TOWN BOARD MEETING MINUTES
August 13 , 1979
The regular meeting of the Danby Town Board was called to order at
the Danby Town Hall , 1830 Danby Road , Town of Danby , County of
Tompkins and State of New York on August 13 , 1979 at 8 : 00 P . M .
Board members present : Supervisor A . Francis Wright

The motion was made by Councilperson Dorothy Roberts to approve the
minutes of the July 9 , 1979 meeting of the Danby Town Board . The
motion was seconded by Councilman Robert Snedden and carried by a
vote of four ayes and no noes .
COMMUNICATIONS :
1 . A letter from the New York State Rural Water Association
concerning the possible need for extra workers in the
West Danby Water District and the availability of CETA
personnel .
2 . A letter from the American Television & Communications
Corporation enclosing franchise fee .
3 . A letter from Moses Peter requesting the proper procedure
to follow to get a special permit .
4 . A letter from the Tompkins County Board of Representatives
concerning the county - wide youth board .
S . Agendas .. of the Tompkins County Board of Representatives
July 9 , 1979 and August 13 , 1979 meetings .
• 6 . A letter from the Association of Towns of the State of New
York concerning seminars on the rising energy costs .
7 . Minutes of the meeting of the Town of Danby Planning Board

PRIVILEGE OF THE FLOOR :
Supervisor A . Francis Wright noted that Chuck Bruce has applied for
a permit to build a pole barn and the permit has been issued .
Rick Dobson said that he has received the letter from the town
written to him on the advise of the town attorney outlining what
he must do in order for the Town Board to consider issuing a permit
for his concert . Supervisor Wright said that when the board receives

Privilege of the Floor Continued :
Riek Dobson ' s application they will have an answer for him within
four days . Rick Dobson said that he cannot put up a $ 1 , 000 , 000
bond to protect the town as the concert will not make enough
money to pay for it .
Jonny Sill asked if the town would do some work with the dozer at
the West Danby Park site to get it in shape to be seeded and
made ready for use next year .
Donald Wright commented on the concert . He said we don ' t want
another Watkins Glen here in Danby .
Frank Haskins said that Rick Dobson ' s Woodside II concert is not •
wanted in this town .
Dean Westmiller brought to the attention of the board that the
highway employees ' contract with the town needs to be negotiated
this year .
Edward Roberts stated that the town needs a new town attorney so
that we can get advise when we need it .
John Myers stated that he has gotten the signatures of 37 Danby
property owners who agree that zoning is needed . He then asked
the status of the Maycumber case that has been in litigation for
such a long time .
Susan and Charlotte Hautala spoke against Rick Dobson ' s proposed
concert .
Pat Longaker stated that zoning is needed inr: the Town of Danby
but something less complicated than the proposed ordinance that
the planning board has come up with and one that is enforceable .
Rick Dobson stated that he feels zoning is needed in the town but
the rules should be less rigid . He then stated that there will
probably be 3000 or less people attending his planned concert .
There will be plenty of police protection . If the town doesn ' t
want the concert/ he says he will no have it The matter was
discussed at len th . Council ersono rodeo its any

assembly of over 500 people in the Town of Danby be .; required
to obtain a permit from the Town Board . This was discussed and
the motion dropped as there was no second to :themotion .
Supervisor A . Francis Wright introduced Assemblyman Sam MacNeil
who was chairman of the Tompkins County Board of Representatives
before he was elected to his present office . Mr . MacNeil asked
the people how they would like to see cassino gambling handled
in New York State . Should the state run it , orf hould they hire
it done . He then talked about what is happening at state level .
He was asked about the closing of the gravel bank in Danby by the
DEC . This was discussed .
Jimmie Miller reported on the Tompkins County Board of Representatives
meeting . He said that their were 40 resolutions to be considered
at today ' s meeting . The board voted to have the TC3 budget stay the
same as last year . Boardman house has been taken back by the County .

COMMITTEE REPORTS :
Highway report - Councilman Ralph Wilbur reported that West Jersey
Road has been finished . Brown Road has been stoned and oiled . The
possibility of trading some road with the county was mentioned and
discussed . The paving of z mile of Gunderman Road instead of 2 mile
of East Miller Road was discussed . The motion was made by Council -
man Ralph Wilbur that specs for a new pick - up truck be presented
at the September meeting of the board . Councilman • . Robert Snedden
seconded the motion which was carried by a vote of five ayes and
® no noes .
Insurance - All in order . An insurance meeting will be scheduuled
soon .
West Danby Water District - Nothing to report .
Refuse Collection and Disposal - Nothing to report .
Youth - There was no July meeting of the Community Council . Jonny
Sill is now chairman of the West Danby Park Committee and is work -
ing on the park at the present time .
Zoning and Planning - No one has been found to fill the vacancy on
the planning board .
Fire - Councilman Ralph Wilbur reported that the new water tank
pumper truck for the West Danby Fire department was approved for
purchase by a vote of 76 to 27 .
Cemeteries - Councilperson Dorothy Roberts reported that after
investigating the vandalism in a : West Danby Cemetery Sloe- . . . .; ,,dg
there is nothing the town can do as the cemetery is not abandoned
but covered by a cemetery association . The Sheriff ' s department
will look into this matter .
OLD BUSINESS :
Highway Superintendent - Nothing to add to the report already given .
Appeals Board Chairman - Absent . Minutes of the last hearing were
read .
® Planning Board Chairman La Absent . Minutes of the last meeting
w ere read .
Zoning Officer - Van Billings reported that three building permits
were issued in July .
The following names were submitted by the Town Clerk for Democratic
election inspectors for consideration by the board . District I :
Beverly Dawson , Eugene Nesbitt and Evelyn Isenberg . District II :
Irene Cortright , Frances Jackson , and Alternate Jean Nowack . There
is no alternate for district I . Councilperson Dorothy Roberts made
the motion that these people be approved for appointment to serve
a one year term from July 15 , 1979 until July 14 , 1980 . The motion
w as seconded by Councilman Robert Snedden and carried by a vote of
four ayes and no noes . Roy Decker ' s name was submitted as a
prospective custodian for the voting machines . The matter was
discussed . It was decided that the salary of the custodian of the
✓ oting machine be looked into before the appointment is made .

Old Business Continued :
West Danby Recreation Program - Jonny Sill reported that a dozer
is needed to get the park area leveled off and seeded this year
so that by next spring it can be used . The town is no longer
willing to provide a dozer and Rick Dobson has sold his dozer .
The matter was discussed at length .
NEW BUSINESS ' :
The matter of bus trips taken by the Danby Senior Citizens funded •
by Danby Revenue Sharing funds was discussed . The insurance
coverage is taken care of . Councilperson Dorothy Roberts moved
a resolution that the Danby Senior Citizens be allowed to invite •
people from outside the town to join them on their trips funded
by the town if these people pay their own way and with the stip -
ulation that Danby people have first priority . The motion was
seconded by Councilman Robert Snedden .
RESOLUTION # 18 DANBY SENIOR CITIZENS TAKING BUS TRIPS
PAID FOR OUT OF DANBY REVENUE SHARING
FUNDS BE ALLOWED TO INVITE PEOPLE OUT -
SIDE THE TOWN OF DANBY TO GO ALONG IF
THESE PEOPLE PAY THEIR OWN WAY AND WITH
THE STIPULATION THAT DANBY PEOPLE HAVE
FIRST PRIORITY .
Roll Call Vote : Wright - aye

Carried by a vote of four ayes and no noes .
Moses Peter ' s letter to the board was read again . After discussion
by the board , Councilman Ralph Wilbur made the motion that a letter
be written to Mr . Peter requesting that he present his plans to the
Planning Board who will then make their recommendations to the Town
Board . This is the procedures' outlined in the Danby Zoning Ordinance .
The motion was seconded by Councilperson Dorothy Roberts and carried
by a vote' of four ayes and no noes .
Councilman Robert Snedden said that he would be unable to get time
off from work to attend the September energy seminar . After
discussion by the board , Councilman Ralph Wilbur made the motion
that Highway Superintendent Roy Hornbrook be authorized to attend
the energy seminar to be held in Monticello the 10th , 11th and 12th
of September . His expenses to be paid by the town . The motion was
seconded by Councilman Robert Snedden and carried by a vote of four
ayes and no noes .
The payment of one - half the bill for window coverings for the town
hall meeting room when the draperies are installed and the balance
when the work has been completed was discussed . Councilman Ralph
Wilbur made the motion to pay Gwen Cukierski one - half of her bill
when the draperies are installed . The motion was seconded by
Councilperson Dorothy Roberts and carried by a vote of four ayes and
no noes .
Councilman Ralph Wilbur made the motion that someone be found to fill
the job of dog enumerator and the appointment made at the September
meeting . Dog control was discussed .

New Business Continued :
A committee was appointed to negotiate wage increases for the highway
employees for 1980 . Councilman Robert Snedden was appointed chairman
of the committee . Councilman Ralph Wilbur will work with him . The
matter was discussed . The committee and the highway people will meet
September 5 , 1979 at 8 : 00 P . M . at the Danby Town Barns .
After a lengthy discussion of the posibility of passing a resolution
requiring a permit for assemblies of over 500 people4as introduced
• by Dorothy Roberts , the board decided to meet with the town attorney
to discuss this at some future date .
4 A meeting concerning T . V . cable in the West Danby area has been held
and some progress was made .
General Fund Warrant #8 in the amount of $ 225 . 80 was approved to be
paid . The motion was made by Councilman Robert Snedden and seconded
by Councilperson Dorothy Roberts and carried by a vote of four ayes
and no noes .
Highway Fund Warrant #8 in the amount of $ 10 , 817 . 84 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and seconded
by Councilman Robert Snedden and carried by a vote of four ayes and
no noes .
West Danby Water District Warrant # 8 in the amount of $ 164 . 13 was
approved to be paid . The motion was made by Councilman Ralph Wilbur
and seconded by councilperson Dorothy Roberts and carried by a vote
of four ayes and no noes .
Councilman Ralph Wilbur made the motion to approve the Supervisor ' s
reports as submitted . The motion was seconded by Councilman Robert
Snedden and carried by a vote of three ayes and no noes .
The motion to adjourn the meeting was made by Councilman Ralph Wilbur
at 10 : 45 P . M . as there was no further business to be brought before
the board . The motion was seconded by Councilperson Dorothy Roberts
and carried by a vote of four ayes and no noes .
