Appeal of Paleontological Research Institution (PRI), aka the Museum of the Earth,requesting
variances from the Town of Ithaca Code, Chapter 270,Zoning, Section 252, Criteria applying to
signs in all zones and Section 254 Residential and Conservation Zones, to be allowed to place
signs (banners) on utility poles and also a sign on a building that exceeds the allowed square
footage and aggregate, as described across three parcels located at 1251, 1257 & 1259
Trumansburg Rd. Specific variances are described as follows:
1259 Trumansburg Rd—Variances from Section 270-252 A(2) to be allowed to have three signs
(banners) on utility poles, where none are permitted; Section 270-254 E(4)to have six banners—
three at 15 square feet in area and three at 8 square feet in area-that are located less than 500
feet from a public right-of-way; and Section 270-254 E(6)(b) to have an 800 square foot area
sign on the museum building, where a 100 square foot aggregate limit is allowed, with no one
sign larger than 50 square feet in area.
1257 Trumansburg Rd—Variances from Section 270-254 E(4) to be allowed to have two
banners, each 15 square feet in area, that are located less than 500 feet from a public right of
way; and Section 270-252 A(2) to allow these signs (banners) to be placed on utility poles,
where none are permitted.
1251 Trumansburg Rd—Variances from Section 270-254 E(4) to be allowed to have one sign
(banner), 15 square feet in area, that is located less than 500 feet from a public right-of-way; and
Section 270-252 A(2) to allow the sign (banner) on a utility pole, where none are permitted.
APPLICABLE CODE
§ 270-252. Criteria applying to signs in all zones.
A. Signs shall not:
Obstruct or impair vision or traffic.
Be attached to utility poles,bridges, or safety, traffic or street identification signs.
Be placed or painted on vehicles or trailers that are parked or located for the primary purpose
of displaying such signs.
§270-254.Residential and Conservation Zones.
D. Except as provided in Subsection E below, signs up to 16 square feet in area in the aggregate
on any one parcel are permitted. No one sign shall be larger than six square feet in area, except
as provided in Subsection E below.
E. Notwithstanding Subsection D above:
LLIn Multiple Residence Zones, signs up to 36 square feet in the aggregate on any one parcel
are permitted. No one sign shall be larger than 24 square feet in area.
(6) If the square footage of all principal buildings on a parcel exceeds 8,000 square feet:
(a) Signs up to 32 square feet in the aggregate are permitted, and no one sign shall be
larger than 24 square feet in area.
(b) In addition, signs up to 100 square feet in the aggregate on any one parcel are
permitted for signs that are located at least 500 feet from a public right-of-way; no one such sign
shall be larger than 50 square feet in area.
Banners up to 24 square feet in area are permitted, provided that they are at least 500 feet
from a public right-of-way and from the lot line of any adjoining owner, all corners are attached
to poles by grommets or pole pockets, and the banners are made of heavyweight fabric or have
air slits.

PRI would like to install six roadside banners along Route 96 where the Museum of the Earth is located.
The locations of the roadside banners are on three adjoining tax parcels.The parcel on which the
Museum of the Earth is located is zoned Low Density Residential(although there are no residences on
this property.)The other two parcels are zoned Planned Development Zone 4.
The Museum of the Earth is at the end of a long sloping yard and mostly hidden behind earth berms. in
addition,the museum was built to conform with regulations of the National Register of Historic Places
because of the adjacent Odd Fellows Hall,and resulted in the museum roof being not higher than the
roofline of the Hall.As a result of these factors,the Museum of the Earth is not readily visible from the
road.These roadside banners will alert motorists to the existence of and approaching entrance to the
museum,and allow motorists to become aware of the entrance so that they may slow down before
encountering the museum driveway.
Banners are currently allowed on the property,and we are requesting variances to have the banners
less than 500 feet from the right of way.Previous variances were granted for the same banner locations
and had no complaints.
We would also like to install banners on three light poles located on our driveway.These poles are not
easily visible from the right of way because they are hidden behind earth berms,and we are requesting
variances to have them less than 500 feet from the right of way. Banners on these poles would be
mostly unseen from Route 96.
Finally,we would like to install a wall banner on the museum building that is more than the 24 square
feet allowed in size.A sign that is 24 square feet would be too small to be visible from the driveway
because the museum is set back from the driveway by a large plaza.In addition,a sign of 24 square feet
would not look appropriate because it is too small for the location of the large front wall where it would
hang.

Georgia,bad news here.None of these banners are permitted,under our sign law. The previous variance that allowed
them before has expired as of May 2017.Therefore,any remaining banners must be removed at this time.Should you
wish to continue to pursue these new banners you would need to seek a variance before our Zoning Board Of Appeals
(ZBA).The reason for this is,Town Zoning section 270-254 E(4).
§270-254 Residential and Conservation Zones. E.
Banners up to 24 square feet in area are permitted,provided that they are at least 500 feet from a public right-of-
way and from the lot line of any adjoining owner,all corners are attached to poles by grommets or pole pockets,
and the banners are made of heavyweight fabric or have air slits.
Your pole banners meet the size requirement but not the 500 ft.requirement.The building banner meets the
distance requirement but not the size requirement.
Also depending on the location of and the number of signs on each parcel,you may also need a variance from
section 270-254 E(6) (a).

Part 3 Determination of Significance
For every question in Part 2 that was answered"moderate to large impact may occur",or if there is a need to explain why a
particular element of the proposed action may or will not result in a significant adverse environmental impact,please
complete Part 3.Part 3 should,in sufficient detail,identify the impact,including any measures or design elements that
have been included by the project sponsor to avoid or reduce impacts. Part 3 should also explain how the lead agency
determined that the impact may or will not be significant.Each potential impact should be assessed considering its setting,
probability of occurring,duration,irreversibility,geographic scope and magnitude. Also consider the potential for short-
term,long-term and cumulative impacts.
The requested action by The Museum Of The Earth, (Paleontological Research Institution), PRI, involves the placing
of 10 banners of various sizes on PRI's building, light poles and utility poles on or adjacent to their owned property.
Traffic will not be increased due to the fact that these banners are designed to alert the current traffic of the
museum's presence and should not increase traffic. Impact on neighbor character would be very little given the
Banners placement in an area surrounded by the hospital and professional buildings.

The poles are Verizon and not NYSEG. I've attached the permit from Verizon which was granted when the banners were
first installed. I am assuming this is still in effect as we have heard nothing different and there is no expiration on the
permit. Please let me know if that is not the case.
It is my understanding that we need to apply for a work permit from the NYS DOT for the installation. I have not begun:
this application yet, as I was not sure about the timing in relation to the variance hearing. I will start that process today,
and send it along to you as soon, as we have it in place. Please let me know if that plan is okay with you.
