Comm, Cleveland reminded City, -Attorney Shapiro that on July 22, 1981
a tie vote occurred in a meeting which Comm. Schickel chaired, in the
absence of Mayor Bordoni, He asked -for a ruling on whether the Nice
Chairman. is allowed'to vote to.break a tie after he- has already voted
on th.e resolution.

City Attorney•Sh.apiro ruled that, in the absence of the Mayor to chair
the meeting,: and th.e Vice•Chairman chairs the meeting; he is allowed
a vote as commissioner and.a vote as chairman in the case of a tie vote.
He cautioned; however, that on a matter of. great importance it would be
advisable to hold it over until the next meeting.
