ATTENDANCE TOWN OFFICIALS PRESENT: Supervisor- Liz Thomas 1St Deputy Supervisor- Nancy Zahler Board members- Michael Boggs, John Hertzler Town Clerk- Carissa Parlato Bookkeeper- Nina Thompson ABSENT- Board member- Rich Goldman OPENING THE HEARING: Ms. Zahler made a motion to open the hearing at 6:45pm, seconded by Mr. Boggs and passed unanimously. STATEMENT BY SUPERVISOR THOMAS: Welcome. My name is Elizabeth Thomas and I am the Supervisor of the Town of Ulysses. I am conducting tonight's public hearing on behalf of the Town Board of the Town of Ulysses. Before we begin, I'd like to introduce the other members of the Town Board: Michael Boggs, John Hertzler, and Nancy Zahler and Deputy Supervisor; our Town Clerk, Carissa Parlato. The subject of this public hearing is the proposed Local Law to Amend Chapter 80 of the Code of the Town of Ulysses ("the Code"), which provides for the Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code, the New York State Energy Conservation Construction Code and the Property Maintenance Code of New York. In 2007 the Town passed a local law to implement enforcement of the State Building and Fire Prevention Codes. It was amended in 2014 and 2016 to provide the Town with more tools to address unsafe structures and properties with significant exterior maintenance violations, such as accumulation of junk on a property. This law adds additional provisions to make the enforcement of the local law more effective, particular in the event of multiple violations that continue for an extended period of time. Specifically, this local law adds references to the Property Maintenance Code of New York State, and other codes enforced by the Code Enforcement Officer, to clarify that violations of any of these codes are subject to the provisions of the local law. It explicitly states that no one may construct, alter, repair, move, remove, demolish, equip, occupy, use, or maintain any building, structure, or portion thereof in violation of any provision of the applicable codes. Copies of the proposed Local law are available at the back of the room. The date of this public hearing was set by resolution of the Town Board on August 8, 2017 and a notice of this hearing was published in the Ithaca Journal on Saturday, August 19, 2017. The purpose of this public hearing is to afford the general public an opportunity to make statements and comments about the Local Law. The hearing will remain open until all members of the public who are present at the hearing have been given an opportunity to make statements or comments on the proposed amendments. A public hearing is a time for the board to LISTEN to comments from the public, not to engage in a dialogue or comment on the subject. Comments presented at this hearing will be taken into consideration by the Town Board when it considers action on the proposed Local Law. The Town Board may take action on this proposed Local Law later tonight. Speakers should try to limit their comments to no more than 3 minutes. Please state your name for the record. If you are appearing as a representative of an organization or governmental entity, please identify the organization or entity and state its address.
