TOWN OF DANBY
SPECIAL BOARD MEETING MINUTES
November 12, 1979
A special meeting of the Danby Town Board was called to order on
November 12, 1979 at the Danby Town Hall, 1830 Danby Road at 8:00
P.M. as duly advertised in the November 5, 1979 issue of the Ithaca
Journal. The purpose of the meeting was to open bids for diesel
fuel and for gravel to be used by the highway department.

Councilman Robert Snedden
Councilperson Dorothy Roberts
Justice Milton Todd
Others present: Roy Hornbrook, George Arsenault, Ida Hulbert,
Jonny Sill, Frank Haskins, Donald Wright, Fred Thayer and Rhoda
Larson.
One bid was received for gravel from Schooley Enterprises, Inc. and
is as follows: $.50 per yard, loaded and picked up by the Town of
Danby at the gravel pit in Brooktondale. This price to remain the
same for the remainder of 1979.
One bid was received for Diesel Fuel 112 and Fuel Oil #2 from Harold
A. Fish, Jr. of South Side Fuel Co. at a price per gallon of .744
on November 8, 1979. Arco is the supplier and the price will change
as Arco changes the price that they will sell the fuel to South Side
Fuel Co.
The supervisor explained that these items must go for bid as there
is a possibility that the town will be paying more than $5,000.00
for these items in a twelve month period. Thus the town will be
in compliance with the laws of New York State. After discussion of
the two bids received Councilman Ralph Wilbur made the motion that
the bid of South Side Fuel Company of .744 for diesel fuel and fuel
oil with increase to be charged as Arco increases the price that
South Side Fuel Company must pay, be accepted. The motion was
seconded by Councilman Robert Snedden and carried by a vote of five
ayes and no noes. Justice Milton Todd made the motion that the bid
of Schooley Enterprises, Inc. for gravel at $.50 per yard be accepted.
Councilperson Dorothy Roberts seconded the motion which was carried
by a vote of five ayes and no noes.
As there was no other business to be heard before the board the special
meeting was adjourned.

The regular meeting of the Danby Town Board was called to order at
the Danby Town Hall, 1830 Danby Road, Town of Danby, County of
Tompkins and State of New York on November 12, 1979 at 8:30 P.M.
Board members present; Supervisor A. Francis Wright

Councilperson Dorothy Roberts
Councilman Robert Snedden

The minutes of the regular meeting of the hoard held October 8, 1979
were approved as presented. The motion was made by Justice Milton
Todd and seconded by Councilperson Dorothy Roberts and carried by a
vote of five ayes and no noes.
COMMUNICATIONS:
1. Resolution No. 274 of the Tompkins County Board of Rep-
resentatives entitled "Authorization to Execute Contract -
SPCA and Towns ".
2. A letter from the Tompkins County Environmental Management
Council advising the town that a new representative from
Danby will be needed at the end of the year.
3. A letter from the Tompkins County Department of Health
concerning inactive hazardous waste disposal site survey.
4. Agenda of the Tompkins County Board of Representatives
meeting to be held Tuesday November 13, 1979.
5. A memorandum from the Tompkins County Board of Represent-
atives concerning Dog and Animal control service with
Resolution No 274 entitled "Authorization to Execute
Contract - SPCA and Towns as Amended ".
6. A letter of resignation from Van Dyke Billings as zoning
officer. The letter also stated that George Arsenault
must resign as assistant zoning officer Both to be
affective December 31, 1979.
PRIVILEGE OF THE FLOOR:
• Mary Smith asked that the stone marker located in the churchyard
be moved to the town property by the town hall.
• Jonny Sill reported that people have moved into a trailer in West
Danby. They have no permit, no water, no sewerage connections.
They are definitely in violation of the Danby Zoning Ordinance.
Van Billings stated that he was aware of the situation and that
these people are attempting to comply.
Ida Hulbert reported that there is work being done on the West
Danby Park. It has been leveled with a bulldozer and will be seeded.
The matching funds from the town will be needed to finish the project.
Albert Sebesta reported that he has copies of the Seneca County Law
regulating the assembly of persons within the County of Seneca,
New York. He asked that it be filed to be used by the town to
draw up a similar law for the County of Tompkins. This will be
filed in the Town Clerk's Office.

Privilege of the Floor continued:
Mr. Sebesta asked if Michigan Hollow Road is a town road or a
county road. He stated that the road is in very poor condition.
The highway superintendent stated that Michigan Hollow Road is a
town road and without extensive work it will remain in poor cond-
ition. The money is not available to undertake such a project.
The road is graded as often as he can do it.
Fred Thayer introduced Beverly Stone who represents the senior
citizens center and came to talk about available state funds for
senior citizens. They can be obtained without increasing local
taxes. She asked that the Town of Danby participate in the state
recreation program for the elderly. Participation in this program
would make $1,000.00 available to the senior citizens of Danby.
This amount is above and beyond what is already budgeted for the
senior citizens. It was noted that the deadline for filing to
obtain these funds is December 31, 1979. Supervisor A. Francis
Wright appointed a committee to study the matter. Councilman
Robert Snedden and Mildred Miller will serve on this committee with
Supervisor Wright. The matter was discussed at length.
Councilperson Dorothy Roberts moved a resolution to set a public
hearing for dog license fee increases on December 10, 1979 at
7:30 P.M. immediately preceeding the regular meeting of the Danby
Town Board to be held at the Town Hall. Councilman Robert Snedden
seconded the motion.

Establishing a board of ethics for the Town of Danby was discussed.
There is a possibility that the town could be represented by the
County board of ethics. A committee was appointed to look into
this matter. Justice Milton Todd will chair the committee and
Councilman Ralph Wilbur and Councilperson Dorothy Roberts will
work with him.
COMMITTEE REPORTS:
Highway report - Councilman Ralph Wilbur reported that an agreement
has been reached 6efiw�e4the highway employees and the town and the
contract is ready for signatures if the board approves. (CSEA Contract

Justice Milton Todd moved a resolution that the salary schedule as
set up be approved by the Town Board if approved by the highway
employees. The motion was seconded by Councilperson Dorothy
Roberts.

Committee reports continued;
It was further reported that Muzzy Road work has been finished and
the road is ready for inspection. The snow equipment is ready when
it is needed. The new 1980 pick -up truck for the highway superin-
tendent has been received. All Donovan projects are completed.
Insurance - Nothing to report.
West Danby Water District - Justice Milton Todd moved a resolution
to add unpaid water bills to the tax roll. These bills amount to
$2,608.99. A copy of this resolution with a copy of the certified
list of delinquent bills to be turned over to the assessment depart-
ment. Councilman Ralph Wilbur seconded the motion.

Youth - Ida Hulbert asked if any more funds will be available from
the town for the West Danby Park project in 1980s. The matter was
discussed.
Zoning and Planning - Nothing to report.
Fire - Nothing to report.
Cemetaries - All taken care of.
OLD BUSINESS&
Highway Superintendent - Nothing to add to the report already given.
Appeals Board Chairman - Absent, no report.
Planning Board Chairman - Vice - chairman, Donald Graham, reported that
the planning board is operating with a handicap. They are three
members short of having a full board. He asked that the town board
fill these vacancies. On October 17th the planning board approved
the proposed new zoning ordinance and 2 copies were presented to the
town board. The ordinance was discussed and the copies filed with
the town clerk. Councilperson Dorothy Roberts made the motion that
James Hovanec be appointed to serve as a member of the Town of Danby
Planning Board. The motion was seconded by Justice Milton Todd and
carried by a vote of five ayes and no noes. Other people have been
contacted and appointments will be forthcoming.
Zoning Officers Report - One permit was issued in October. Council-
man Ralph Wilbur made the motion that the supervisor be authorized
to pay the assistant zoning officer, George Arsenault, $300.00.
The necessary money has been budgeted for this purpose. Justice
Milton Todd seconded the motion which was carried by a vote of five
ayes and no noes.
Mr. Graham reported that the Randall planned development was brought
before the planning board and their recommendation to the town board
approve the application. Councilman Robert Snedden moved a resolution
to approve the application of the Randall's for a planned development
as recommended by the planning board. The motion was seconded by
Justice Milton Todd.

Old Business continued;
RESOLUTION #35 UPON THE RECOMMENDATION OF THE PLANNING
BOARD, THE TOWN BOARD APPROVES THE APPLIC-
ATION OF THE RANDALL'S FOR A PLANNED
DEVELOPMENT.

The Town Board discussed the petition that has been circulated for
the purchase of the property next door to the town hall owned by
Jimmie Miller. Councilperson Dorothy Roberts stated that the
building on the property that is partially torn doen should be
completely taken down before the town even considers buying the
property. She also brought up the question of whether or not it is
ethical for the town to buy property from a town official. The zon-
ing officer was to contact Mr. Miller and ask his intentions con-
cerning the building on the property. The matter was then referred
back to committee for further study.
The supervisor asked Joan Barber to enumerate the dogs for the town.
She has asked for an additional $.50 per dog enumerated to help pay
for the gas she uses. The matter was discussed. Councilman Robert
Snedden made the motion that the dog enumerator be paid an additional
$.50 per dog enumerated Councilperson Dorothy Roberts seconded the
motion which was carried by a vote of five ayes and no noes.
A representative from the Town of Danby to serve on the Enviromental
Management Council was discussed. This is a two year appointment
and someone will be needed by the end of the year.
Inactive hazardous waste disposal sites in the Town of Danby were
discussed. No one on the board knew of any such sites in the town.
Therefore, the supervisor asked the town clerk to so advise the
Tompkins County Health Department who has been delegated the respon-
sibility of surveying Tompkins County in an attempt to locate these
sites.

Supervisor A. Francis Wright reported that the Tompkins County Trans-
portation Committee has made the recommendation that parking areas
be made available in the towns for people to leave their cars and
ride to work with someone else. The county will provide the signs
for areas designated by the towns. The lot by the town hall must be
repaired before it can be officially designated as a park it and
ride area. Justice Milton Todd will look into a lot in West Danby
and report back to the board in December.

The board discussed joining the county in a contract with the SPCA
and the other towns in the county. Councilman Ralph Wilbur made the
motion to table the matter until the next board meeting. Possibly
by that time there will be more information available. The motion
was seconded by Councilman Robert Snedden and carried by a vote of
five ayes and no noes.
The resignation of the zoning officer was discussed. It was sugg-
ested that an article be put in the Danby Area News to make people
aware that the position is open and perhaps there will be volunteers.
Councilperson Dorothy Roberts stated that she has had a complaint of
25 cars parked on Hornbrook Road. These are Auto Salvage cars.

Supervisor A. Francis Wright.moved a resolution to transfer $1492.79
from the contingency account A1990.4. $499.00 to go to the unalloc-
ated insurance account A1910.4 for insurance for the new truck. $46.79
to go to the social security account A9030.8. $947.00 to go to the
Health Insurance account A9060.8 to pay additional premium.

Councilman Ralph Wilbur made the motion to transfer $1,200.00 from

Supervisor A. Francis Wright seconded the motion which was carried
by a vote of five ayes and no noes.
General Fund Warrant #11 in the amount of $3,279.05 was approved to
be paid. The motion was made by Justice Milton Todd and seconded by
Councilman Robert Snedden and carried by a vote of five ayes and no
noes.
Highway Fund Warrant #11 in the amount of $7,210.15 was approved to
be paid. The motion was made by Councilman Ralph Wilbur and seconded
by Councilperson Dorothy Roberts and carried by a vote 'of five ayes
and no noes.
West Danby Water District Warrant #11 in the amount of $48.40 was
approved to be paid. The motion was made by Councilman Ralph Wilbur
and seconded by Justice Milton Todd and carried by a vote of five
ayes and no noes.
Councilman Ralph Wilbur made the motion to approve the Supervisr's
reports as presented. The motion was seconded by Justice Milton
Todd and carried by a vote of four ayes and no noes.
Justice Milton Todd made the motion that the Supervisor be authorized
to sign the yearly maintenance agreement for the repeater on Conn-
ecticut Hill. A fee of $99.00 is charged. Councilperson Dorothy
Roberts seconded the motion which was carried by a vote of five ayes
and no noes.

Justice Milton Todd made the motion that the meeting be adjourned.
The motion was seconded by Councilperson Dorothy Roberts. and carried
