HomeMy WebLinkAbout1981-02-09• • • TOWN OF PUBLIC February DANBY HEARING 9, 1981 A public hearing was held by the Danby Town Board on February 9, 1981 at 7 :30 P.M. at the Danby Elementary School, Gunderman Road, Town of Dainty, Tompkins County, New York. The purpose of the hearing was to consider the proposed amendment to the local dog law now in effect in the Town of Danby, relative to fees. Board members present: Councilperson Sylvia Hiney Councilman Ted Merritt Councilperson Dorothy Roberts Councilman Robert Snedden Supervisor Mildred Miller Others present: Carol & Casterline, Frank Haskins Mr. Hilker, Carol & WaltE Huddle, Sandy Strong, Sus Bob Tesori, Pete Goodman. John Benjamin, Edward Slights, Judy Roberts, Donald Wright, r Sczepanski, Connie Merritt, an Hautala, Charlotte Hautala, Roy Jane FoViler, Gay & Garry Pam Clermont, The Clerk presented the Supervisor with the proof of advertising. Supervisor Miller stated that the hearing was advertised in the February 3rd issue of the Ithaca Journal and that the prupose of the hearing was to repeal the Dog Law of 1979 of the Town of Danby whereby the Town set a local fee in addition to the statutory fee for dog licenses. The Town Board -is now in favor of no longer having that local fee. The statutory fee shall prevail. Mr. Hilker, who is proposing a contract with the Town for dog control, stated that if the dog license fees are reduced the Town will not be able to fund a dog control system. A lengthy discussion followed. All persons wishing to be heard, having been heard, the public hearing was adjourned at 8:00 P.M. Councilman Ted Merritt stated fees are being collected and will be used to offset the cost of cleaning the floors and having the lawn mowed. These fees will have nothing to do with the $100 fee paid to the school district by the town. This fee will be paid from town funds. • C Bob Tesori talked about the closing of the Danby school and school closings in other areas and how the school taxes are not decreased, but increased, even though the schools are closed. People are hurting because of increased assessments and high fuel bills. He doesn't feel he can get anyone to listen to his problems concerning assessments. The Board advised him to go tbethe Assessment Office. they will listen to individuals. Mr. Hilker presented the Town Board with copies of his proposed contract for dog control in the Town of Danby. This is an alterna- tive to the contract with the SPCA. He feels that his contract will be less expensive and will give more and better service to the Town than the contract proposed by the SPCA. After discussion, Supervisor Mildred Miller said that the board will consider Mr. Hilker's proposal. Mr. Hilker will meet with the board, if they feel it is necessary, to answer any additional questions. Close to Privilege of the Floor - Open for regular business meeting COMMUNICATIONS: 1. Highway - Bruce Hill Road is posted in the winter time to the effect that it will not be fully maintained.iThere seems to be some controversy over whether this should be fully maintained at all times or not. Zoning - Written report submitted. The Town Board is filing an application for insurance for the Town Officials with. the Ithaca Agency in order to get an estimate of the cost. Supervisor Mildred Miller said that Bruce Rightmyer has said he will serve as a member of the Danby Board of Zoning Appeals. An appointment will be made to talk with Mr. Rightmyer before the appointment to the board of zoning appeals is made. The matter of dog control was discussed. Some concern was expressed by the public that no enumeration is being made of the dog popula- tion in Danby. Mr. Hilker's proposal was discussed as well as that of the SPCA. It was agreed that the Town would go with the SPCA and that the supervisor be authorized to sign the contract. Councilman Robert Snedden moved a resolution that local dog fees be repealed by passing Local Law #1 of 1981. The motion was seconded by Council- person Dorothy Roberts. RESOLUTION #13 REPEAL LOCAL LAW N0, 1 OF THE YEAR 1979 SETTING THE LOCAL FEE FOR DOG LICENSES IN THE TOWN OF DANBY BY PASSING LOCAL. LAW N0, 1 OF 1981. Roll Call Vote: Hiney - aye Merritt - aye Roberts - aye Snedden - aye Miller - aye Carried by a vote of five ayes and no noes. The Town Board then looked over the bills before approving them for payment. The motion was made by Councilperson Sylvia Hiney and seconded by Councilperson Dorothy Roberts and carried by a vote of five ayes and no noes. The Supervisor's reports were approved as presented. The motion was made by Councilperson Dorothy Roberts and seconded by Councilman Ted Merritt and carried by a vote of four ayes and no noes. The March meeting of the Town Board will be held in West Danby at the fire station, with the permission of the fire commissioners. Council- person Dorothy Roberts will check this out and make the arrangements. This meeting will be held March 9, 1981 at 7:30 P.M. Pete Goodman and Connie Merritt both asked why the Town Hall has not been closed down completely and the Town Clerk's Office moved to the school. The Town Board passed a resolution in January stating that the Town Hall would be closed February 1, 1981 and all offices moved. Councilman Robert Snedden replied that there had been a meeting of the board and the clerk and the matter of moving her office discussed. A compromise was reached. The clerk agreed to move her office February 23, 1981. Most members of the board felt this to be an equitable agreement. Supervisor Mildred Miller read a part of a letter from the clerk which explained that it was impossible for her to move her office any sooner. All the heat has been turned off at the Town Hall, accept for the heat in the Clerk's Office, which has its own separate heating unit. The water has been turned off entirely. The expense for her to remain there will be minimal. Councilman Ted Merritt spoke against this arrangement anddsked how expensive it would be for the clerk to move her office. She stated that the highway people will move the office and therefore there • will be no expense to the town. It was asked what jurisdiction the Town Board has over the Clerk's Office. The Town Attorney has advised the board that they can say where the town records are to be kept and must approve:.any money spent by the clerk. The clerk is an elected official. Her office is a separate entity not under the jurisdiction of the Town Board. Supervisor Mildred Miller said that the hour is late and the town books must be audited and therefore made a resolution that the meeting be adjourned.
