HomeMy WebLinkAbout2017-01-03-PB-FINALTOWN OF ULYSSES PLANNING BOARD MEETING MINUTES Tuesday, January 3, 2017 Approved: January 17, 2017 Present: Chair David Blake, board members Benjamin LeWalter, Rebecca Schneider, David Tyler, and Sara Worden; Environmental Planner Darby Kiley. John Wertis was absent, and Mr. LeWalter was named a voting board member in his absence. Public in Attendance: Larry Berger, Audra Bartlett Mr. Blake called the meeting to order at 7:00 p.m. Agenda Review; Minutes Review (10/18/16) There were no proposed changes to the meeting agenda. Mr. Tyler MADE the MOTION to accept the October 18, 2016 meeting minutes, and Ms. Schneider SECONDED the MOTION. The minutes were unanimously accepted, 5-0. Consideration of Sketch Plan/Site Plan and Special Permit for a residence located at 1603 Trumansburg Rd, Tax Parcel Number 33.-2-15, B1 -Business District. The proposed project is to convert an existing building (former nursery) into a residence, which will include a wholesale bakery. Single-family residences are permitted with Special Permit in the B 1 District. Lesia and Gary Van Houten, Owners; Audra Bartlett, Applicant; Larry Berger, Agent. Mr. Tyler MADE the MOTION to open the sketch plan conference, and Ms. Worden SECONDED the MOTION. The motion was unanimously carried. Mr. Berger described the project where Ms. Bartlett would be renovating the existing building at 1603 Trumansburg Rd to turn the building into a residence, and she will operate a home business. She plans to begin operation of the bakery within a month of moving in. There will not be traffic other than deliveries to the house, and Ms. Bartlett delivers the baked goods to about 10 local cafes and businesses. The septic system was recently installed, and the water line will soon be connected. All of the work on the house is internal, the building is plumbed but a bathroom and kitchen need to be installed. Ms. Bartlett will have a home processor's permit, which issued by NYS Department of Agriculture and Markets, and not subject to the requirements of a commercial kitchen and Health Department inspections. Ms. Kiley discussed the process - because the property is in the B1 -Business District, the zoning requires site plan approval and special permit for any residence. The project is subject to County Planning Board 2 January 3, 2017 Planning Department review pursuant to General Municipal Law §239-1 and —m. The materials were submitted to the county on December 20th, and the county has 30 days to review the submission, which has not been completed. The Planning Board cannot approve the project until the county responds. Ms. Schneider MADE the MOTION to close the sketch plan conference, and Ms. Worden SECONDED the MOTION. The motion was unanimously carried. Ms. Schneider MADE the MOTION to open the site plan review, and Ms. Worden SECONDED the MOTION. The motion was unanimously carried. Ms. Schneider MADE the MOTION to waive a public hearing, and Mr. Blake SECONDED the MOTION. The motion was unanimously carried. The site plan review will continue when the county responds to the General Municipal Law §239-1 and —m submission. Administrative items: 2017 meeting schedule; review rules and procedures; ethics policy Mr. Blake MADE the MOTION to adopt the 2017 meeting schedule, Ms. Schneider SECONDED the MOTION. BE IT RESOLVED, that the Planning Board of the Town of Ulysses adopts the following schedule of meetings for the Planning Board for the year 2017, where the board will meet on the first Tuesday of each month and as needed on third Tuesday of each month. The Town of Ulysses Planning Board will meet at 7:00 PM in the Town of Ulysses Town Hall at 10 Elm St, Trumansburg. 2017 Schedule is as follows January 3, January 17 (as needed), February 7, February 21 (as needed), March 7, March 21 (as needed), April 4, April 18 (as needed), May 2, May 16 (as needed), June 6, June 20 (as needed), July 18, August 1, August 15 (as needed), September 5, September 19 (as needed), October 3, October 17 (as needed), November 7, November 21 (as needed), December 5, December 19 (as needed). The motion was unanimously carried. Review rules and procedures The Board did not recommend any changes to the rules and procedures Ethics policy Members submitted the signed ethics policy statement. Solar Law Discussion Planning Board 3 January 3, 2017 Ms. Schneider stated that she is interested in finding out what is the total number of solar projects that could be installed across the town? Are there places that we would not want solar installed? She would like to schedule time on the agenda to discuss the maximum build -out and review maps with steep slopes, prime soils and other sensitive areas, including views. Ms. Kiley mentioned the tax regulations associated with Real Property Tax Law Section 487 and that the town and other taxing entities can require a Payment in Lieu of Taxes (PILOT).
