SPECIAL BOARD MEETING MINUTES
June 11 , 1979
A special meeting of the Danby Town Board was called to order at
7 : 30 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby ,
Tompkins County and State of New York on June 11 , 1979 . The
purpose of the meeting was the opening of bids for the Danby Town
Hall window covering project .
Board members present : Supervisor A . Francis Wright

The clerk presented a ,copy of the proof of publication to the
supervisor which he read .
The clerk advised the board that the Cornucopia of Lansing had picked
up specifications for the window covering project and specificiations
were mailed to Kaye ' s Fabric Shop , Markham Interiors , Anne Odesso and
Ithaca Paint & Decorating , Inc . These peoplgtiWicated an interest
in the project . Only one bid was received ./from Gwen Cukierski who
drew up the specifications . The bid was opened and read by the
clerk .

made by the Ithaca Speech Clinic . The motion was seconded by Council -
man Robert Snedden and carried by a vote of five ayes and no noes .
As there was no other business to be brought before the board , the
meeting was declared adjourned at 8 : 00 P . M .

The regular meeting of the Danby Town Board was called to order at
the Danby Town Hall , 1830 Danby Road , Town of Danby , County of
Tompkins and State of New York on June 11 , 1979 at 8 : 00 P . M .

Justice Milton Todd made the motion to approve the minutes of the May
14 , 1979 meeting of the town board as presented . The motion was
seconded by Councilperson Dorothy Roberts and carried by a vote of
five ayes and no noes .
COMMUNICATIONS :
1 . Agendas of the Tompkins County Board of Representatives May
14th , May 28th and June 11th meetings .
2 . A letter from Thaler and Thaler concerning the Code of Ethics
and asking if the town had adopted such a code .
3 . A letter from Thaler and Thaler concerning the Jennings Pond
Permit .
PRIVILEGE OF THE FLOOR :
Rick Dobson asked if zoning maps will be available along with the
new zoning proposal . He was told that maps will be available June
20 , 1979 at the open meeting .
. Bill Shippos stated that nothing has been done about repairs to the
Station Road . He also wanted to know what is being done about cable
T . V . service in West Danby . Supervisor Wright stated that he is
waiting to hear from the committee in West Danby on the cable T . V .
situation . It is now up to the people in West Danby to say what they
want .
Frank Haskins stated that trees were cut on his property by the
town and left there . If he has to clean them up he will charge the
town for it .
Mr . Konchack , Jonny Sill , Bob Goodwin and Donald Wright were all
interested to know when Brown Road would be repaired .

Privilege of the Floor continued :
Ted Merritt represented Sanford Miller who has a zoning problem . He
built an addition to his home on Miller Road too close to the road
in violation of the zoning ordinance and also did not obtain a build -
ing permit . He now must go before the town justice for settlement
of this matter . Mr . Merritt stated that Mr . Miller tried to contact
the Zoning Officer to get a- permit to build but was unable to get
in touch with him . He submitted a petition signed by 204 residents
of the town stating that this addition was good looking and that •
they had no objections to it . They did not feel Mr . Miller should
be penalized for building without a permit and not in accordance with
the zoning ordinance . They felt the zoning ordinance was too restrict -
ive . The petition will be turned over to the Town Board . A discussion
followed concerning negative feelings about the Danby Aoning Ordinance .
Kenneth Merritt talked about problems with the zoning ordinance as
he sees it . He feels that trailers for low income families should
be allowed .
The Palmers supported the statements made by Mr . Merritt .
Dean L ' Amoreaux stated that he felt that zoning maps should be made
available before the public meeting is held on the proposed zoning
ordinance . Supervisor Wright responded that on June 20th, the date of
the meeting , the zoning maps will be available and it will be the first
time the board as well as the public has seen them .
Moses Peter stated that he endorsed what was said about zoning and
the Miller case . He is against the Zoning Ordinance as revised .
Many of the people present expressed dissatisfaction with the zoning
in Danby and were in sympathy with Mr . Miller . Some felt that there
should be zoning but it should not be so restrictive . Some complained
about the availability of the zoning officer .
Bill Farrell asked t.he_ peoples vane for a zoning ordinance .
Supervisor Wright stated that public informational meetings are
held so that people can make themselves familiar with the ordinance
and give them a chance to express there opinions . The Town Board
makes the final decision .
In the case of Sanford Miller, Supervisor Wright stated that the case
is in court and the Town Board can do nothing as long as it is in
court . A lengthy discussion followed the town justice having first
been excused . Councilman Robert Snedden made the motion that the
Town Board take no action but let the attorneyssget together and -
settle the matter . The motion was seconded by Councilman Ralph
Wilbur and carried by a vote of five ayes and no noes .
John Benjamin asked if no cable is available for West Danby why
have the rates for cable service in Danby been increased . It was
explained that the rate increase was inevitable with or without
cable service in West Danby . .
Bill Reed , representing the Danby Senior Citizens , asked that the
Senior Citizens be allowed to fill their buses for trips with out -
siders if it cannot be filled with Danby people . A fee would be
charged by the people not living in Danby . The bus is expensive and
should be filled to make it worth while .

Privilege of the Floor continued :
It was asked why Hubert Dorn is allowed to put a trailer on his
property even though ; he was denied a variance for a trailer and
why nothing is being done to have it removed . The answer was that
New York State Law allows trailers on private property . Mr . Dorn
is not in violation as long as the trailer is not lived in .
County Representative , Jimmie Miller , reminded people that June 12th
is grievance day in Danby . People with property tax problems should
attend . He said that the Sambo restaurant problem was discussed at
the County Representatives meeting and the county passed a resolution
recommending that the Sambo restaurant people change the name of
• the restaurant .
COMMITTEE REPORTS :
Highway - Councilman Ralph Wilbur reported that the bridge problem at
the Ithaca Speech Clinic has been resolved to the satisfaction of the
board . He stated that Roy has attended school at Cornell and found
it very helpful . The brin for dust control is temporarily unavailable .
The pond has dried up , but the problem should be resolved in a month
or so . There may be a substitute for the brin . The complaints about
Brown Road will be taken to the Highway Superintendent .
Insurance - Everything is covered . Councilman Ralph Wilbur said that
as far as health insurance is concerned the town possibly could switch
to a contributory type policy .
West Danby Water District - Everything in order .
Refuse Collection and Disposal - Nothing to report .
Youth - Councilman Robert Snedden reported that a new chairman and
a new committee is needed for the West Danby Park Project . There is
a problem of life guards at the pond . The committee has found no
work study people or CETA people .
Zoning and Planning - No report .
Fire - The firemen did a good job at the recent fire West Danby fire .
The rescue squad is being kept busy .
Cemetaries - Flags were put on the veterans graves by Mr . Griffin ' s
® boy scout troop , in Danby and in West Danby , by Donald Wright .
Justice Milton Todd moved a resolution of thanks to the boy scouts
and Mr . Wright for putting the flags on the veterans graves . The
motion was seconded by Councilman Robert Snedden and carried by a
vote of five ayes and no noes .

OLD BUSINESS :
Report of the Highway Superintendent - Absent , no report .
Appeals Board Chairman - Edward Roberts Vice chairman reported that
no appeals are before the board at this time .
As it was noted that Edward Robert's term of office as a member of
the Town of Danby Board of Zoning Appeals will end the end 'of
June . Justice Milton Todd made the motion that Mr . Roberts be
appointed to serve another five year term as a member of the
appeals board . The motion was seconed by Councilman Robert Snedden
and carried by a vote of five ayes and no noes .
It was also noted and discussed that someone will be needed to
serve as planning board chairman and also a member of the planning
will be needed .
Zoning Officer ' s report - A written report was submitted . He reported
that 3 building permits were issued in May and no violations sited .
Mr . Billings then reported on the seminar he attended at TC3 on the
energy conservation law .
Justice Milton Todd made the motion that Mr . Shippos and Mr . Haskins
be appointed to serve on the Cable TV committee in West Danby . The
motion was seconded by Chairman Ralph Wilbur and carried by a vote of
five ayes and no noes .
It was noted that a representative from Danby on the EMC board is
needed . The committee has a couple of prospects and is still looking .
The Town Clerk reported that the extension to the town highway phone
located in the town hall has been disconnected . It will cost $ 56 . 00
to have a jack installed for an extension from the town hall phone
to make a phone available for use in the meeting room . The matter
was discussed . Supervisor A . Francis Wright made the motion that
a jack be installed for an extension from the town hall phone
to the meeting room . The phone to be kept in the clerk ' s office .
The motion was seconded by Councilperson Dorothy Roberts and carried
by a vote of five ayes and no noes .
The Jennings Pond license agreement was discussed . Councilperson
Dorothy Roberts made the motion to authorize the Supervisor to
sign this agreement with the attorney ' s approval . The motion was
seconded by Justice Milton Todd and carried by a vote of five ayes
and no noes .
The draperies for the Town Hall Window covering project were discussed .
It was decided that as far as color is concerned Councilperson
Dorothy Roberts and Town Clerk Mary Oltz look at the samples and
report to the Town Board by phone .
NEW BUSINESS :
The next order of business was the appointment of election inspect -
ors . The Chairman of the Republican Committee in the Town of Danby ,
Alberta Wilbur , submitted a list which was read by the clerk and is
as follows : District I : Rhoda Larson , Donna Smith and Charlotte
Hautala . District II : Merriam Crance , Dora Huson and Alternate Mary
Casterline . District one still needs an alternate inspector . The
motion was made by Council >mans Ralph ' :Wilbur .that. the names submitted

New Business continued :
for Republican be approved and these people appointed to serve a one
year term . The motion was seconded by Justice Milton Todd and carried
by a vote of five ayes and no noes . It was noted that no names have
been submitted by the Democratic Committee for Democratic inspectors .
After discussion Supervisor A . Francis Wright made the motion that
if the Board of Elections does not act on submitting a list of
Democrats to serve as election inspectors , the clerk will make
recommendations for appointments . and also for a voting machine
custodian . The motion was seconded by Councilman Robert Snedden and
carried by a vote of five ayes and no noes . Councilperson Dorothy
Roberts made the motion that the election inspectors be paid $ 3 . 10 per
. hour and each chairman be paid an additional $ 5 . 00 for each time they
serve . Councilman Ralph Wilbur seconded by motion which was carried
by a vote of five ayes and no noes .
After discussion , Councilman Ralph Wilbur made the motion that the
senior citizens be allowed to charge a fee to people living outside
the Town of Danby who go on their trips with them . These people will
be allowed to go only after all Danby Senior Citizens are polled and
the number taking the trip does not fill the bus . Councilperson
Dorothy Roberts seconded the motion which was carried by a vote of
five ayes and no noes .
General Fund Warrant #6 in the amount of $ 380 . 99 was approved to be
paid . The motion was made by Councilperson Dorothy Roberts and sec -
onded by Justice Milton Todd and carried by a vote of five ayes and
no noes .
Highway Fund Warrant #6 in the amount of $ 2 , 952 . 88 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and sec -
onded by Councilman Robert Snedden and carried by a vote of five ayes
and no noes .
West Danby Water District Warrant # 6 in the amount of $ 33 . 66 was.
approved to be paid . The motion was made by Justice Milton Todd
and seconded by Councilman Ralph Wilbur and carried by a vote of
five ayes and no noes .
Supervisor A . Francis Wright moved a resolution to transfer $ 2 , 000 . 00
from insurance on General Fund Warrant #5 to insurance on Highway
Fund Warrant #5 . The compensation insurance for the highway department
was included with the general insurance in error . The motion was
• seconded by Councilman Ralph Wilbur .

Dear Mary ;
The purpose of this letter is to inform the town board
of changes related to the translucent " thermal blanket " which
I have agreed to supply for the six windows in the town hall .
This material is to be supplied to me by Owens Corning Fiberglas
Corporation .
Owens Corning company policies had always dictated that
their products meet strict fire testing requirements . It had
previously been rated as a class B material as specified in my
bid . New policy developed this fall required additional testing
before company approval was granted for commercial applications . `I
These tests were completed and approval of the material is
expected shortly .
Material specifications have changed as follows :

Because of these developments I cannot complete the fabrication
and assembly of the " thermal blankets " before Dec . 31 , 1979 .
Therefore , I am requesting that the amount of $ 810 . 00 be allocated
in your 1980 budget for the purpose of completing this project .
Owens Corning will supply the translucent material free of cost
to you and will absorb inflationary increases resulting from
the delay . A more definite timetable will be established when
I receive a shipping date from them .
I am very sorry about this delay and hope that you will
agree to an extension of this innovative project .

Provide window coverings as described below for each of six 1
( 6 ) windows in the Danby Town Hall , Main Room , Route 96B , Danby ,
New York . See attached drawings .
Al . Provide 3 inch thick " thermal blanket " material distributed
by Owens Corning Fiberglas Corporation or equivalent .
Material shall be a polyester fibrous ; construction with a
continuous 5 ml vinyl vapor barrier on front and back sides
and shall have a transmissivity of at least f % and an
effective R value ( resistance to heat flow ) of at least 5 .
2 . Each " thermal blanket " panel described above shall be
supported by a framework made of wood or plastic which holds
it vertically within the window frame , as shown on the
attached drawing no . 1 , and shall have a continuous air
tight weatherstrip between the framework of the window
covering and the window jambs , head and sill .
3 . The framework described above shall be demountable from the
window for cleaning and panel storage when desired .
4 . Each thermal blanket panel shall be flameprodfed and flame
retardant with a flame spread rating less than 75 - class B .
5 . The finished size of each of the 12 panels ( 2 per window )
shall be measured to fit . The approximate size shall be
12 ' 0 " x 2 ' 0 " .
A second window covering for each window shall provide a sound
absorption coefficient of at least . 5 in the 500 - 2000 Hz range
with a # 7 type mounting ( material placed over a 16 - inch air space ) .
This shall be accomplished through one of the following treatments :

Enclosed are the bidding specifications for the insulative
as well acoustical window coverings for the Town Hall , main
room .
I have treated the windows with two separate coverings :
a thermal blanket made of the translucent material distributed by
Owens Corning Fiberglas Corporation , and second , a decorative
treatment with acoustical properties . Because of the need to
reinforce and maintain the historic architectural image of the
building , I have included a drapery as well as a thermal shutter
for the second covering . An attached drawing will allow the
board to decide between the two or I would suggest that the
board collect bids on both treatments and include price as a
criteria for selection .
It should be understood that the translucent blanket will
remain in place for the duration of the heating season , preventing
heat loss both during the day and night . The translucent quality
•
of the material allows some solar heat gain on the south
orientation during ' the day . Estimated effective R value ( resistance
to heat flow ) for 3 " of this material is 7 and should be adequate
in preventing heat loss through the windows .
The thermal shutter , which is made of opague materials , provides
additional thermal protection if closed at night . It has excellent
acoustical properties , as well . Below is a chart comparing the
various materials specified ) :

Drapery :
Bl . The drapery fabric shall be a heavy velour , at least 18 oz: .
per yard , draped to half area (1000. fullness ) . Color on
approval of board .
2 . The top of each drape shall have 3 ' 1 / 2 jute webbing with
rust proof brass grommets every 6 " on center . Side hems
shall be 4 " in width . The bottom hem shall be 6 " in width .
3 . Each drape shall be lined with Roc - lon cloth manufactured by
The Rose Line or equivalent . The lining shall have the same
fullness as the drape ( 100 % ) .
4 . All fabrics shall be flameproofed and flame retardant .
5 . The bidder shall supply material of the same velour as the
drapery to cover six cornices .
6 . The finished size of each panel shall be 4 ' 0 " wide by 14 ' 0 "
long . There will be 12 panels .
7 . Each cornice will be constructed from 1 / 2 " plywood . All
exposed surfaces shall be covered in same velour as draperies
and padded with cotton batting . Edges shall be finished with
decorative fabric tape , on approval of board . or representative .
8 . The bidder shall provide and install 6 adjustable traverse rods ,
manu . by Kirsch , Empire # 3125 with extendorod conversion kit
# 3512B or equivalent .
9 . Finished draperies , tracks , and cornices to be installed / t1

Cl . A rigid shutter shall be constructed of 1 " thick Owens
Corning Fiberglas 703 insulation board or equivalent with
1 / 8 " Owens Corning Fiberglas Glastrate or equivalent on each
side ( back and front ) .
2 . Each shutter panel shall be framed with a " u " shaped plastic
track , colored to match the decorative face material .
3 . Each shutter panel shall be faced with a decorative material ,
'7 on approval of the board or representative , and shall be
provided with four 3 " hinges for attachment to the casing
molding of each window , as shown on drawings 1 and 2 .
4 . The decorative face material shall be flameproofed and flame
retardant with a flame spread rating less than 75 - class B .
5 : Each shutter panel shall be installed in such a way to provide
an air tight seal between the shutter and the casing molding .
An additional 1 x 6 trim molding should be added where indicated
on drawing one , plan view .

The drapery installation shown in the drawing does not
provide significant added thermal protection . Its primary
function is acoustical control and appearance . Therefore , it
would not be necessary to close the drapery ( orl: the shutter )
at night . However , the shutter , if closed , will provide
additional thermal protection as well as acoustical control .
Please contact me if you have any additional questions .
I have also rewritten the previous drapery specifications so
that , to the best of my knowledge , they are accurate yet
easier to fullfill .
Also enclosed is an invoice for my services . I look
forward to bidding on the specifications when they are issued .
I would also remind you that the translucent material will be
supplied at no cost by Owens Corning . No warranties or guarantees
are offered on the material at this time :* Also , my estimated
construction time of Sept . 1st is still possible .
