HomeMy WebLinkAbout1978-08-14 / TOWN OF DANBY TOWN BOARD MEETING MINUTES August 14 , 1978 The regular meeting of the Danby Town Board was called to order at the Danby own Hall , 1830 Danby Road , Town of Danby , County of Tompkins and State of New York on August 14 , 1978 at 8 : 10 P . M . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Dorothy Roberts Councilman Robert Snedden Others present : Roy Hornbrook , Ernest Cole , Kevin Rorke , Justice Paul Smith , Eva Mae Musgrave , Frank Haskins , Jimmy Miller , Joan Barber , David Lee , Moses Peter and Ed Slights . Board member absent : Justice Milton Todd Supervisor A . Francis Wright made the motion to accept the minutes of the regular meeting held July 110 , 19 78 as presented . The motion was seconded by Councilman Ralph ilbur and carried by a vote of four ayes and no noes . COMMUNICATIONS : 1 . A letter to Moses Peter a copy sent to the Supervisor from the Tompkins County Board of Representatives concerning the assessment of Mr . Peter ' s property . 2 . A letter from Kevin Rorke advising the town that David Lee will become general manager of Cerracche Television a division of American Television and Communications Corp effective August 1 , 1978 . 3 . A letter from the New York State Department of Transportation concerning permits to construct new access driveways or ,. alter :r. . existing : : driveways . 4 . A letter from. the Central New York Village Clerk/Treasurer Association extending an invitation to Town Supervisors and Town Board members to a dinner meeting . Mr . Robert Fisher from Audit and. Control will discuss fixed assets . 5 . Minutes of the Town of Danby Planning board meeting held July 19 , 1978 . 6 . Minutes of the Town of Danby Board of Zoning Appeals meeting held July 12 , 1978 . PRIVILEGE OF THE FLOOR : Justice Paul Smith statelthat there is a problem of disappearing mail . To eliminate theproblem, Mr . Smith suggested that a mail slot be installed in the back door of the town hall . He obtained an estimate of the cost of the slot and basket and labor which was $47 . 00 . Jimmie Miller of the Tompkins County Board of Representatives reported that the TC3 operating budget has been apporved . OTB in Tompkins County was also approved by the board . Route 96 was discussed . Mr . David Lee was introduced by Supervisor A . Francis Wright . He discussed the revised proposed cable television franchise for the Town of Danby . - This would be a 10 year franchise . After discussion Councilman Ralph Wilbur made the motion that the revised proposed cable television franchise be approved . Councilman Dorothy Roberts seconded the motion . FRANCHISE FOR THE TOWN OF DANBY AS PRESENTED BY CERACCHE TELEVISION A DIVISION OF AMERICAN TELEV- ISION AND COMMUNICATIONS CORPORATION Roll Call Vote : Wright - aye . Wilbur - aye Roberts - aye Snedden - aye Carried by a vote of four ayes and no noes . COMMITTEE REPORTS : Highway - Councilman Ralph Wilbur reported on the roads that are being worked on under the Donovan Plan at the present time . The new truck purchased by the town will be delivered in September . Mr . Wilbur would like a meeting in September of. the highway committee and the Town Board . Money has been budgeted for a building . A decision should be made as to what type building is needed and the site . The bridge that is available from the county was discussed . It could be used to replace the old one at the Ithaca Speech Clinic . The county would not charge for the bridge but it would cost $ 300 . 00 to have it moved . Money is available in the budget under bridges . To make funds available to get the bridge to Danby and get it installed , Roy Hornbrook said that $ 500 . 00 can be taken from the bridge fund and $ 1000 . 00 from the snow fund and transferred to the machinery fund to make funds available to pay for the transfer of the bridge and the installation . Councilman Ralph Wilbur moved a resolution to transfer the funds as stated by Roy Hornbrook . Councilman Dorothy Roberts seconded the motion . RESOLUTION #33 TRANSFER $ 500 . 00 FROM THE BRIDGE FUND AND $ 1000 . 00 FROM THE SNOW FUND TO THE MACHINERY FUND TO MAKE FUNDS AVAILABLE TO MOVE THE BRIDGE AND INSTALL IT AT THE SPEACH CLINIC . Roll Call Vote : Wright - aye Wilbur - aye Roberts - aye Snedden - aye Carried by a vote of four ayes and no noes . Two people have rebid for the Oshkosh 4-wheel drive 1957 dump truck . Bill Farrell rebid $ 495 . 00 and Bill Johanson rebid $ 450 . 00 . Discussion followed . Supervisor A . Francis Wright made the motion to authorize the Highway Superintendent to negotiate with these two people and sell the truck as he sees fit . The motion was seconded by Councilman Ralph e r y p Wilbur and carried by a vote of four ayes and no noes . The low bidder for the town barn roof repair has been contacted and asked to submit a contract . He has not done this yet . West Danby Water District - All in good shape now . Insurance - All in order . Refuse Collection and Disposal - There has been a complaint of litter on Bald Hill Road that is being handled by the Town Justice . Youth Program and Community Council - West Danby Park is being bulldozed and cleared. There was discussion about the swimming program at the Danby fond . Town Board Meeting Minutes - August 14 , 1978 Page 3 Committee Reports continued : Zoning & Planning - Councilman Robert Snedden reported that the Town Board will be holding hearings on the sections of the zoning ordinance that the Planning Board has ready . Also two members are needed to make a full Planning Board . Fire - Very busy . Cemetaries - All is in order . ® OLD BUSINESS : Highway Superintendent ' s report - Nothing to add to what has already ® been submitted . Appeals Board Chairman - Absent no report . Planning Board Chairman - Ernest Cole reported that the proposed Agriculture District that includes part of West Danby should be acted on by the Town Board . The matter was discussed . Councilman Robert Snedden made the motion that the clerk send a letter to Jim Ray advising h im that the Town Board approves the proposed Agricultural District #6 which is located partly in the Town of Danby . The motion was seconded by Councilman Dorothy Roberts and carried by a vote of four ayes and no noes . Councilman Robert Snedden made the motion that Donald Graham be named official alternate to Ernest Cole on the County Planning Board . He will be able to attend meetings and will have a vote when Mr . Cole is not available . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of four ayes and no noes . An a official map of the Town of Danby was discussed . The matter of the map will be put on the agenda of the September Town Board meeting . The Clerk reported that drapes will be hung in the Clerk ' s Office and the Justice ' s Office next week . Drapes for the meeting room were d iscussed . The matter of the drapes for the meeting room was tabled . AerrUdiscussing the need for a deputy zoning officer it was decided that this matter would be turned over to the Zoning and Planning committee . The invitation to the meeting of theCentral New York Village Clerk/ Treasurer Association Was discussed . Councilman Roabert Snedden made the motion that the funds be released to pay for town board members , the supervisor , and the clerk to attend . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of four ayes and no noes . Appointments to the Planning Board were discussed . Councilman Dorothy ORoberts made the motion to appoint A . berta Wilbur to another term as a member of the board and appoint Irene Cortright as a new member of the board . The motion was seconded by Supervisor A . Francis Wright and carried by a vote of three ayes and one abstaining vote . These people will be notifed by the clerk of their appointment . There will be a public hearing on the town map September 11 , 1978 at 7 : 30 P . M . immediatley preceding the regular meeting of the town board . The motion was made by Councilman Ralph Wilbur and seconded by Councilman Robert Snedden and carried by a vote of four ayes and no noes . Supervisor A . Francis Wright made the motion to authorize William Reed to install a slot for mail in the back door of the town hall . The cost of labor and installation to be $ 47 . 00 . Money to pay the bill to be t aken from the purchasing account . The motion was seconded by Councilman Dorothy Roberts and carried by a vote of four ayes and no noes . Town Board Meeting Minutes - August 14 , 1978 Page 4 New Business continued : A letter was received from Thaler & Thaler stating that they could see no problem in printing a town directory and distributing it throughout the town . The directory was discussed at length . Councilman Robert Snedden made the motion that the Community Council be authorized to publish a town directory . The board reserving the right to look at the proof before it is published . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of four ayes and no noes . Councilman Ralph Wilbur made the motion to appoint Fred Thayer as • custodian of the voting machine and authorize him to attend the two day school in Jamesto *h , New York . The expense of the trip to be paid by the town . The motion was seconded by Councilman Dorothy Roberts and carried by a vote of four ayes and no noes . • Radios that were purchased for the highway department will be installed next week . Moses Peter stated that nothing has been done about his assessment problem as was promised . This was discussed . Ernest Cole as a member of the assessment board of review would like to go over the matter with Mr . Peter . General Fu;}d Warrant #8 in the amount of $ 2101 . 00 was approved to be paid . he motion was made by Councilman Dorothy Roberts and seconded by Councilman Robert Snedden and carried by a vote of four ayes and no noes . Highway Fund Warrant #8 in the amount of $ 2745.39 was approved to be paid . The motion was made by Supervisor A . Francis Wright and seconded by Councilman Ralph Wilbur and carried by a vote of four ayes and no noes . West Danby Water District Warrant #8 in the amount of $ 111 . 04 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Councilman Dorothy Roberts and carried by a vote of four ayes and no noes . The Supervisor ' s reports were approved as presented . the motion was made by Councilman Ralph Wilbur and seconded by Councilman Dorothy Roberts and carried by a vote of three ayes and no noes . Supervisor A . Francis Wright made the motion to adjourn the meeting as there was no further business before the board .
