GRIEVANCE - HILLICK - CARMAN: The Clerk read the following letter:
To: Board of Public Works - RE: Grievances of William Hillick and
Adam Carman
"The undersigned Arbitrator's Committee approved the grievance of William
Hillick and recommend reimbursement to him of three months' insurance
payment in the total amount of $103.65. We also approved the grievance
of Adam Carman and recommend repayment to him of one month's insurance
premium in the amount of $34.55.
We denied the grievance of Adam'.:Carman with respect to the reimburse-
ment of sick leave. We agree with the memo from the Superintendent
pointing out the City ordinances which require that compensation be
charged against sick leave. 43/7
We recommend that each and every City Employee be considered 'on the
payroll" for the payment of insuranceremiums, unless and until they
are (a) discharge4, (b) resign, and (c) are on a leave -of -absence re-
quested by the employee.

Controller Russell reviewed the rules of procedure governing the New
York State Health Insurance Plan in which the City had participated
since 1958. He referred to paragraphs 3 and 4 of Article V1 of the Bar-
gaining Agents' Agreement between the City and the Laborers' Union re-
garding grievance procedures. He questioned the Board's right to choose
Commissioner Putney to represent the City in these grievances and felt it
was unfair to the City to have Commissioner Putney represent it. He
suggested that no action be taken on the report pending a review of the
matter by the City Attorney. Mayor Conley suggested referring it to the
City's Negotiators for further review. The Clerk pointed out that the
Council, by resolution dated December 23, 1958, elected to participate in
the State Employees' Health Insurance Program for all of its officers
and employees and therefore questioned the Board's right to make any
changes in the rules regarding employees of the Board since it ob-
viously could not speak for all. He suggested that changes as sug-
gested in the foregoing letter should be presented to Council for final
action.

HILLICK-CARMAN GRIEVANCE: Attorney Gersh reported the Laborers' Union had filed a com-
plaint with PERB because the City had not complied with the Arbitrators' decision in
this grievance. He reviewed the steps already taken leading up to Mr. Putney's ap-
t pointment by the Board to represent the City. He felt the Board did not have such �/

authority and therefore the City did not have a legally appointed arbitrator to represent!
it. He gave his opinion that the authority for making such an appointment rested
solely with the Common Council, the legislative body of the City.

HILLICK-CARMAN GRIEVANCE: Attorney Gersh reported a compromise had been reached with
the Laborers' Union in the matter of the Hillick-Carman grievance and that the complaint
in the matter filed with PERB had been withdrawn. He recommended the Board take some
official action approving a compromise with the understanding that their grievance be
subject to negotiation in future wage agreements.

RESOLVED, that the Board recommends to Common Council that the CityvAttorney be authorized
to enter into an agreement with the Laborers' Union which will compromise the Hillick-
Carman grievance and similar grievances until December 31, 1972, the expiration date
of all bargaining agents' agreements with the City.

CONTROLLER: The Superintendent called attention to the fact that this would be the City
Controller's last Board meeting and that arrangements had been made for those who wished
. to attend a cocktail party for him after the meeting at the Char Pit on Elmira Rd. Vice-
# Chairman Leary extended the Board's thanks to Mr. Russell for his dedicated and worthy
services to the taxpayers of the City during his term of office and extended to him the
Board's best wishes and good luck in his new field of endeavor. Mr. Russell stated he
had enjoyed working with the Board and Council and even though there appeared to beCA.J�Zc,
differences of opinions at times yet he felt sure all were working for the best inte±ests
' of the City. ,

Office Manager in the Department of Public Works by opening competitive examination sad

Commission. Attorney Gersh called attention to action taken by the Council on this
same matter at its executive session held after its special meeting, dated June 21st,
recommending that the position be filled by promotional examination.

RESOLVED, that action on the. Superintendent's recommendation be deferred and that the
matter be referred back to the Finance Committee of the Board for further review and

OFFICE MANAGER - D. P. W.: Mayor Conley asked the status of the job of Office Manager
in the Department of Public Works as the C. S. E. A. had contacted him in regards to it.
Comm. Putney informed him that no official grievance had been filed and that they had sent
an answer t) the letter written to them by James Scripa, Fiold Representative.'
1, OFFICE MANAGER: Comm. Putney reported that they were asking the Civil Service
Commission to hold an open competitive examination for the position of Office Manager.
IAttorney Gersh reminded the Board that the Common Council had requested in June of this
•year that a promotional exam be held for this position. Superintendent Dingman explained
1 that the board has the right to hire those under their jurisdiction. Attorney Gersh
1 agreed with this. Mayor Onley explained that there were qualified people working for the
City and felt that this should be promotional. Superintendent Dingman said that no one
would be prevented from taking this examination and the request for an open competitive
exam decision laid with the Civil Service Commission. (
