Town of Danby, County purpose of the hearing $2.50 for dog licenses Board members present: C7 Town of Danby held a public hearing December at the Danby Town Hall, 1830 Danby Road, of Tompkins and State of New York. The was to discuss the proposed local fee of in the Town of Danby. Supervisor A. Francis Wright Councilman Ralph Wilbur Councilperson Dorothy Roberts Councilman Robert Snedden Justice Milton Todd Others present; Dean Westmiller, Rick Dobson, Edward Slights, Moses and Lois Peter, Roy Casterline, Fred Thayer, Donald Miller, Frank ® Haskins, Jim Hovanic, Van Dyke Billings. The meeting was called to order at 7:30 P.M. and the notice of publication was read by the Supervisor. The fees for dog licenses were discussed. It was noted that the statutory fee for neutered dogs is $2.50 and the statutory fee for unneutered dogs is $ ?.50. This would increase the _license fee for neutered dogs to $5.00 and unneutered dogs to $10.00 if a local fee of $2.50 is approved. The proposed increase and fees for purebred licenses was discussed further. The Town of Danby by local law or ordinance may set license fees in addition to the state fees pursuant to sub - division 4 of Section 110 of the Agriculture and Markets Law of the State of New York. If a local fee is approved, the money collected can only be used for dog control. It was noted that the fee for neutered dogs will be lower in 1980 than it was in 1979 if the proposed local fee is approved. Councilperson Dorothy Roberts moved a resolution that the Town of Danby set the local fee for dog licenses at $2.50 and follow the state mandate for purebred lice ses. Respectfully submitted, Za/r;yy ( %I�Z , c 1 e TOWN OF DANBY LOCAL DOG LICENSE FEES LOCAL LAW NO. 1 of the year 1979. A local law providing for the setting of the local fee for dog licenses in the Town of Danby, New York. Be it enacted by the Town Board of the Town of Danby, New York as follows: SECTION I. The local annual fee for each dog license issued in the Town of Danby shall be $2.50. This local fee is in addition to the statutory fee. Total dog license fees are as follows. a) Statutory fee of $2.50 for neutered dogs both male and female plus local fee of $2.50 or a total fee of $5.00 for all neutered dogs. b) Statutory fee of $7.50 for unneutered dogs both male and female plus local fee of $2.50 or a total fee of $10.00 for unneutered dogs. c) The statutory fee for purebred licenses shall prevail. No local fee will be added. SECTION II. This local law is adopted pursuant to Section 110 Sub - division 4 of the Agriculture and Markets Law of the State of New York (effective 10/1/79). SECTION III. This local law shall take effect immediately upon its filing in the office of the Secretary of State in accordance with the provisions of Section 27 of the Municipal Home Rule Law. The purpose of this hearing is to review the town fee for 1980 dog licenses. The town fee to be $2.50 in addition to the state fee of $2.50 for neutered male dogs and spayed female dogs and $7.50 for unneutered male dogs and unspayed female dogs. By Order of the Town Board Mary Oltz., Town Clerk December 1, 1979 v4 r TOWN OF DANBY TOWN BOARD MEETING MINUTES December 10, 1979 The regular meeting of the Danby Town Board was called to order at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins and State of New York on December 10, 1979 at 8:00 P.M. Board members present: Supervisor A. Francis Wright Councilman Ralph Wilbur Councilperson Dorothy Roberts Councilman Robert Snedden Justice Milton Todd Others present: Dean Westmiller, Rick Dobson, Edward Slights, Moses and Lois Peter, Roy Casterline, Fred 1hayer, Donald Miller, Frank Haskins, Jim Hovanic, Van Dyke Billings,Dean L'Amoreaux, Mildred Miller, Rhoda Larson, Mary Smith, Lucy Hogben, Beverly Stone, Ken Compton, Paul Smith, Paul Howard, Frank Haskins, Bradley Corbitt, Donald Graham, Al Sebesta. Councilperson Dorothy Roberts noted that on page 3 of the November minutes of the regular meeting of the board it should have stated that James Hovanic will be filling the vacancy created by the expir- ation of Clifford Hills term of office in July of 1979. Mr. Hovanec's term of office will expire in 1986. Milton Todd made the motion that the minutes of the November meeting be approved with the above correction. The motion was seconded by Councilperson Dorothy Roberts and carried by a vote of five ayes and no noes. COMMUNICATIONS: 1. A letter from Attorney Morrison representing Jimmie Miller in the sale of his property located next to the town hall. 2. A letter from Gwen Cukierski concerning the window covering project in the town hall. 3. A letter from the CNA Insurance Companyconcerning insurance rates for Major Medical coverage. Supervisor A. Wright noted that he was served a summons December 7, 1979 in the matter of the Claim of Rick Dobson against the Town of Danby. The summons was turned over to the Town Clerk for filing. PRIVILEGE OF THE FLOOR: Roy Casterline asked why the trailer was allowed to remain on Brown Road with no permit. He was advised that this matter is on the agenda. Dean Westmiller thanked the Town Board on behalf of the highway people for their negotiations to settle the contract between the Tompkins County Chapter of Civil Service Employees Association, Inc. (Danby Highway Unit) and the Town of Danby. He said new Town Board members are invited to look over the highway equipment. Dean L'Amoreaux of the Danby Community Council, who will be president of the council in 1980, asked that the balance of the funds in the youth program account in the 1979 budget be incumbered to help support a program of spring sports. Mary Smith thanked the Town Board for having the stone marker moved from the church yard to the town hall property. Moses Peter asked if anything has been done about lowering the ceil- ing the town hall to conserve energy. Jim Hovanic suggested that the air be recirculated with fans. Rick Dobson asked to by the town attorney he could look at the and that there could in litigation, see the bill for the fees charged to the town in the matter of his concert. Francis Wright read a resolution of ei-iiendment to the 1980 Town of Danby budget. This amendment is necessary in order that the Town of Danby may participate in the New York State re- creation program for the elderly. Participation in this program will make y$1000.00 available to the Danby Senior Citizens. The matter was discussed. Supervisor A. Francis Wright moved the resolution which was seconded by Councilman Ralph Wilbur. RESOLUTION x#38 Roll Call Vote: AMEND THE 1980 BUDGET FOR TOWN OF DANBY. Wright - aye Wilbur - aye Roberts - aye Snedden - aye Todd - aye Carried by a vote of five ayes and no noes. THE C7 Supervisor A. Francis Wright read an agreement between the Town of Danby and the Tompkins County Senior Citizens Council. After discussion, Councilman Ralph Wilbur moved a resolution that the town supervisor be authorized to execute this agreement. The motion was seconded by Justice Milton Todd. Mildred Miller who will take office as supervisor of the town at the first of the year agrees with this program. The application must be filed by December 31, 1979 RESOLUTION #39 AUTHORIZE THE TOWN OF DANBY SUPERVISOR TO EXECUTE AN AGREEMENT BETWEEN THE TOWN OF DANBY AND THE SENIOR CITIZENS COUNCIL OF TOMPKINS COUNTY. Roll Call Vote: Wright - aye Wilbur - aye Roberts - aye Snedden - aye Todd - aye Carried by a vote of five ayes and no noes. COMMITTEE REPORTS: Highway Report - All donovan projects have been completed and approved and the money will be forthcoming from the State. Plans for the next program are being made. An agreement between the Tompkins County Chapter pf Civil Service Employees Association, Inc. (Town of Danby Highway Unit) for wage increases has been completed and signed and turned over to the Town Clerk for filing. Insurance - Nothing to report. West Danby Water District - All is alright. Refuse Collection and Disposal - Nothing to report. Youth Program - Working on the 1980 Application to the State for the Youth Recreation Program. Zoning and Planning - Even though one new member has been appointed to serve on the planning board, there are still two vacancies to be filled. There is no chairman of the board and no representative from Danby on the Tompkins County Planning Board. Councilman Robert Snedden made the motion that Donald Graham be appointed chairman of the planning board and also serve as Danby's representative on the Tompkins County Planning Board. The motion was seconded by Dorothy Roberts and carried by a vote of five ayes and no noes. There was nothing to report under zoning. Mr. Billings stated that in order to settle the matter of the trailer on Station Road that was talked about earlier, he needs direction from the board as to whether a double wide trailer is allowed on a lot the same as a home. A lengthy discussion followed. Insurance wise a double wide or modular home is considered a house. The "zoning officer must follow the zoning law of the town and proceed accordingly. As Van Dyke Billings will no longer serve as zoning officer. Councilman Robert Snedden made the motion that Frank Haskins be appointed zoning officer as of December 31, 1979 for the Town of Danby. The motion was seconded by Council- man Ralph Wilbur and carried by a vote of five ayes and no noes. Fire - Danby fire company is ver active. There is an election if officers being held tonight. They will hold a dance to raise funds. Councilman Ralph Wilbur presented the board with a letter of intent from Charles Bruce for a planned development and approval of a sign. The Town Board accepted the plans and resubmitted them to the planning board for approval or disapproval. The planning board will then make their recommendations to the Town Board. Cemetaries - Nothing to report. OLD BUSINESS: Highway Superintendent - Absent. Appeals Board Chairman - Absent. Planning Board Chairman - Donald Graham reported that Pam Claymont of Steam Mill Road has expressed the wish to serve as a member of the planning board. This matter was referred to committee. The next meeting of the planning board will be held December 19, 1979- After discussion of the purchase of the property owned by Jimmie Miller located next to the town hall, Councilperson Dorothy Roberts made the motion that the matter be tabled. The motion was seconded by Council- man Robert Snedden and carried by a vote of five ayes and no noes. Supervisor A. Francis Wright moved a resolution to incumber $810.00 for completing the window covering project for the town hall. The installation of the window coverings will be completed in 1980. Councilman Robert Snedden seconded the motion. RESOLUTION #40 Roll Call Vote: Wright - aye Wilbur - aye Roberts - aye Snedden - aye Todd - aye INCUMBER $810.00 TO BE USED TO FINISH THE WINDOW COVERINGS FOR THE TOWN HALL MEETING ROOM. Carried by a vote of five ayes and no noes. The question of incumbering the balance of the funds budget will be handled at the year end meeting. The meeting of the board will be held December 26, 1979 at the Danby Town Hall. in the youth thirteenth at 8;00 P.M. Rick Dobson's claim against the Town of Danby has been turned over to the town attorney. The insurance company has been notified and nothing more need be done at this time. An appointment of a representative from the Town of Danby to the Environmental Management Council was discussed. Town Board Meeting Minutes - December 10, 1979 Page 4 Old Business continued: A Board of Ethics for the Town of Danby is needed. This is a three member board. It was suggested that someone from the Community Council, someone from the Town Board and someone from the Planning Board should serve on this board. Councilman Robert Snedden made the motion that Dean L'Amoreaux, Ted Merritt and Donald Graham serve on this board and Roy Casterline serve as alternate. Council - person Dorothy Roberts seconded the motion which was carried by a vote of five ayes and no noes. The town clerk was asked to notify the State of the appointment of the Board of Ethics. NEW BUSINESS: General Fund Warrant #12 in the amount of $1722.40 was approved to be paid. The motion was made by Councilperson Dorothy Roberts and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes. Highway Fund Warrant #12 in the amount of $5652.46 was approved to be paid. The motion was made by Justice Milton Todd and seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes. West Danby Water District Warrant #12 in the amount of $48.06 was approved to be paid. The motion was made by Councilman Ralph Wilbur and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes. Councilperson Dorothy Roberts made the motion that the Supervisor's reports be approved as presented. -The motion was seconded by Justice Milton Todd and carried by a vote of four ayes and no noes. As there was no more business to be brought before the board Councilman Ralph Wilbur made the motion to adjourn the meeting.
