HomeMy WebLinkAbout1972 City AttorneySO CITY ATTORNEY ATTORNEY'S REPORT: Attorney Gersh reported on the following items; 1)' MacLean refund - Progress report - expects to have final report by next meeting. 2) U.S.N.R. Center - He reported he had written about the City's desire to purchase this property which it now uses under lease for use as a Community Services Building. 3/r/7� 3) Hillick-Carman Grievance - He reported the Union had iled a complaint with PERB. ATTORNEY'S REPORT: Attorney Gersh reported he had been informed by the Planning Director. that lands adjacent to the Station Restaurant of West Buffalo Street had been acquired by the City with B.O.R. funds and felt that consent from B.O.R. should be obtained before ,proceeding further. He also reported he had written to N. Y. State Water Resources Commission to find out if it had any objections to the City leasing frontage on Cayuga Inlet adjacent to the Golf Course to Johnson's Boatyard for mooring -of boats. He indicated he was awaiting an answer. IN ATTORNEY'S REPORT: Attorney Gersh reported on the following; Local Lars #1 and #2-1972: He read a letter from the Attorney General advising that OLocal Laws #1 and #2-1972, giving the Council to right to review actions of the Board, il appeared to have been properly enacted and therefore valid. 7 - PARADES: PARADES: Attorney Gersh reported that he had attempted to reconcile the Code of Ordinance in regards to parades. He felt that the fault laid in the way the ordinances were written. Section 19-7 and 19-75 grants the Mayor the authority but Section 19-78 grants lisethe Superintendent the authority. Attorney Gersh ruled, that in his opinion the Mayor has the authority to grant permits for parades and gatherings. Once the Mayor has made his decision it is up to all departments to take the necessary steps to comply. No other city agency has the power to countermand the Mayor's decision. After much discussion of the issue, the following resolution was presented. i By Comm. Golder: seconded by Comm. Putney RESOLVED that the Board of Public Works denies the right to close Drydn Road between Eddy Street and College Avenue and that the Chief of Police and the Fire Chief be so informed. AYES: 1 NAYS: 3 Motion defeated. After further discussion the following resolution was submitted. 'By Comm. Ewanicki: seconded by Comm. Golder against the action ,RESOLVED, that the Board of Public Works goes on record as being a g 'taken by the Mayor in closing Dryden Road, and BE IT FURTHER RESOLVED, that the Board denies any responsibility or liability in the closing of Dryden Road between Eddy Street and College Avenue.
