TOWN BOARD MEETING MINUTES
FEBRUARY 8, 1982
The regular meeting of the Danby Town Board was called to order
at 8:35 P.M. at the Danby School, 72 Gunderman Road, Town of
Danby, County of Tompkins, and State of New York on February 8,
1982,

Others present: Sandy Kane, Roy and Mary Casterline, Frank
Haskins, Ed Slights, Ed Roberts (Bald Hill Rd.) Donald Graham,
Florence Starr, Roland Manley, Connie Lust, Paul Smith, Herb
Engman, Donald Wright, David Benson, Chuck Bruce, Fred Lee,
Garry and Gay Huddle, Roy Hornbrook, and Mr. and Mrs. Patrick
Caveney,
Communications: A letter from New York State Electric and Gas
Corporation was read pertaining to notifying an employee of the
Natural Gas Department in the event of natural gas odor in the
area. A list of employees to be called was left to be posted
on the bulletin board at the Danby School.
Letter from SPCA Attorney George Patte regarding renewing of
contract between Town of Danby and SPCA for 1982. Issues
discussed were increasing the license fees at least $2.50 per
license in addition to statutory amount. SPCA did not feel they
could renew the contract with the Town unless we agreed to the
increase.
Letter was read from Mr. Robert Clauson, pertaining to improv-
ing the grave yard beyond the highway facility. Some ideas he
had were putting markers where the old gravestones had fallen
down, building a pole type pavillon shed large enough to accom-
modate a few picnic tables. A project of the type would, in
addition to preserving some of Danby's history, be used as a
picnic area for special occasions.
Letter from Richard I. Mulvey. He represents Landstrom Gravel
Company and is requesting the Town of Danby abandon an old
unused Town road approximately 200 feet north of the Tioga County
line running easterly from Route 34 and 96B.
The minutes of the January 11, 1982 meeting were presented and
Dorothy Roberts asked that a correction be made on page 5; her.
report on Senior Citizens, in which the line regarding $1,000 in
matching funds be deleted. They will not be receiving them.
Also the General Fund Warrant #1 total is to be decreased by
$250.00 (Municipal Officers Dues). The dues were paid in November.
Supervisor Mildred Miller intertained the motion that the minutes
be approved with the above mentioned corrections. Motion made
by Councilperson Sylvia Hiney and seconded by Councilman Ted
Merritt and carried by a vote of five ayes and no noes.
Privilege of the floor: David Benson, Mr.. €Mrs. Caveney, Mr.
& Mrs. Huddle, Sandy Kane, and Connie Lust all spoke in regards
to a concern about a Group Home residing on Gunderman Road at
the Clauson residence. Gay Huddle said there was nothing definite
about the home moving here- just a possibility. This group
home is a temporary home for troubled kids. The zoning ordi-
nance was questioned as to whether this could be allowed.

Paul Smith questioned what the Senior Citizens will get in
funds this year. Mildred reported they will get $2,000
($1,000 in Revenue Sharing and $1,000 in General Fund),
Ed Roberts (Bald Hill Rd.) spoke regarding a letter from the
Jones Family in West Danby, which had been sent to all town
board members. The letter pertained to a hardship they were
having and wanted to move a trailer in to live in temporarily.
Ed stated they had not been living up to what they were told
to do. Also, Ed spoke about the Gilbert Road and the Gilbert's
not receiving their mail.
Florence Starr reported for Board of Representatives; at their
last meeting discussions were sale of land at old hospital.
Board of Reps are looking for someone who would like to be on
the Human Rights Committee. Scott Heyman is head of this com-
mittee. Purpose of committee is to help those who feel they
are being discriminated against.
Old Business: Last month's issue of contract for temporary
easement with Forestre Robert Moore and Walter Heater, across
town of Danby Water District: we will go the alternate route,
so as not to cross over any water pipes, etc. Pamela Clermont
will contact the Forestre regarding their using the alternate
route.
SPCA Contract: Councilperson Diary Oltz suggests we should have
our own Dog Control Officer. It was suggested Connie Merritt
be named Dog Control Officer and Ted Merritt as deputy. Florence
Starr reported their town (Caroline) has its own dog control
officer and a $2,000 budget and it is working well for them.
Mildred Miller appointed Connie Merritt (Ted Merritt as deputy)
as Dog Control Officer for Danby with I.a budget of $1500. to work
with, to become effective March 1, 1982.

Fire District: Mary Oltz reported work is continuing on the
repair of the roof. Mary also reported Marilyn Seeley is new

Planning Board Chairman, Donald Graham, reported at last meeting
they had with town board, they agreed to recommend to town that
they enforce building codes only of the state building and fire
codes. We have the option of enforcing only building codes or
fire codes. Proposed revision of two articles of the Zoning
Ordinance were: schedule of fees be updated and revision of
planned unit development. Had received a number of requests
for planned unit development.
Mildred Miller reported Workman's Compensation Board has approved
application for volunteer coverage giving highway department
men disability benefits.

Town Justice Report: Record of arraignment fees and fines for 1981
are: vehicle & traffice (138), conservation (4), civil (2), criminal
(10) parks (1) small claims (3). Fines and fees submitted to
Albany were $1,830.
RESOLUTION #12 ISSUE CORRECTED TAX BILLS TO MRS. JOHN
MOODY FOR TAX LOT # 6 -1 -2 AND TO JEROME
GENTILE TAX LOT # 26 -1 -2.3 FOR 1981 -82.
Resolution moved by Councilperson Dorothy Roberts and seconded by
Councilperson Mary Oltz and carried by the affirmative vote of the
entire board.
Mildred Miller appointed Francis Wright as Chairman of the Tompkins
County Transportation Committee to serve until December 31, 1983.
A letter will be sent to Mr. Wright along with a request for reports
on the meetings.
Question was raised by Mildred Miller on how to abandon a Town Road.
Roy Hornbrook will check with Bill Mobbs,county highway superintendent,
about this. Regarding the Gilbert Road issue, the road is serviced
by the highway department but there is no mail delivery to the
Gilbert's. They have to pick their mail up at the Dick's residence.
Ed Roberts will check into what is needed to change the mail delivery.
Highway Fund Warrant #2 in the amount of $16,460.87 was.approved
to be paid, with the correction of bill #'s 38 & 39, Southside Fuel
to go on General Fund Warrant.
The motion was made by Supervisor Mildred Miller and seconded by
Councilman Ted Merritt and carried by a vote of five ayes and no noes.

West Danby Water District #2 in the amount of $1,065.05 was approved
to be paid. The motion was made by Councilperson Dorothy Roberts and
seconded by Councilperson Mary Oltz and carried by a vote of five
ayes and no noes.
Councilperson Dorothy Roberts made the motion to approve the Super-
visor's reports as presented. Motion seconded by Councilman Ted
Merritt and carried by a vote of five ayes and no noes.
Chuck Bruce spoke regarding a change in planned development, as
he would like to operate a repair shop for automobiles at his present
business. Mildred suggested he attend the planning board meeting
February 17 and bring all reports and requests before them.
At 9:40 P.M., Councilperson Dorothy Roberts made
meeting be adjourned. The motion was seconded by
Mary Oltz and carried by a vote of five ayes and
