Walpole moved that Attorney Bucko attend SEU Workshop at Bear Mt., N.Y., on April 25 - 26 at a preregistration cost of $75.00. Seconded by Mr. Rankin. Ayes - Walpole, VanBenschoten, Sovocool, Rankin, Robinson Annual road inspection was set for April. 22, 1978, at 10:00 A.M. VanBenschoten, Councilman Ellard L. Sovocool, Councilman Verl Rankin, Jr., Councilman Benjamin J. Bucko, Town Attorney Also present were: Leland Cornelius, Charles &P Blanche Volbrecht, Edward � Beverly Miller, Herbert Stewart, Carl Ferris, Hank Bush, Robert & Laura Haughn, Joseph Hora, Mary Ellen mane, Frank Pierson, Erik Hewitt, L. K. Wood, Robert Skinner of Cerrache, Robert Brown, James Schaefer of 314, Mary Evelyn Dempsey,of the Cortland Standard, Nancy McGuerdy of the Groton Journal & Courier, and others. The meeting started a few minutes late due to lack of a quorum. Mr. Sovocool moved to accept minutes of previous meeting as mailed. Seconded by Mr. BanBenschoten. Ayes - VanBenschoten, Sovocool, Robinson Claims #83 to 9100 of the Highway Department and ##97 to #126 of the General Fund were presented for audit. Mr. Walpole moved that the bills be paid and the Clerk instructed to draw the warrant for them. Seconded by Mr. Rankin. No one present from Planning Board.. Air. Cornelius reported on Sovocool Hill Road and bank repair. Intends to use Stone Gabions to hold bank - 1503 baskets, V bottom pipe with tar to make last several years. Highway Department will do work. Estimated cost is $3,038. Can anti - recession money be used? If capital expense, it cannot be used. Attorney Bucko sent Board a copy of a ;proposed local law for repair or removal of unsafe buildings and collapsed structures. Mr. Bucko commented on the local law and its enforcement. He recommended the Board study and lay on table for one month before considering passing. Received notification that LVRR running through Groton has been abandoned.and Town can consider what they wish to do with it. Will study and discuss our section the following to the north and south of Village at a later date. Meeting recessed at 8:00 P.M. for Public Hearing on Cable TV Merger, Public Hearing - ATC Merger with Time Inc. Clerk read Legal Notice which was published April 19, 1978 in the Groton Journal & Courier. Supervisor Robinson asked if there were any questions on the proposed merger. There being no questions, Supervisor Robinson closed. hearing at 8:01 P.M. Meeting reconvened at 8:01 P.M. Supervisor Robinson asked. Board if they wished to take action on `1`V Hearing now. Since there was no discussion, the following resolution was made: RESOLUTION NO, _ 5 - APPROVAL OF ATC/TIME MERGER Moved by Mr. Walpole, seconded by Mr. Sovocool Ayes - Walpole, VanBenschoten, Sovocool, Rankin, Robinson WHEREAS, a public hearing has been held after notice required by law on May 1, 1978, at 8:00 P.M., there was no discussion for, or against said merger, the Town of Groton does hereby approve merger of American Television and Communications Corporation (ATC) and a wholly owned subsidiary of Time Inc., which shall be known as American Television and Communications Corporation upon consumation of the merger. Supervisor Robinson stated we have $4,510.14 in State Anti- Recession Funds that was received in NFovember of 1977 which must be allocated within six months. We have allocated $300.00 from this for Town Directory. We had a public hearing on Federal. Revenue and Anti- Recession Title II, but not State Anti- Recession. Tabled by Mr. Rankin until Special Meeting to disburse State Anti-Recession monies with Title II monies for Deputy Clerk fees to be considered also on May 8, 1978, at 7:30 P *M Supervisor Robinson and Board Members went into Executive Session. Upon returning, Supervisor. Robinson indicated session was for payroll deduction for United Fund, Mr. Walpole resolved not to have United Fund deducted from payroll since most all are paying into it now. Seconded by Mr. Sovocool. Ayes - Walpole, VanBenschoten, Sovocool, Rankin, Robinson At 8:15 P.M. Clerk opened two bids received for sale of a 1963 and 1967 Chevrolet Pickup trucks. Bids received from Arnold. Lester were $156.00 for the 1963 Pickup and $210900 for the 1967 Pickup. Bid received from L. Kenneth Flood was $100.00 for the 1967 Pickup. No other bids were received. After some discussion, Mr. VanBenschoten moved to accept bids as is from Arnold Lester for the two tracks. Seconded by Air. Sovocool. Ayes - Walpole, VanBenschoten, Sovocool, Rankin, Robinson Attorney Bucko read a proposed resolution designating agents to allow inspection and. copying of recors of the Toym of Groton required by each agency to adopt rules and regulations setting forth procedures, subject matter, etc., known as the Freedom on Information Law. "Records after Town Board has seen them." This resolution is up for consideration before next meeting. Mr.. Bucko recommended tabling until next meeting so Clerk could look up record of approximately three years ago that may have been passed on same subject. . Town Board. asked, Planning Board to look into commercial aspects :from 701 Plan - Tentative Study. More land for possible future use. Planning Board is currently working on sub - divisions. A meeting of all three Boards on the effects of SEU should be held at a later date • • Attorney Bucko reported briefly on the SDQR Workshop he attended. SEAR goes into effect September 1, 1978. Every action of Boards and Highway Department come under Environmental Review Act, Certain things are exempt such as dog licenses, highways unless changed. over 50 per cent. lead agency determines whether or not if it affects air, people, ground, etc., and requests the applicant to apply for an impact statement. 'An impact statement is not required for about 95% of the Town's projects. If state money is used, an' impact study is required -- changing water route requires an impact study. Study stays here and is filed with County and State. More details to follow when Mr. Bucko has tapes ready -- sometime in June. Supervisor Robinson asked the board if they were interested in new lighting for entire unit of Totim offices as quoted by Mr. Walden of Lustra Lighting Corporation. Consensus of board was that what we have is sufficient with a definite no to purchasing lights at this time. ® Discussed appointing a representative to County Transportation Commission. Since first meeting is tomorrow night (May 2), Mr. Walpole suggested Supervisor attend first meeting then Board. would appoint someone. r: Mr. Cornelius reported on Gravel Pit and. progress on Mining Permit. Maps are ready. Supervisor and Mr. Cornelius have to get write up done as to how we're going to reclaim land in the next 30 years. Cost for Mr. William Casolara's map work is $385.00 to possibly come out of State Anti- Recession Funds. They have to indicate total taken out since 1975 to 1981 using overlays every three ycarss to renew permit. Mr. Walpole wanted. to know ,,hat decision on dogs has been made. Town Justice phone is ringing off hook with complaints. One case was.at 8:30.A,M. when taro dogs were after chickens and the SPCA was notified but were unable to do any- thing because they didn't open until 10:00 A.M. Suggestions were contract for $1000/year for three or four hours /week with SPCA to pick up dogs, or contract on a per cal]. basis. Attorney Bucko indicated Constables can make out complaint and turn over to Town Justice. Mr. Walpole felt he could not help make out a written information and then try case in court. Supervisor Robinson will contact Clint Cottrill, President of Tompkins County Municipal Official's Assoc:iai;ion, to see what the Towns intend to do, since it was agreed that Supervisors and Mayors would get together to see if they couldn't come up with a solution to dog problems in all Towns and Villages in the County. Mr. Walpole stated he had three phone calls between 8:15 and 9:30 this A.M. regarding "Amendment to Zoning Ordinance" related to Motorized Vehicle Repair and Sales. He indicated he had not received any information and could not answer questions from the irate garage owners. Mr. Walpole demanded to know how a proposed amendment or inter-governmental memo got out to the public before the Board had seen it. No response. Mr. Walpole again demanded a statement. Town Clerk remarked that he already had been informed how it got out and this was not the proper time to reprimand ox put on trial.anyone in front of the public. Boisterously, Mr. Walpole demanded the Town Clerk to make a statement to the Board. Members (who already knew where it came from). Mr. Walpole and Town Clerk were interruped by Supervisor to restore order. Once restored, Town Clerk again informed Mr. Walpole,.the Board, and about 30 citizens what had happened. Mr. Walpole explained that the Planning Board makes recommendations to Town Board. Ideas are put into format and presented to Town Board for review. Attorney Bucko gave copy of "Amendment to Zoning Ordinance" Supervisor on Friday for mailing to Board Members and she in turn gave it to Town Clerk to attach to Agenda and Minutes for mailing which was done Saturday morning-. Attorney Bucko also informed Town Clerk that hereafter he would hand out memos to Board Members at the Board Meeting. Mr. Walpole made the motion to meet with Planning Board to go over-with Town Board the amended zoning ordinance on May 8, 1978. Since no one from the Planning Board was present to agree on date, Supervisor Robinson.said:she would contact the Planning Board to see if they could meet on the 8th. Mr. Volbrecht, a garage owner, asked, Do members of the Planning Board know what a garage business does ?" He suggested garage owners work with Planning Board.. Mr. Hora likes idea to set down with Planning Board.. Mr. Stewart asked, "How cane when a guy pays for a permit he doesn't get it ?" Referring to Pir. P. White, Mr. Brown the Zoning Officer said "he has it ". L. Kenneth Wood would'like to retire from his position on the Environmental Council. He said Mr. Cliff Monagan was interested and is going to the next meeting with him. The Board- approved. r 37 .l O Supervisor Robinson told garage owners there was a sheet of paper on counter that all garage' owners could sign 'and card's 'would be sent notifying them of meeting. VanBenschoten, Councilman Merl Rankin, Jr., Councilman Ellard. L. Sovocool; Councilman Benjamin J. Bucko, Town Attorney Absent: Robert F. Walpole, Town -Justice ' Also present were: Leland Cornelius, Carl Ferris,; Don Brown, Herb Stewart, Kenneth Swenk and several others coming in�•to attend an informal meeting with Planning Board at 8:30 P.M. Purpose of meeting is to figure out what we can use State Anti- Recession Funds for, Federal Anti- Recession allocated •to Deputy Clerk. We have approximately $4500 State'Anti- Recession to allocate'.' (Actual - $4510.14) State Anti - Recession was not figured. on in budget. It was received in November of 1977• Mr. Cornelius, Highway Superintendent, could use money for Sovocool Hill' repair but Attorney Bucko indicated supplies are not allowed. After discussion the following proposed uses were presented: 1 Compiling ':Gown Directory - $300.00 2 Printing Town Directory - $500.00 3) Preparation of Survey & Maps of Gravel .Pit - $385.00 4 Employment of Summer Help - $1000.00, 5 Repairs of roof on 'Town Building we $1000.00 6 Microfilm Old Documents - $350.00 7 Janitorial Services - $975.14 Further discussion involved the possible need-for a new roof for the Town Buildings. Mr. Cornelius indicated that it had been on for several years and will have someone look at and give us,an idea of cost. May have to put in budget for next year. Another possible use would be SPCA contract for dog control ser,,rice. Also, we can hire one or two men for summer help, to paint, mow, etc. Moved by IoIx. Sovocool to,hold Public Hearing on Proposed Use of State Anti - Recession Funds on Monday, May 22, 1978, at 7:30 P.M. Seconded by Mr. VanBenschoten. Ayes - Sovocool, Rankin, Ba.nBenschoten, Robinson Supervisor Robinson informed the board that a ,young man out of Cortland demonstrated two photocopy machines. One was an SCM which was eliminated due to small capabilities. The other machine was a,Mita which did satisfactory copying. Attorney Bucko will look into how much the Town can spend without bidding. Local Advisory Board. of Assessment Review is scheduled for June 8, 1978 from 1:00 P.M. to 8:00 P.M. Need several people to set with county. The follow- ing individuals and 'times were set: Teresa Robinson - 1:00 'to 2:30; Robert Walpole an 2:30 to 4:00; Lewis Sovocool - 4:00 to 6:00; Dutch VanBenschoten - 6 :oo to 8:0o .
