The meeting was held at the Ulysses Town Hall at 10 Elm Street, Trumansburg. Notice of Town Board meetings are posted on the town's website and clerk's board. ATTENDANCE: PRESENT: Supervisor- Liz Thomas Board members- Michael Boggs, Rich Goldman, John Hertzler 2nd Deputy Supervisor- Michelle Wright Town Clerk- Carissa Parlato Highway Superintendent- Dave Reynolds Highway Department Staff- Bill Conroy, Chris Stevenson OTHERS PRESENT: John Cometti, Organizer, Teamsters 317 ABSENT: 1St Deputy Supervisor- Nancy Zahler CALL TO ORDER: Ms. Thomas called the meeting to order at 6:30 p.m. O & A WITH UNION REPRESENTATIVE JOHN COMMETTI Mr. Cometti gave an overview of what the Town Board can expect now that four highway staff have unionized. GENERAL BUSINESS: APPROVAL OF MEETING AGENDA RESOLUTION 2017-57: APPROVAL OF MEETING AGENDA BE IT RESOLVED that the Ulysses Town Board approve the agenda for February 28, 2017 with the change of removing the PILOT discussion from the agenda. Moved: Ms. Thomas Ms. Thomas aye Ms. Zahler absent Mr. Hertzler aye Mr. Boggs aye Mr. Goldman aye Vote: 4-0 Seconded: Mr. Hertzler Date Adopted: 2/28/17 PRIVILEGE OF THE FLOOR: (none) NYSEG TOWN BARN AND TOWN HALL ENERGY EFFICIENCY PROPOSAL Mr. Stevenson gave an overview of the proposal to upgrade lighting in the town barn, citing brightness and energy savings. RESOLUTION 2017---: NYSEG TOWN BARN AND TOWN HALL ENERGY EFFICIENCY PROPOSAL WHEREAS NYSEG has a Small Business Energy Efficiency Program that offers to save the Town of Ulysses money by replacing the existing lights in both the Town Hall and Town Barn with high efficiency fixtures and bulbs. Therefore Be It RESOLVED that the Ulysses Town Board authorizes the Town Supervisor to enter into a contract with the NYSEG Energy Saver Program as proposed by Martin Grozier dated 2/10/2017 to improve the efficiency of the lighting in both the Town Hall for a cost to the town of an estimated $3,401.98 and Town Barn for an estimated $5,531.02 for a total estimated savings over 5 years of $25,625. Moved: Ms. Thomas Seconded: Mr. Goldman Mr. Boggs would like 2 other bids for the project and more information gathered on the safety of LED lights before making a final decision. UNIONIZATION OF HIGHWAY DEPT. On January 25, 2017, the Town of Ulysses recognized Teamsters Local 317 as the representative for the Highway Department employees for the classifications of Deputy Highway Superintendent, Motor Equipment Operator, Mechanic and Laborer. GENERAL UPDATES: 2 Ms. Thomas shared information on the Governor's decree that counties come up with a plan to cut spending and share services by Aug. 31. This was the topic of discussion at the recent Tompkins County Council of Governments (TCCOG) meeting that she attended. OLD BUSINESS: CONTRACTING WITH A MUNICIPAL FINANCIAL ADVISOR FOR FINANCING ASSOCIATED WITH TTHM REMEDIATION IN WATER DISTRICT #3 RESOLUTION 2017---: CONTRACTING WITH A MUNICIPAL FINANCIAL ADVISOR FOR FINANCING ASSOCIATED WITH TTHM REMEDIATION IN WATER DISTRICT #3 WHEREAS the Town of Ulysses requested proposals for municipal financial consulting services from four firms specializing in this type of financing to assist with funding needed to assure Water District 3 water quality meets EPA standards for chlorination by-products; and WHEREAS the RFP was mailed on January 12, 2017; and WHEREAS two proposals were received, Therefore, Be It RESOLVED that based on price and recommendations, the Town of Ulysses Town Board authorizes the Town Supervisor to enter into a contract with Municipal Solutions, Inc. for the purposes of assisting with municipal funding needs for Water District 3 remediation of chlorination by-products as required by the Tompkins County Department of Health and the United States Environmental Protection Agency. AUTHORIZING THE TOWN SUPERVISOR TO ACCEPT GRANT FUNDS FROM THE NEW YORK STATE OFFICE OF PARKS, RECREATION AND HISTORIC PRESERVATION RESOLUTION 2017-58: AUTHORIZING THE TOWN SUPERVISOR TO ACCEPT GRANT FUNDS FROM THE NEW YORK STATE OFFICE OF PARKS, RECREATION AND HISTORIC PRESERVATION 3 BE IT RESOLVED that the Ulysses Town Board hereby directs and authorizes Town Supervisor Elizabeth Thomas to accept funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993, in an amount not to exceed $57,205, and enter into and execute a project agreement with the State for such financial assistance to the Town of Ulysses for the acquisition of the Salo Drive Preserve property and, if appropriate, a conservation easement/ preservation/public access covenant to the deed of the assisted property. Moved: Mr. Goldman Ms. Thomas aye Ms. Zahler absent Mr. Hertzler aye Mr. Boggs aye Mr. Goldman aye Vote: 4-0 Date Adopted: 2/28/17 Seconded: Mr. Hertzler ESTABLISHING CIVIL PENALTIES FOR VIOLATION OF ZONING LAWS AS AUTHORIZED IN 212-4 OF THE TOWN OF ULYSSES CODE RESOLUTION 2017-59: ESTABLISHING CIVIL PENALTIES FOR VIOLATION OF ZONING LAWS AS AUTHORIZED IN 212-4 OF THE TOWN OF ULYSSES CODE WHEREAS, the Town Board of the Town of Ulysses ("the Town Board") on December 17, 2013 adopted the Zoning Law of the Town of Ulysses by Local Law no. 3 of 2013, and amended certain provisions thereof by adoption of Local Law no. 2 of 2015; and WHEREAS, the Zoning Law is set forth in Chapter 212 of the Code of the Town of Ulysses ("the Code"); and WHEREAS, §212-4 of the Code addresses enforcement of the Zoning Law and penalties for offenses, and §212-4 E provides as follows: "Civil penalties. In addition to those penalties prescribed by state law, any person who violates any provision of this chapter shall be liable for a civil penalty in an amount determined by resolution of the Town Board for each day or part thereof during which such violation continues. The civil penalties provided by this subsection shall be recoverable in an action instituted in the name of this Town." NOW, THEREFORE, pursuant to the provisions of §212-4 E of the Code, be it RESOLVED that the amount of the civil penalties for violation of the Zoning Law shall be no less than $100 per day and no greater than $250 per day for each day or part thereof during which the violation continues. Moved: Mr. Hertzler Seconded: Mr. Boggs 91 Ms. Thomas aye Ms. Zahler absent Mr. Hertzler aye Mr. Boggs aye Mr. Goldman aye Vote: 4-0 Date Adopted: 2/28/17 NEW BUSINESS: REVIEW OF AG/RURAL ZONING DRAFT The board briefly discussed the Zoning Update draft dated 2/7/17 (which focused on agricultural districts) and decided to wait until comments have been received from other boards/committees before discussing it further. PRIVILEGE OF THE FLOOR: (none) MONTHLY BUSINESS APPROVAL OF MINUTES RESOLUTION 2017-60: APPROVAL OF MINUTES: 2/7 BE IT RESOLVED that the Ulysses Town Board approve the minutes of 2/7. Moved: Mr. Goldman Seconded: Mr. Boggs Ms. Thomas aye Ms. Zahler absent Mr. Hertzler aye Mr. Boggs aye Mr. Goldman aye Vote: 4-0 Date Adopted: 2/28/17 Mr. Boggs attended the Cayuga Lake Intermunicipal Organization (CLIO) meeting and reported that they are getting closer to updating their lake protection plan. He also reported that Newfield was working with Delaware River Solar on a PILOT and completed it through the IDA.
