SPECIAL BOARD MEETING MINUTES
March 13 , 1978
A special meeting of the Danby Town Board was called to order at
7 : 30 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby ,
County of Tompkins and State of New York on March 13 , 1978 . This
meeting immediately preceded the regular meeting of the Danby
Town Board . The purpose of the meeting was to settle the Deputron
Hollow Road problem .

Others present : Attorney Manley Thaler , Rick Dobson , Mr . Liberman

Supervisor A . Francis Wright stated that Deputron Hollow Road is a
Town Road which is not maintained beyond Olsefski ' s home . Mr .
Liberman lives beyond Olsefski ' s where the road is not maintained .
The Olsefski ' s apparently believe this section is not a Town Road
primarily because it is not maintained . . This is causing a problem
between the Olsefski ' s and the Liberman ' s . Mr . Liberman feels that
maintaining the road for an additional 500 feet will solve the
problem . The highway committee has studied the possibility of repair -
ing the road so that it can be maintained . The County Engineer was
asked to look over the section of road in question and give an
estimate of the cost of repairing it . His estimate was $ 10 , 076 . 00
to repair it to Erwin standards which are the standards adopted by
the town as the town standards for building roads . Even with the
$ 2 , 000 . 00 that Mr . Liberman said he would donate the town does not
have the balance needed to do , this . work . Mr . Liberman feels that
the cost figure of $ 10 , 076 . 00 . s unreasonable . Attorney Thaler
read from the law which states that a town board approached by
property. owners to improve a road can on its own , by resolution ,
decide to repair the road or the property owner wanting the work
done can petition the town board to do this work . The charge for
having this done would not be a general town charge but would be
asse aed to the property owners on that particular road (State
Comptroller ' s Opinion ) . The matter was discussed at length .
Councilman James Murinchack moved a resolution to accept a petition
from Mr . Liberman to set up a special improvement benefit district
under Section 200 of the Town Law to have a 500 foot section of
. Deputron Hollow Road repaired . The property owners along that
section to be billed for the repairs tbe, the road depending on the
approval of the State Comptroller . The motion was seconded by
Councilman Dorothy Roberts .

March 13 , 1978
The regular meeting of the Danby Town Board was called to order at
the Danby Town Hall , 1830 Danby Road in the Town of Danby , County
of Tompkins and State of New York on March 13 , 1978 at 8 : 13 P . M .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman James Murinchack

Others present : Mr . & Mrs . William Shippos , Mr . Rourke , Roy Hornbrook

Smith , Bill Center , Ernest Cole , Rick Dobson , Douglas Taylor , Ed
Slights .
The board members will read the minutes of the February 13 , 1978
meeting and vote on them at the next regular meeting of the Town
Board .
COMMUNICATIONS :
1 . The minutes of the March 8 , 1978 meeting of the West Danby
Water District Commissioners .
2 . The minutes of the February 15 , 1978 meeting of the Town of
Danby Planning Board .
PRIVILEGE OF THE FLOOR :
Mr . Shippos asked about Cable T . V . in West Danby . He was told that
the next step will be a public hearing . He asked what can be done
to improve the condition of Station Road . He was told that the
matter of repairs has been studied and the project would be too
expense at this time .
Rick Dobson is unhappy about the rezoning in Danby and feels that
help from the county to do this is not necessary .
Bill Center asked why a man who is not a Danby resident is chairman
of the Danby Planning Board . It was explained that Ernest Cole has
property in the Town of Danby and up until recently lived in the
town . He was a town resident for approximately 30 years .
OPaul Smith reported that the sign for the Town Hall was put up and
then had to be taken down again because the post needed to be changed .
® Jimmie Miller reported that the Tompkins County Hospital is 70%
completed . Also a resolution on off - track - betting will be coming
before the Tompkins County Board of Representatives in about two
weeks and he would like to know how the people in Danby feel about
this . It would legalize OTB . County recession funds in the amount
of $ 12 , 000 . 00 have been donated to help repair Ithaca High : School .
EOC will be voted on . Mr . Miller would like the Town Board to
consider the purchase of the Austin Property which abuts the property
where the Town Hall is located .
Douglas Taylor , a resident of the Town of Danby , was introduced . He
attended the meeting to discuss the problem of acoustics in the Town
Hall and make suggestions as to what can be done to correct the

Privilege of the Floor Continued :
problem . He said that many things could be done but the most pratical
thing to do would be to install draperies . Draperies would help cut
down on the heating bill as well as help with acoustics . After
discussing the type of draperies that could be used and how they
should be hung he showed some sketches of how he thought it could
be done . He gave the Town Board an estimate of 33 , 300 . 00 for
having the drapes made and installed . Mr . Taylor was asked to
work with the committee on writing up specifications as this is
over $ 1 , 500 . 00 and must be put out to bid . A motion was made by
Justice Milton Todd that specifications be drawn up with the help
of Mr . Taylor and advertise for bids . The motion was seconded by
James Murinchack and carried by a vote of five ayes and no noes .
The return date for bid opening to be April 10th .
COMMITTEE REPORTS : •
T . V . Cable Committee - Judson Leonard reported that a public
informational meeting was held in West Danby . Mr . Roarke stated that
he feels the contract seems agreeable and is ready for public hearing .
( Mr . Roarke is the T . V . Company representative ) The procedure was
discussed and it was noted that the Town Attorney would need to give
his approveal on the proposed contract before a public hearing could.
be held . James Murinchack made the motion that the agreed upon
cable T . V . contract be turned over to the town attorney for his
recommendations . It should be stipulated that an answer is needed in
two weeks as the Town Board will hold a special meeting at that time
to go over this and set a date for a public hearing . The date for
the special meeting to be March 27 , 1978 . .. Dorothy Roberts seconded the
motion which was carried. by a vote of five ayes and no noes .
Highway Committee Report - Councilman Ralph Wilbur reported that he
wrote a letter to Shelko asking for more information about the
material that they are billing the town for and some sort of
guarantee that the material was received by the Town of Danby .
This bill cannot be paid until we know what it is for . This letter
was not acknowledged and therefore all the information was turned
over to the town attorney . The new air compressor has been received .
There is an FWD in Horseheads that the town board should look at as
it is similar to the type of truck the town needs . After discussion
it was decided that the town board members would beet at the town
barns on Thursday at 7 : 00P . M . and go as a group to look at the truck .
Roy Hornbrook will make the arrangements . Justice Milton Todd made
the motion that Roy Hornbrook look in to the matter of the bad
drinking water at the town barns and make recommendations as to what
needs to be done . Councilman James Murinchack seconded the motion
which was carried by a vote of five ayes and no noes . A motion was
made that the coveralls for the highway employees be purchased .
Supervisor A . Francis Wright made the motion which was seconded by
Councilman James Murinchack and carried by a vote of five ayes and.
no noes . Councilman Ralph Wilbur said that some people have shown
an interest in some of the old surplus highway equipment . He suggested
that all the old equipment be put to bid to get rid of it . When
Roy Hornbrook draws up specs a time will be set to open the bids .
The owner of the equipment to be moved from the highway barns has
been contacted and. he will do this as soon as he can . Radios for
the highway department were discussed . The Town of Newfield has
gone to bid , having contacted the Town of Danby Board members , for
raidios for their highway' department with the idea that the Town of
Danby would cooperate by buying radios in conjunction with them . A
resolution was moved by Justice Milton Todd to purchase a radio
system with a maximum of 20 radios of which Danby Would purchase
5 , Newfield School would purchase a maximum of 6 and the own of
Newfield would purchase 6 . This would involve a repeater which is
installed on Connecticut Hill . The cost of the service contract
involved will be split 3 ways . This contract is for the repeater
only . Each unit shall be limited to six radios and a set of rules

be adopted by the three boards governing the use of the radios . The
motion was seconded by Councilman James Murinchack .
RESOLUTION #11 COOPERATE WITH THE TOWN OF NEWFIELD AND
TEE NEWFIELD SCHOOL TO PURCHASE A RADIO
SYSTEM WITH A MAXIMUM OF 20 RADIOS

West Danby Water District - All running smoothly .
Insurance - Nothing to report .
Refuse Collection and Disposal - Nothing to report .
Youth Program - An amendment is needed to pay Mike Wieses salary from
the 1978 budget . Ross Cortright says that the West Danby Park is
really progressing .
Zoning and. Planning - Nothing .
Fire - Fire departments are busy . The rescue squad is trying to
raise funds for a rescue vehicle .
Cemetaries - Nothing .
OLD BUSINESS :
Supervisor A . Francis Wright moved a resolution to adopt the changes
in the hourly rates of pay for the highway people as set forth in
the contract between CSEA as representatives of the highway employees
and the Town of Danby . This contract was presented to the board at
their January meeting and approved . Also this resolution will
authorize the supervisor to sign this contract . The motion was
seconded by Councilman Ralph Wilbur .
RESOLUTION #12 ADOPT CHANGES IN THE RATES OF PAY FOR THE
HIGHWAY EMPLOYEES AS SET FORTH IN ARTICLE
XXII SECTION ;. I OF THE CSEA CONTRACT AND
AUTHORIZE THE SUPERVISOR TO SIGN THIS CONTRACT .

Carried by a vote of five ayes and no noes .
A letter was read form the people on Holland Road who had asked to
have snow plowing done on a section of their road that previously
was not plowed . They complemented Roy Hornbrook for doing a good job .
Highway Superintendents Report - Nothing to add to what has already
been brought up .
Planning Board "' hairman - Minutes were read of the last meeting . Mr .
Cole stated that the county would like to know the concerns and the
reactions of the municipalities about possible improvements to Route
96 at the west end of Ithaca where it crosses the railroad . It was
noted that a planning board member is needed .
Councilman Dorothy Roberts and Councilman James Murinchack will work
as a committee to7draw up rules and regulations for the use of the
town hall .

NEW BUSINESS : - ' -
Supervisor A . Francis Wright and Councilman James Murinchack
reported on the Association of Towns Meeting in New York City that
they both attended .
Councilman Dorothy Roberts will head a committee to set up a party
with Floyd Dorn as guest of honor .
The matter of purchasing the Austin property next door to the town
hall was discussed . If the town will make a commitment , Jimmie
Miller will put up the money now and the town can purchase it
later . The board felt they should have more facts and set up a
committee to look into the matter . Councilman James Murinchack
and Justice Milton Todd will serve as this committee .
A motion was made by Ralph Wilbur that a vacuum cleaner be purchased III
for the town hall for x$ 170 . 00 or less . This matter to be left to
the discression of the Town Clerk and Councilman James Murinchack .
The motion was seconded by Justice Milton Todd and carried by a
vote of five ayes and no noes .
General Fund Warrant #3 in the amount of $ 6 , 615 . 25 was approved to
be paid . The motion was made by Councilman Dorothy Roberts and
seconded by Councilman Ralph Wilbur and carried by a vote of five ayes
and noes .
Highway Fund. Warrant #3 in the amount of $ 5 , 691 . 31 was approved to be
paid . The motion was made by Councilman Ralph Wilbur and seconded
by Justice Milton Todd and carried by a vote of five ayes and no noes .
West Danby Water bistrict Warrant #3 in the amount of $ 560 . 54 was
approved for payment after subtracting the bill for Perma Patch Gel
from Lion Industrial Corporation in the amount of $ 127 . 38 making
a total warrant of $ 433 . 16 . The motion was made by Councilman
Dorothy Roberts and seconded by Justice Milton Todd. . and carried by
a vote of fove ayes and no noes . The clerk was asked to write a
letter to Lion Industrial Corporation advising them that the Perma
Patch Gel had not been ordered by anyone in the water district , could
not be used and would be returned .
Councilman Ralph Wilbur made the motion to approve the supervisor ' s
reports as presented . The motion was seconded by Justice Milton
Todd and carried by a vote of four ayes and no noes .
The meeting was adjourned at 11 : 20 P . M .
