ZONING CASES: APPEAL 1273 (deferred fromm�August and September meetings)rc Use variance from Section 30.25, Column 3 (accessory uses) and an Area variance from Section 30.376 (parking areas in residential districts) to permit use of property at 159-165 Crescent Place for a neighborhood parking lot. The property is located in an R-2b .residential ) use district in which a ( neighborhood parking lot is not a permitted use, and the appellants also are requesting relief from the development requirements of the Ordinance for neighborhood parking lots. As of the date of preparation of this agenda, staff has met with appellants and discussed the issue with Engineer- ing staff, and is awaiting appellants' decision on how to proceed., APPEAL 1285: Area variance under Section 30.25, Column 11 (minimum front yard) to permit construction of a carport in the front yard of property at 574 Spencer Road. The property is in an R-2a (residential ) use district and would be deficient in required front yard. APPEAL 1286: Special Permit under Sections 30.25, Column 3 and 30.26-C .3 to permit operation of a small shop for the purpose of selling games and miniature figurines as a home occupation at 113 Utica Street. The property is located in an R-2b (residential ) use district in which a special permit is required for a home occupation, RECONSIDERATION OF APPEAL 1269: Appeal for a use variance under Section 30.25, Column 2 (perm tted' p'rimary uses) to permit the use of the property at 1023-1025 N. Tioga Street for professional offices and residential use. The property isocated in an R-2b (residential ) use district in which professional offices are not a permitted use. Appellants are providing additional information in support of their appeal . SIGN APPEAL 11-1-79: Variance under Section 34.4B (Projecting Signs)- of the Sign Ordinance to permit the retention of the existing Victory Liquor Store sign at 303 Taughannock Blvd. The property is in an M-1 (Marine) use district. Urban Design and Preservation: Report oh' ,plann ing issues related to the designation.of. a-portion of -the Quadrangle of the NYS -College of Agriculture and Life Sciences as a City Historic District. (Committee recommendation and Board action to be considered under New,.Business.-) b. Codes and Ordinances: Report on possible improvements to the public notification system for zoning appeal's. Comments, complaints and . observations from various officials and the .general public indicate increasing need for adequate notice and descri°ption of appeals so that persons potentially affected by a variance may be better informed of the facts of the appeal and of their opportunities to comment thereon for the record. (Action under New Business. ) 8. Old Business: a. Rte. 13 update: The long search for consensus has reached a juncture at which comment on how the city may be affected by proposed improvements to the road to Cortland appears to be in order. In particular, the alternatives currently being advocated appear to have potential indirect impacts on the East Hill area. b. Rte. 96 update: NYSDoT is currently reviewing costs associated with the project, to determine whether the project budget is adequate. Of con- cern to them are the added costs of converting Meadow and Fulton to a one-,way pair, and accomplishing the environmental impact evaluations for all five alternatives on the area east of Meadow. c. Emergency access to West Hill : Some potential is developing for the installation of preemptive railroad crossing signals in conjunction with . other crossing improvements. d. Landmarks Commission staff position: The position has been advertised, and the selection committee hopes to be able to make a decision by November 30th. 9. New Business: a. Spencer Road: Council has asked the Planning and Engineering staff to make recommendations by November 7 on closing Spencer Road to through traffic, as a result of residents' complaints. b. APPEAL 1277; Area variance under Section 30°26-B to permit a group care home at 618-620 N. Aurora Street. The property is Located in an R72b (residential ) use district and is deficient in both side yards, APPEAL 1278, Area variance under Section 30,25, Column 12 to permit construction of an addition to the present Ridley Printing structure at 317 Taughannock Blvd, The property is located in an M-1 (marine) use district, and' an existing structure is within the required side yard. ZONING CASES: 5-1-79: Appeal to §34.6A of the Sign ordinance to permit erection of a business sign on the east side wall of 407 W. Seneca, in a B-2 zone, to permit better visibility of sign by one-way traffic. The ordinance prohibits signs on other than street frontage. APPEAL 1252: Appeal for area variance to permit addition to restaurant space at 319 Taughannock Blvd. , in an M-1 zone. Appeal deferred from March meeting. Property is deficient in side yards and off,-street parking. APPEAL 1257: Appeal for interpretation and -'area variances to permit construction of a four to six--story commercial building at 202 E. Buffalo Street, in a B-1 zone, Interpretation is requested to determine whether the required parking space would not be provided by the city's Seneca Street parking structure. The Board is asked to make a recommendation to Council as to whether all or part of the area designated by the ILPC, as shown on the maps distributed last month, should be added to the official landmark district. 9. New Business: Town of Ithaca's subdivision: The Department has been asked to evaluate a proposed six-lot subdivision adjacent to the city, in the Town of Eastwood Avenue extended, to determine its capatibility with city subdivision regulations. The owner has been denied city water service for the proposed subdivision, partly on the basis that it fails to meet city subdivision standards. Staff will report on its findings. 10. The proposed building would result in deficiencies in required off-street loading, side and rear yards, and maximum permitted lot coverage would be exceeded. The site, located in a B-2 district, is presently occupied by a fire-damaged building, and is deficient to some degree in all of the categories listed above. Previous appeals on this project were denied; appellants are requesting reconsideration of their proposal based on the provision of some additional off-street parking, though some deficiency would remain. SIGN APPEAL 2-1-79: Sign Variance to place a second sign on the property at 740C Cascadilla Street in a I-1 district. BUSINESS AREA ZONING: Discussion of alternatives available for resolution of problems in the area adjacent to the CBD. Development pressures and goals, private and public, are increasingly coming into conflict with legislative and physical constraints in this area. Part of the solution seems to lie in the direction of zoning ordinance revision - new districts, regulations and procedures which offer the potential of innovative and flexible responses to development and growth initiatives have been discussed with staff and other interested parties The problems and some alternative solutions will be outlined, and the Board's recommendation as to the most appropriate plan of approach will be sought. 10. MISCELLANEOUS: a. Board Administrative Organization Due to the volume and priority of zoning appeals generated in recent years, a great deal of the Board's time at meetings is consumed before other business is addressed. Possibilities for ameliorating this situation, to free the Board's energies for consideration of broader and frequently more vital planning issues, include holding separate meetings for zoning recommendations or charging a committee with appeal review for Board action.
