The Landmarks Commission, though unable to certify the sign's qualification for historic status , due to lack of documentation of a pre-1950 date, nonetheless urges favorable consideration of a variance on the basis of the sign's construction and simple design. PLANNING & DEVELOPMENT NOTICE OF MEETING, p. 2 APPEAL 1331 : Area Variances to permit continued use of premises at 801 E. State Street (owner Charles Fritschler) in an R-3a zone, as a multiple dwelling. Structure was converted by previous owner in violation of codes, and previous appeal was denied Mr. Fritschler in August. Appellant now proposes to construct required off-street parking, but other facts of the appeal are not changed: the lot, front and side yards are undersized, and use would be for one four-bedroom and one six-bedroom cooperative unit. Due to some confusion in the record of this case, appellant has been requested to reappear, and has obtained design assistance for the proposed work. APPEAL 1333: Area Variance to permit use of house at 316 Third St. , in an R-3b zone, as a two-family residence. House is too close to front property line, but otherwise conforms . APPEAL 1334; Use and Area Variances to permit use of small portion of premises owned by Cornell Radio Guild at 227-31 Linden Ave. , in an R-3b zone, as retail goods storage. The structure and its current uses are legally nonconforming, but each new use is required to be considered for a separate variance. APPEAL 1335: Area variances to permit use of the house at 207 E. Court St. , in a B-la zone, as legal offices. The site is undersized, lacks required off- street parking, and the house is too close to lot lines . APPEAL 1336: Area Variances to permit occupancy of house at 201 S. Aurora St. , in an R-3b zone, by five unrelated persons . The property lacks off-street parking and is deficient in front and rear yard depths , due partly to its corner location. Old Business : a. Route 96: NYS DoT proposes to do further design work on three of the five alternative routes approved by the City last year, if given the approval to proceed by Council . DoT 's current position is that due to escalating costs, it will only be possible to build a two-lane grade-level bridge and road with current funding, adding two more lanes and another bridge (possibly grade separated) if funding and need exist in 1995. They have asked whether the City will accept this staging. A Board recommendation to Council may be in order. b. Any other 8. SIGN APPEAL 10-4-80: Variance under Sections 34.46 (projecting signs) and 34.5B (size regulations in a residential zone) to permit retention of non-conforming signs at 402 West Court Street (Jake's Red & White) in an R-2b district. The signs exceed in number and area the maximums for a residential zone. SIGN APPEAL 11-1-80: Variance under Section 34.6A (size and total number of signs) to permit retention of existing Ithaca Cayuga Optical signs at 134 East State Street in a B-3 district. APPEAL 1321: Appeal of Orson .Ledger for an Area Variance under Section 30.25, Columns 4 , -10, 12, 13 and 14 (off- street parking, maximum lot coverage, side yards , and rear yard)_ to permit the addition of eleven efficiency apartments .to the building at 318-322 West State Street , in a B-2a J business) district . Tioga St. Zoning - status and discussion. Common Council is expected to lay one or more alternatives on the table in September, for action at its October meeting. Council has received the Board's July recommendation against any rezoning, but wishes to continue consideration of Alternatives B (rezoning only properties fronting on N. Tioga St. between Court St. and Cascadilla Ave. ) and C (a new or special zone which would permit limited non-residential uses; draft specifications for this alternative will be presented) . Further Board input to Council will be sought, Radio Tower Zoning Amendments discussion of draft provisions and recommenda- tion to Council . Sage Infirmary and Sheldon Court Conversions - status and discussion. Cornell has applied to the U.S. Dept, of Education for funding assistance for these projects, which would provide 150 undergraduate beds in Sheldon Court and 150 graduate beds in Sage Infirmary. 6. The broad outlines of two additional general alternatives have been drawn for discussion: one would involve a special new zone, permitting as of right uses compatible with residential uses, subject to certain limits to minimize effects on the existing character of the area; the other would establish special condition/special permit controls to apply on a case-by-case basis , also with built-in controls to limit impacts.
