PUBLIC HEARING ON PROPOSED PLANNED
OF
CHARLES BRUCE
JANUARY 28, 1980
DEVELOPMENT
The Town Board of the Town of Danby held a public hearing on the Bruce
proposed planned development on January 28, 1980 at 8:00 P.M. at the
Danby Town Hall, 1830 Danby Road.

Others present: Mr. & Mrs. Evelien, Edward Slights, Jim Hovanec, Stephen
Hovanec, Marjorie Van de Mark, Dean L'Amoreaux, Moses Peter, Sanford
Miller, Jr., Donald Graham, Wayne Rial, Evelyn Eisenberg, Althea Bruce,
John & Carol Shepardson, Judy and Ed Roberts, Charles and Carol Bruce,
Donald Wright, Frank Haskins, Gary Evans, Edward Roberts (Bald Hill),
Bill Genter, Ralph Wilbur, Robert Maycumber, Clifford Hill, John Novaar,
Mr. Campbell, Joan Babbitt, Mike Quinlan, John Shepardson, Jack Baker,
Mr. & Mrs. Randall, Ithaca Journal reporter Don Ross and many more.
The meeting was called to order at 8;00 P.M. the clerk presented Mildred
Miller with proof that the meeting was duly advertised in the Ithaca
Journal in the January 22, 1980 issue. Mrs Miller read the proof of
advertising and referred to a letter from the town clerk stating that
she had researched the minutes of past meetings of the town board and
found that the September 10, 1979 meeting minutes show that Councilman
Ralph Wilbur read a 14atter from Charles Bruce asking for the board's
approval of his proposed planned development at 1926 Danby Road. The
minutes further read that the town board will turn all information they
have on the Bruce planned development over to the planning board for
their review and recommendations. Mrs. Miller then asked Mr. Graham,
chairman of the planning board, what steps had been taken by the plan-
ning board in this matter. Mr. Graham said that the Bruce planned
development was first considered by the planning board at their Sept-
ember meeting. Not all of the required information was presented. The
necessary information was presented at the October meeting of the plan-
ning board which included a rough drawn map. Again there were questions.
At the December meeting of the planning board Mr. Bruce presented a
revised plan which was approved by the planning board. Mr. Graham then
wrote a letter to the Supervisor,Mrs. Mi.11eryrecommending to the town
board that action be taken to approve the Bruce proposed planned devel-
opment subject to a public hearing. The meeting was then opened to the
public for their comments for lor.againstjthe development.
Mr. Campbell urged the board members to consider the wishes of the
nearest neighbors to the Bruce proposed planned development.
Moses Peter said that he has become more and more concious of the tax
structure of the county. Danby needs good organized businesses. These
businesses are a service to the community.
Bob Maycumber feels that Danby is the highest taxed township in the
county. He approves of the proposed planned development of Charles
Bruce.
Elinor Randall stated that zoning is very essential but should be
enforceable. She is against the planned development.
Ralph Bowles stated that he is for the Bruce planned development. The
tractor company will require the business to be carried on in an orderly
manner.
Clifford Hill feels that if a person pays his taxes in a community,
he should have every right to make his living there.

John Novaar, a neighbor of Mr. Bruce,said that he is against the
Bruce proposed planned development. He read a statement signed by
property owners who hold over 90% of the land which borders the
Bruce property which requests the town board not to rezone the Bruce
property but to allow it to remain agricultural and residential.
Fred Thayer said that he has known the Bruce family for many .years and
also that he has worked in the town in many different capacities over
the years. He wants to see that the residential area of the town
remain residential and not zoned commercial.
Rick Dobson stated that more commercial land is needed in Danby to
bring in more tax money. .
Carol Hovanec said that Danby has nothing to offer. Property is hard
to sell. We need businesses. •
Carol Bruce said that she and her husband have had their house for
sale for three years and could not sell it. There is nothing to
offer in Danby.
John Myers stated that the residential property in Danby needs to be
protected. Zoning is the answer but must be enforceable.
John Wormser said that a master plan is needed so that areas for
commercial growth can be designated.
Carol Benjamin said that people who have owned property for many years
should be able to use their property to carry on business and not have
to buy more property to set up a business.
Mike Quinlan, John Shepardson, Jim Hovanec, John Schmonsees, Rick
Dietrick, Mr. & Mrs. Evelyn all said th are for the Bruce proposed
planned development.
Mr. Randall said that he is against the planned development.
All persons wishing to be heard having been heard the matter was then
considered by the board. Supervisor Mildred Miller read a letter from
Ted Merritt councilman for the Town of Danby. The letter signed by
Mr. Merritt stated that any affiliation he has with the Bruce family
will not affect the manner in which he conducts himself in public
office. After discussion by the board of the proposed planned development,
Supervisor Miller stated that a vote of the board members would be
taken either for or against the planned development keeping in mind
that there will be a survey made of the dividing line between the
planned development and residen' . There must be 200 feet between
the edge of the building and any residence. The final vote of the
board will be taken when this survey has been made. A roll call vote
was taken, Snedden, Roberts, Merritt and Miller were for the planned
development and Corbitt was against it.
As there was no other business to be brought before the board the
meeting was adjourned.
