SPECIAL BOARD MEETING MINUTES
February 12 , 1979
A special meeting of the Danby Town Board was called to order at
7 : 30 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby ,
Tompkins County and State of New York on February 12 , 1979 . The
purpose of the meeting was to open bids for draperies for the
meeting room in the town hall .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
• Councilman Robert Snedden
Justice Milton Todd
• Board member absent : Councilman Dorothy Roberts
Others present : Justice Paul Smith , Edward Slights , Rick Dobson and
Roy Hornbrook .
The clerk furnished the supervisor with a copy of the proof of
publication . This was read .
As no bids were received the meeting was adjourned .

The regular meeting of the Danby Town Board was called to order at
the Danby Town Hall , 1830 Danby Road , Town of Danby , County of
Tompkins and State of New York on February 12 , 1979 , at 8 : 00 P . M .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Dorothy Roberts
Councilman Robert Snedden
Justice Milton Todd
Others present : Justice Paul Smith , Edward Slights , Rick Dobson ,
Roy Hornbrook , Frank Haskins , Roy Casterline , Bill Shippos , Moses
Peter , Gordon Roberts , Ted Merritt , Donald Wright , Van Billings ,
Jimmie Miller , Alberta Wilbur .
The minutes of the January 8 , 1979 meeting of the town board were
approved as presented .
COMMUNICATIONS :
1 . Justice Milton Todd presented his annual report for 1978
court cases .
2 . Minutes of the meeting of the West Danby Water Commissioners
held February 7 , 1979 .
I/. 3 . A letter from Congressman Matthew McHugh concerning CAB
hearings .
4 . A letter notifying the town of training sessions in " Risk
Management for Small Local Governments " to be held at
Cornell University .
5 . A copy of a letter sent to Justice Paul Smith from Moses
Peter .
6 . A copy of a letter sent to Moses Peter from Justice Paul
Smith .
7 . A letter of apology from the United Christian Youth Group
concerning the broken window in the Town Hall and a promise
to repair the window .
8 . A copy of a letter sent to Mr . Paul Hutchings from the West
Danby Water Commissioners concerning a water break in Mr .
Hutchings basement .
9 . A letter from the Tompkins County Department of Health
concerning the annual inspection of the West Danby Water

PRIVILEGE OF THE FLOOR :
The clerk noted that the lease fee on property that the town leases
for the West Danby Park from Leon Drake has not been paid . The
matter was referred to the youth committee . Mr . Drake will be
n otified that this matter is being looked into .
Mr . Shippos asked how much longer it will be before West Danby
w ill get the TV cable . He also asked that the town board put
pressure on the TV people to get this done .
Moses Peter discussed the case being heard in town justice court
in which he was not allowed to serve as counsel for a friend . He •
w as unhappy with the way Justice Paul Smith handled the matter and
w anted the town board to know his feelings .
Rick Dobson asked about a letter from the town board that states that
he is in compliance with the laws of the town to submit to the state
in order to get a "Vehicle Dismantlers " permit . Without the permit
he can be fined . He also ask what action the planning board is
taking to rezone property in Danby . He is not happy with the changes
t hat have been made that affect his property .
Justice Paul Smith stated that he has answered the letter from Mr .
Peter and that the trial in the court case mentioned will be held
February 20 , 1979 . He also stated that he has his books available
for audit by the town board .
COMMITTEE REPORTS :
Highway - The old FWD has been repaired and is now in service . People
in West Danby seem to be happy with the way Station Road is being
maintained . The water cooler is working well . Bruce Hill Road has
been closed due to its icy condition . The cinders are running short
and salt is being rationed .
West Danby Water District - Roy Casterline brought to the attention
of the town board the fact that the fire commissioners have not
paid rent on the fire hydrants in the West Danby Water District .
This rent is past due .
Insurance - The increase in the fees forthe health insurance that
t he town carries on the highway employees was discussed . Possibly
t here is a need to shop around for a more economical policy .
Refuse Collection and Disposal - No report .
Youth - Nothing •

Zoning and Planning - There is a new section of the Vehicle Law
t hat states that a " Vehicle Dismantler " needs a letter from the
t own stating that his operation is in compliance with the laws of
t he town in order to get a permit from the state . Rick Dobson
needs such a letter . After discussion by the board it was decided
t hat the zoning officer should check Rick ' s operation to see if
t he screening complies with the town law before writing a letter .
Councilman Robert Snedden recommended that Wayne Rial be interviewed
by the town board as a candidate to fill the vacancy on the planning
board .

Committee Reports continued :
Fire - West Danby needs a new tank for their fire truck . A new tank
will cost approximately $ 15 , 000 . 00 . They have $ 7 , 000 . 00 in their
equipment fund . The additional amount needed will have to be raised .
This truck has been out of order for six weeks and something must be
done . Possibly a tank truck will be rented from another town . The
matter was discussed .
Cemetaries - Well covered .
OLD BUSINESS :
Highway Superintendant ' s report - Roy Hornbrook stated that a study
should be made in the near future of a new highway building to house
the town equipment that now sits outdoors all year round . He also
noted that he has had many complaints about the ruts in the roads
which is a real problem this year .
Appeals Board Chairman - Absent
Planning Board Chairman - Absent
Zoning Officer - Written report submitted .
Appointment of a zoning officer was discussed . A number of candidates
have been interviewed . Van Billings has been asked to serve as zoning
officer and George Arsenault , Jr . as assistant to the zoning officer .
Councilman Robert Snedden made the motion that Van Billings be appoint -
ed Zoning Officer for the Town of Danby and George Arsenault , Jr . be
appointed assistant zoning officer . Councilman Ralph Wilbur seconded
the motion which was carried by a vote of five ayes and no noes .
Mr . Billings was introduced . An office for the zoning officer was
discussed .
It was noted that no bids were received for draperies for the town
hall meeting room .
The safe at the fire house that belongs to the town was discussed .
Possibly it is something that can be stored in the highway barns .
Ralph Wilbur made the motion that the highway department move the
safe to the town barns . The motion was seconded by Justice Milton
Todd and carried by a vote of five ayes and no noes . The materials
in the old town vault were discussed . This matter will be put on
the agenda for next months meeting .
The risk conference meeting at Cornell University was discussed . It
will be held Saturday mornings ( February 24th , March 24th and April
21st . ) . Justice Milton Todd and Supervisor Wright will try to attend .
NEW BUSINESS :
The town board had a request to investigate the cost of a direct fire
alarm system for the town hall and the town barns to the fire station .
This was done and the cost was found to be $ 4 , 240 . 42 plus a monthly
phone bill . This installation would give insurance savings of about
$ 30 . 00 per year for the town hall and the town barns combined . It
was decided after discussion that this would be much to costly for
the benefit realized .

New Business continued :
Representative Jimmie Miller reported that the County Board of
Representatives is just getting their committees set up for the
year . He stated that he would try to answer questions .
It was noted that a new Republican Committee Chairman has been
appointed . The new chairman is Jim Raye .
Jonny Sill has been recommended to serve as one of the water
commissioners by the West Danby Board of Water Commissioners . He '
will replace Roland Neefe and will serve a five year term . Justice
Milton Todd made the motion that Mr . Sill be appointed to the
board of water commissioners . The motion was seconded by Council -
man Ralph Wilbur and carried by a vote of five ayes and no noes .
General Fund Warrant # 2 in the amount of $ 1 , 081 . 37 was approved to
be paid . The motion was made by Justice Milton Todd and seconded by
Councilman Ralph Wilbur and carried by a vote of five ayes and no noes .
Highway Fund Warrant # 2 in the amount of $ 9 , 752 . 43 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and seconded
by Justice Milton Todd and carried by a vote of five ayes and no noes .
West Danby Water District Warrant # 2 • in the amount of $ 45 . 85 was
approved to be paid . The motion was made by Supervisor A . Francis
Wright and seconded by Justice Milton Todd and carried by a vote
of five ayes and no noes .
The supervisor reported that his annual report has been completed
and filed .
The clerk was asked to contact Bob Myers and the party in Syracuse
that were sent specifications for draperies for the town hall and
ask if there was some problem with the specifications as they did
not submit a bid .
A . Francis Wright reported on ambulance service for the Town of
Danby . The Tompkins County Board of Representatives took over the
problem and subsequently passed a resolution that service be given
at no charge to the taxpayers put the users of the service in the
county be charged $ 55 . 00 per call . This will be reviewed in one
year .
The motion to approve the Supervisor ' s reports was made by Council -
man Ralph Wilbur and seconded by Justice Milton Todd and carried by
a vote of four ayes and no noes .
As there was no further business to come before the board , Council -
man Ralph Wilbur made the motion to adjourn the meeting . The
motion was seconded by Justice Milton Todd and carried by a vote of
five ayes and no noes . The time was 10 : 00 P . M .
