HomeMy WebLinkAbout2003-06-18 BZATOWN OF ULYSSES BOARD OF ZONNG APPEALS MEETING & PUBLIC HEARING 6/18/2003 PRESENT: Chairman George Tselekis, Board Members Ken Christianson, Jim Hickey, Carl Mann, and Joel Warren, Code Enforcement Officer Alex Rachun, and Zoning Clerk Karin Lanning. ALSO PRESENT: Charles & Karen Dickson, applicants. An adjourned public hearing, scheduled for 7:30 pm, to hear further comments on the variance requested by the Trumansburg Golf Association for its property, tax parcel 12.-1-1.2, for the purpose of constructing an equipment storage and maintenance building within the 100-foot setback required by the Zoning Ordinance was announced as cancelled at 7:30 pm. The reason for cancellation given was the Golf Association had withdrawn its application, since a full board was not expected tonight. Chairman Tselekis called the meeting and public hearing to hear comments on a variance requested by Charles Dickson for his property located on South Street Extension, known as tax parcel number 12.-2-9.1 to order at 8:00 pm, proof of notice having been furnished. Mr. Tselekis asked Mr. Dickson to describe his proposed project. Mr. Dickson explained he wishes to build an addition consisting of a 24’ X 24’ garage connected to the present house by a breezeway and screened porch on his lot, which consists of approximately one-half of an acre. Mr. Dickson stated he spoke to his neighbors about his plans, and they did not express any objections. No neighbors were present. No comments were heard. Chairman Tselekis asked if any written comments were received and the Clerk answered in the negative. Chairman Tselekis asked if the garage will have any bathrooms or an apartment. Mr. Dickson stated it will be one story and will have neither bathroom or an apartment. Mr. Mann moved the following, which Mr. Warren seconded: Whereas the variation in regards to the requirement is not substantial, and Whereas there will be no impact on population density and, therefore no increased demand on available governmental services, and Whereas there will be no change in the character of the neighborhood and no detriment to adjoining properties, and Whereas there is no alternative feasible means of obviating his difficulty available to the applicant, and Whereas, it would appear considering all of the above factors, that the interests of justice will be served by the granting of this variance, NOW THEREFORE BE IT RESOLVED that the variance be granted. Mr. Christianson aye Mr. Hickey aye Mr. Mann aye Mr. Tselekis aye Mr. Warren aye Adopted. The variance was granted. Mr. Hickey moved to approve the minutes of the Meeting and Public Hearing of May 20th, 2003 as presented. Mr. Mann seconded. Mr. Christianson aye Mr. Hickey aye Mr. Mann aye Mr. Tselekis aye Mr. Warren aye Adopted. Mr. Rachun brought to the Board’s attention an upcoming matter, which could be addressed in a number of ways, concerning Cornerstone Recovery Services on Route 227. Mr. Rachun explained the Zoning Ordinance defines but does not allow for rehabilitation centers, so when it comes time for Cornerstone to build its new facility, which it plans to do fairly soon, it will not be an allowable use in a residential district. Mr. Rachun advised the Board of possible means of addressing this issue. The Board could consider the facts and interpret the Zoning Ordinance, to determine whether or not the Ordinance was intended to include rehabilitation center as an allowable use in a residential district, a Planned Unit of Development (PUD) could be pursued, or a change in zoning could be requested. The Board and Mr. Rachun discussed the options briefly, and agreed the best option would be hearing and review of the matter by the Zoning Board of Appeals to determine whether or not the original writers of the Town Zoning Ordinance intended to include rehabilitation centers as an allowable use in a residential district. Mr. Rachun will advise Cornerstone Recovery Services accordingly. Hearing no further business, Mr. Hickey moved to adjourn the meeting and Mr. Mann seconded.
