AN, OUT Van Cort and the developer, had a meeting in which IMr. Weisburd suggested an alternate priopos.-i-il, EMumenthal stated that the Neighborhoods, Housing and MUMS committee had recommended to the board that an Environmental hrn;pact Statemet-;t be requested on the basis of the issues identified in the IMIa-rct-!, 25th memo to the board. S. CumnIngs stated her concerns regarding the memo. She Said that items 1-5 do not include all of the .5re-is which the board indicated concerns about The other area that concerned her dea-it vrrith thie -site as a:m i n-;port ant open space to the community; the character of the neighborhood (aesthetic, visual); the aesthetics of the proposed structures the'nsell,ves, and that there was no specific category dealing with the type TS o_r-.-u p a n cy f or ch the units d be marketed. ' ..{{Its!' haIE rnart's+ E'•eDOr t - None fii!,��I E E.fE�I r"r I Sy!�:•1 Y•�I.1 lJ Y"3?E.,�i"i t ZONING APPEALS MINUTES Planning and Development Board March 25, 1986: Codes and Administration Committee members, Blumenthal and Cook- ingham, reviewed the zoning appeals cases and determined that Appeal 1685 should be discussed by the Planning and Development Board. The remaining Appeals presented no issues of general planning significance. Mr. Cookingham presented the Committee's discussion regarding Appeal 1685. He said that Mr. Lower was requesting a reconfiguration of a dwelling at 241 Linden Avenue where nine apartments and one room would become five apartments. Mr. Cookingham said that since there is a temporary moratorium on building permits and certification of occupancy in this area, and since Mr. Lower is proposing the addition of one more room (person) greater than the existing configuration, the Board should deny this project based on the fact that there is a moratorium on building. Mr. Lower came into the meeting and Mr. Cookingham reviewed his statement. Mr. Cookingham stated that basically the decision of the committee was to suggest that the Board recommend denial of the variance to the BZA. Mr. Lower addressing the Board stated he was not proposing to in- crease the occupancy of the building. He said be believed that he would actually be decreasing the occupancy of the building because the bedrooms would be too small by N. Y. S. Housing Codes standards of square feet per bedroom. In that respect, he said that he would be cutting down the potential legal occupancy possibly by one or more. Mr. Lower said that in his opinion he would not rent to more people because he does not believe it is right, even though it would- be legally possible. He went on to describe some of the structural changes. He said that the interior walls would be replaced with 5/8 inch sheet rock that would improve insulation and upgrade the fire safety of the building. There would also be separate bathrooms. Mr. Lower stated that he would be happy to go over with Mr. Hoard the number of occupants that the New York State Code would allow. He believed that his proposal would decrease the number of occupancy in two ways. One way would be that the bedrooms would be either 120 sq. ft. or just a bit over 120 sq. ft. ; that those under 120 sq. ft. would be limited to one occupant. Also, the building is an eyesore. Mr. Lower told the Board that his interest was not in using the building to make a profit, but rather to transform the building that is now a "dump". Ms, Cummings asked Mr. Lower how many people are currently in the building and how many would be in the building after its conversion. Mr. Lower said he did not know the exact numbers in order to answer Ms. Cummings' question, but that he did not intend to have the bedrooms occupied to the maximum. He added that if the BZA decided to limit the occupancy to eight people that he would be happy to comply. He restated his comment that he wanted to improve the property, not exploit it. -2- Ms. Cummings commented that if Mr. Lower was going to take an eyesore property and improve the quality of the building and not increase the occupancy, that would .be fine. Mr. Cookingham mentioned that the com- mittee based their decision on the existing configurations , and under the new configuration the density went from nine to eleven people. He added that if the. Board felt they could condition the variance to limit the number of occupants that there would not be a problem. Mr. Lower said that he would be in agreement with the conditions that.the Board put forth. Motion: Mr. Cookingham, seconded by Mr. Sampson, moved to recommend approval of the variance to the Board of Zoning Appeals with the condition that the number of occupants be limited to eight. Mr. Jackson expressed concern regarding limitation of occupancy since this is difficult to enforce He suggested that controlling the number of rooms seemed more feasible. Vote: Vote on Mr. Cookingham's motion resulted in 5-aye, 1-nay (Jackson) . Motion carried. Discussion continued regarding Appeal 1682, 106 Sears Street. Ms. Cummings said that the area had recently been rezoned from R-3 to R2b changing the density allowed. Ms. Cummings suggested that in the Board's report to the Board of Zoning Appeals, the references to family residential . use and reducing its attraction to families be dropped; family was never a reason for the zoning change. The reason for the change was to prevent residential units from being torn down. Residents are eager to have the rooming house, which is an eyesore, converted. Chairman Blumenthal also suggested that the phrases regarding family be deleted. Mr. Jackson suggested that the Board mention only the reason for the zoning change. Ms. Cummings recommended that the Board's report to the BZA should state that the zoning was recently changed in order to help preserve the housing from demolition and to enhance the residental rather than the commercial activities of the neighborhood. This appeal should be seen as enhancing the residential character of the neighborhood. Motion: Ms. Cummings, seconded by Mr. Cookingham, moved that the Board's comment to the Board of Zoning Appeals on this Appeal state specifically that the intent of the 1984 zoning change from R-3 to R-2 was to improve the residential character of this neighborhood, and that the proposed variance would work toward that goal . Vote: 6-04. Motion carried. The committee found no planning issues of significance city-wide in Appeals 1683, 1684, or 1686-1690, though the members are hopeful that the Board of Zoning Appeals will reach an equitable resolution to the longstanding problem presented in Appeal 1687.
