HomeMy WebLinkAbout1979-09-100 TOWN OF DANBY TOWN BOARD MEETING MINUTES September 10, 1979 The regular meeting of the Danby Town Board was called to order at the Danby Town Hall, 1830 Danby Road, Town of Danby, County of Tompkins and State of New York on September 10, 1979 at 8:00 P.M. Board members present: Supervisor A. Francis Wright Councilman Ralph Wilbur Councilperson Dorothy Roberts Councilman Robert Snedden Justice Milton Todd Others present: Edward and Judy Roberts, Frank Haskins, Bill Shippos, Sanford Miller, Allen Cropf, Donald Wright, Van Dyke Billings, Roy Hornbrook, Roy Casterline, Frank Muzzy, Donald Graham, Roland Manley, Rick Dobson, Mildred Miller, Sylvia Hiney, Bradley Corbitt, Carol and John Benjamin, Sandy Strong, Al Sebesta, Bill Genter, Peggy and Joe Petrillose, Mrs. Constantine, Carol Shepardson, Edward Slights, Steven Havanec, Rick Lazarus ..i:_ a f. Councilperson Dorothy Roberts made the motion to accept the minutes of the August 13, 1979 meeting of the board as presented. The motion was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes. COMMUNICATIONS: 1. A letter of appreciation from Assemblyman Sam MacNeil for the invitation to the August meeting of the Town Board, 2. Agenda of the meeting of the Tompkins County Board of Representatives held September 10, 19794 3. Minutes of the meeting of the West Danby Water District Commissioners held September 5, 1979. PRIVILEGE OF THE FLOOR: The clerk stated that alternate election inspectors for the Democratic party and also for the Republican party have been found and need to be approved and officially appointed by the board. The drapes for the meeting room have not been completed yet but should be by October 1, 19790, A dog enumerator is needed and the clerk.,was asked to contact Joan Barber to see if she is interested in this position. Rick Dobson presented letters and papers pertaining to his Woodsidell concertvfor`�°eir information. He feels that the injunction to stop the concert because it could be a public nuisance is unfair. He stated that he intends to go on with the concert one way or another. Steven Havanec said that he is not forr,or a ainst the co Rock Dobson's but feels the publicity is out of hand, concert of Rick Lazarus asked if he could contract with the town to get his driveway cleaned out in'the winter time. He was told that the law will not allow this Edward Roberts reported on the by the Danby Community Council, summer program at the Danby Pond run He feels that it was successful. Town Board Meeting Minutes - September 10, 1979 Privilege of the Floor continued: Page 2 Bill Shippos asked what is being done about Cable TV for West Danby. He also asked if the Town Board could help with this. Frank Haskins reported that only 32 West Danby People signed the petition for Cable TV out of the necessary 84 subscribers needed. The Town Board said that they would do what they could to help. Al Sebesta mentioned his feeling about Rick Dobson's Woodside II concert and asked the Town Board to pass an ordinance to make a permit necessary for an assembly of over 1000 people in Danby after September 21st. The matter was discussed. Zoning and enforcement of zoning was discussed as it affects the people of Danby and Danby's image. COMMITTEE REPORTS: Highway report - Councilman Ralph Wilbur reported on the Donovan projects for 1980 that must be submitted by September 20, 1979. The total amount of money to complete the Donovan projects is $35,847.00. Extra funds may be available for bridges through the Donovan program as a special project. Justice Milton Todd moved a resolution to include the Donovan projects in the town budget for 1980. The motion was seconded by Councilperson Dorothy Roberts. RESOLUTION #19 INCLUDE THE DONOVAN PROJECTS IN THE 1980 BUDGET FOR THE TOWN OF DANBY AT A TOTAL COST OF $35,847900. Roll Call Vote: Wright - aye Wilbur - aye Roberts - aye Snedden - aye Todd - aye Carried by a vote of five ayes and no noes. Councilman Ralph Wilbur stated that the specifications have been drawn up for a 2 ton 4 -wheel drive pick -up truck 1980 model for the highway department. They would like delivery by November 15, 1979. The money has been appropriated. He then moved a resolution that the Town of Danby advertise for bids for the pick -up truck per specifications. Bids to be opened October 8, 1979 at 7:30 P.M. at the Danby Town Hall. The motion was seconded by Councilman Robert Snedden. RESOLUTION #20 Roll Call Vote: M ADVERTISE FOR BIDS FOR A 2 TON 1980 i PICK -UP TRUCK FOR THE HIGHWAY DEPART- MENT OF THE TOWN OF DANBY PER SPECI- FICATIONS. Town Board Meeting Minutes - September 10, 1979 Committee reports continued: Page 3 Insurance - The town board met with the insurance agent to update the town insurance. The insurance on the town highway equipment needs to be increased. There should be an appraisal done on the Town Hall and the Town Barns for fire insurance purposes. The bonds carried on the supervisor and town clerk should be increased. The insurance on the West Danby Water District equipment will be looked into by the water district commissioners. Justice Milton Todd moved a resolution to increase the towns auto liability insurance to one -half million dollars, increase personal injury to coincide with the auto insurance, also have an unbrella clause .that goes to one million dollars and authorize the supervisor to negotiate with the insurance agent. The motion was seconded by Councilman Robert Snedden. RESOLUTION #20 � INCREASE AUTO LIABILITY INSURANCE TO ONE - HALF MILLION DOLLARS, INCREASE PERSONAL INJURY TO COINCIDE WITH AUTO INSURANCE AND AUTHORIZE THE SUPERVISOR TO NEGOTIATE WITH THE INSURANCE AGENT. West Danby Water District - The supervisor has received the tenative budget for the water district. Refuse Collection and Disposal - Nothing to report. Youth Program - Mary Oltz reported that the Community Council has had a budget meeting and is prepared to present the town board with a proposed budget for 1980. Zoning and Planning - The planning board needs two members so that they will be able to function with a full board. There will soon be a third opening on the board. Councilman Ralph Wilbur read a letter from Charles Bruce asking for the boards approval of his planned development at 19245 Danby Road. The board will turn the information they have over to the Planning Board for their review and recommend- ations. The permit for the Danby Pond was discussed. Fire - The department is very busy. At present they are working on ® their 1980 budget which will be turned over to the town board by September 20, 1979. Cemeteries - All in good shape. There are 8 cemeteries that Ed Slights takes care of. Councilman Robert Snedden reported that the committee negotiating a contract with the highway employees has met and is working. Councilman Dorothy Roberts made the motion to appoint the two alternate election inspectors, Republican Mildred Weitzel and Democrat Linda Howe to serve as inspectors for the Town of Danby for the 1979 - 1980 term of office. The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes. Town Board Meeting Minutes - September 10, 1979 Page 4 OLD BUSINESS: Highway Superentendent's Report - Nothing to add to the report 2iready given, Appeals Board Chairman - Frank Muzzy reported that there are no vacancies on the board of zoning appeals and there is a hearing schedulled for Wednesday of this week. Planning Board Chairman - Absent. The Vice - chairman reported that the next meeting of the board will be held September 19, 1979 at the Danby Town Hall, Zoning Officer - Van Billings reported that 2 permits were issued in August. Grading the parking lot at the town hall was discussed. Funds are available to have this done. Roy Hornbrook said he will get this r k done sometime late on October. NEW 60sTNESZ: The supervisor reported that he needs authorization from the board to negotiate for an anticipation note or go for a bond for funds to pay for the 4 -wheel drive snow plow vehicle. The matter was discussed. This will be looked into and a report made at the October meeting. Councilman Ralph Wilbur made the motion to appoint Rolland Manley as town constable. His appointment to be affective 30 days from tonight. The motion was seconded by Councilperson Dorothy Roberts and carried by a vote of five ayes and no noes. The job of town constable was discussed. Problems of dogs biting people and the procedure to follow to handle such matters was discussed. After discussion by the board, it was decided that the supervisor will talk with the manager of the Cable T.V. Company to see what can be done, Fees to be charged for of $5.00 and $10.00 was a resolution to set fee spayed female dogs and was seconded by Council dog licenses in 1980 were discussed. A fee suggested. Councilman Robert Snedden moved s6for 1980 dog licenses at $5.00 for male and $10.00 for unspayed female dogs. The motion person Dorothy Roberts. RESOLUTION #21 FEES FOR UNSPAYED FEMALE DOGS FOR 1980 TO BE SET AT $10.00 AND THE FEE FOR MALE AND SPAYED FEMALE DOGS AT $5.00. is Roll Call Vote: Wright aye Wilbur - aye Roberts - aye Snedden - aye Todd - aye Carried by a vote of five ayes and no noes. The date for the public hearing on the use of the Revenue Sharing Funds was set for September 24, 1979 at 8:00 P.M. at the town hall. Councilman Ralph Wilbur made the motion that the clerk advertise the hearing. The motion was seconded by Councilman Robert Snedden and carried by a vote of five ayes and no noes. The budget meeting will be September 19, 1979 at 7:30 P.M. at the home of the supervisor. Town Board Meeting Minutes - September 10, 1979 Page 5 New Business continued. Councilman Robert Snedden made the motion that the $100.00 lease fee for the the West Danby Ball Park be paid to Leon Drake. The motion was seconded by Councilperson Dorothy Roberts and carried by a vote of five ayes and no noes. There will be a meeting of the Tompkins County Municipal Officials, but no date has been set yet. Justice Milton Todd made the motion that Roy Decker be appointed to serve as custodian of the voting machine for the town of Danby and will be paid $50.00 each time he works. Fred Thayer will be paid $65.00 each time he works. Councilman Robert Snedden seconded the motion which was carried by a vote of five ayes and no noes. General Fund Warrant #9 in the amount of $234.91 was approved to be paid. The motion was made by Justice Milton Todd and seconded by Councilperson Dorothy Roberts and carried by a vote of five ayes and no noes. Highway Fund Warrant 09 in the amount of $11,316.13 was approved to be paid. The motion was made by Councilman Ralph Wilbur and seconded by Councilman Robert Snedden and carried by a vote of five ayes and no noes. West Danby Water District Warrant #9 in the amount of $35.36 was approved to be paid. The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes. Councilman Ralph Wilbur made the motion to approve the Supervisor's reports as submitted. The motion was seconded by Justice Milton Todd and carried by a vote of four ayes and no noes. The proposal for an ordinance to make it mandatory to have a permit for gatherings of over 1000 people in the Town of Danby was discussed at length.
