HomeMy WebLinkAbout1978-02-13 TOWN OF DANBY SPECIAL BOARD MEETING MINUTES February 13 , 1978 A special meeting immediately preceding the regular meeting of the Danby Town Board was called to order at 7 : 30 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby , County of Tompkins and State of New York on February 13 , 1978 . The purpose of the meeting was to discuss the problem of acoustics in the town hall with the Danby Builders . Board Members Present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman James Murinchack Councilman Dorothy Roberts Justice Milton Todd Others present : Justice Paul Smith , Edward Slights , John Myers , Jimmie Miller , Esther DePew , and Danby Builders representative Gene Wilcox and also John Novaar . An estimate has been received from Danby Builders for installing tile on the walls of the Town Hall . Gene Wilcox explained how the tile would be installed and how it would help the problem . John Novaar discussed the advantages of installing carpeting and drapes . He did not feel that the tile was the thing to use in an old building like the Town Hall , it would be too distracting . A lengthy discussion followed . No decision was reached . Councilman James Murinchack suggested the board go to a building where the tile that Mr . Wilcox is showing is installed and see for themselves what it is like . Mr . Murinchack will look into this and get back to the board . Meeting adjourned at 8 : 00 P . M . M . Board Members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman James Murinchack Councilman Dorothy Roberts Justice Milton Todd Others Present : Justice Paul Smith , Edward Slights , John Myers , Jimmie Miller , Esther Depew , Gordon Roberts , Roy Hornbrook , Donald Graham , Moses Peter , Mr . Liberman and Judson Leonard . A motion was made to approve the minutes of the January 9 , 1978 meeting . The motion was made by Councilman Ralph Wilbur and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter from the State of New York Department of Motor Vehicles concerning handicapped parking permits . 2 . Agenda of the Board of Representatives Monday February 13 , 1978 meeting . 3 . Agenda of the Tompkins County Board of Representatives Monday January 19 , 1978 meeting . • . Agenda of the Tompkins County Board of Representatives Thursday December 29 , 1977 meeting . 5 . A letter from the Newfield. Central School District inviting the Town Board to a meeting March 30 , 1978 concerning re - evaluation of Tompkins County Property . 6 . A letter from Texas Eastern Products Pipeline Company concerning officials to be contacted in the event of an emergency involving their pipelines . 7 . A letter from the Human Services Coalition asking that Danby appoint a representative to sit on the Coalition Executive Committee and Board . 8 . A letter concerning the bad condition of 96B in the Town of Danby from a person that travels the road . 9 . A letter from the Tompkins County Public Library asking for printed material concerning regulations , zoning , taxation , town officials , annual reports etc . 10 . Minutes of the Tompkins County Board of Representatives Monday January 30 , 1978 meeting . 11 . Minutes of the Planning Board Meeting held January 31 , 1978 . PRIVILEGE OF THE FLOOR : Justice Paul Smith talked about holding Court only on Tuesday and on Thursday only in an emergency . This change of hours to take place the 1st . of April 1978 . The two justices would like the opinion of the Town Board in this matter . The reason for changing is because the District Attorney is only available for Danby on Tuesday nights . This change was discussed at length . This is a matter to be decided by the judges . It was suggested that they do this on a trial basis before changing permanently . Town Board Meeting Minutes - February 13 , 1978 Page 2 Privilege of the Floor continued : Cable T . V . for West Danby was discussed . The contract is ready to be negotiated . There are three alternatives opened to the West Danby People . The first is a monthly charge of $ 7 . 00 for 12 channels installed at a rate of $ 50 . 00 per household . The seconde is an installation charge of $ 287 . 00 per household with a monthly charge of $6 . 00 . The third is a monthly charge of •$ 6 . 50 per month with installation charges of $ 158 . 29 . This was discussed at length with Judson Leonard representing the West Danby people . He said that the West Danby people want the cable . Supervisor A . Francis Wright and Judson Leonard will set up a meeting with the West Danby people at the West 0 Danby Fire Hall . Judson Leonard reported that a family in West Danby lost their home and all their possessions in a fire . They would like to put a trailer • on the foundation of the house that burned as they need a place to live . Justice Paul Smith reported that the sign is ready for installation at the Town Hall . It must be decided where the sign will be installed . A meeting will be held at the Town Hall Saturday February 25th at 9 : 30A . M . for the purpose of discussing installation of the sign . John Myers asked about the Maycumber situation which has been in the hands of an attorney for many years . It was noted that an injunction has been filed in Supreme Court . We are waiting for the decision of Judge Bryant of the Supreme Court . Moses Peter stated that federal money is available for towns such as Danby . If the town is interested , Fred Stolz , who is in a position to d o so , will look into this . The possibility is good that we could get - some of these funds . He also mentioned ' that the zoning ordinance should include parking areas and he questioned the price of $ 5 . 00 for a copy of the zoning ordinance . J immie Miller talked about the Tompkins County Board of Representatives meetings . Off track betting will be voted on soon ( OTB ) . Notices of assessment will be mailed to county property owners in the near future . The dog monies due the Town of Danby total $ 1156 . 90 . COMMITTEE REPORTS : Councilman Ralph Wilbur reported that Howland Road hasn ' t been checked. out yet due to the bad weather . There may be a possibility for the board to look at a snow plow of the type that Danby needs . Groton is g etting one and when it comes into Horseheads possibly the board can g o look at it and talk to the salesman . It takes four or five months from the order date to get one of these . Estimated costs of repairing • the old FWD is $ 2800 . 00 . Councilman Wilbur stated that he wrote a letter to Shellco Co . for an explanation fo their bill but has not received a reply . An estimate of doing the road for Mr . Liberman has been received . The estimate is $ 10 , 076 . 00 to build it to specifications . Mr . Liberman is willing to pay up to $ 2 , 000 . 00 . It was decided that no decision could be made immediately . It was discussed where the town would get the balance of the funds needed . There will have to be a meeting of the committee and they will bring recommendations to the Town Board . Councilman Ralph Wilbur moved a resolution to accept the amendment to the contract between the Town Highway Employees ( .CSEA) and_ _ the Town of Danby . This is a two year contract . The resolution was seconded by Justice Milton Todd . RESOLUTION # 8 ACCEPT THE AMENDMENTS TO TEE CSEA CONTRACT BETWEEN THE TOWN HIGHWAY EMPLOYEES AND THE TOWN OF DANBY AND AND NEGOTIATE THIS CONTRACT FOR A TWO YEAR PERIOD . • A Town Board Meeting Minutes - February 13 , 1978 Page 3 Committee Reports continued : Roll Call Vote : Wright - aye Wilbur - aye Murinchack - aye Roberts - aye Todd - aye Carried by a vote of five ayes and no noes . After discussion of the repairs to the 1958 FWD , Councilman James Murinchack made the motuon that Roy Hornbrook be authorized to pruchase the necessary parts for the price of $ 2 , 800 . 00 to get the vehilce back in working order . Councilman Ralph Wilbur seconded the motion which was carried by a vote of five ayes and no noes . The piece of equipment owned by Paul Seeley parked at the highway barns ® . was discussed . He is not authorized to leave his equipment there and the town is liable . This matter was discussed at length . . A registered letter with return receipt will be sent to Mr . Seeley asking him to move the equipment . The motion was made by Councilman Ralph Wilbur to authorize Roy Hornbrook to spend up to $ 60. 00 per pair for coveralls for the highway men . Councilman Dorothy Roberts seconded the motion which was carried by a vote of five ayes and no noes . Councilman Ralph Wilbur made the motion to authorize Roy Hornbrook to purchase an air compressor for $ 1 , 082 . 00 less trade in of $ 175 . 00 the funds to be taken out of the machinery fund . No bid is needed . Justice Milton Todd seconded the motion which was carried by a vote . of four ayes and one abstension . West Danby Water District - All fine Insurance - All in order . Refuse Collection and Disposal - Nothing to report . Youth - Councilman James Murinchack reported that due to a mix up of who was to use the Town Hall , the Danby Area News people or the Town Planning Board both were schedulled to use the same room at the same time . This caused some problems and some hard feeleings . Possibly the old furnace can be reinstalled and the basement made usable for the Danby Area News . Zoning and Planning - Councilman James Murinchack stated that a deputy Zoning Officer is needed but no one has been found to fill this position yet . A.lsq the Planning Board wants to know what action the Town Board is taking on the administration section of the zoning ordinance that was presented to them some time ago for consideration . A public hearing will be held on this section March 22 , 1978 at the Town Hall at 8 : 00P . M . Councilman James Murinchack said that Rick Dobson some time ago had offered to pay one - half the cost of the lease for the West Danby Park . The lease for one year costs one hundred. dollars . Rick has given James Murinchack $ 50 . 00 which he turned over to the supervisor . The parking ordinance was discussed . The possibility of posting signs and their cost was discussed . It was decided that the town would go along with handling the situation the way we have been and see what happens . Councilman James Murinchack said that befor.eLthe Planning Board can make up a Zoning Map they must know the statis of the Auto Salvage . • Cemetaries - No report Supervisor Wright noted that Eva Mae Musgrave has sent him a written report on the County Wide Youth Bureau . Also , any bills for 1978 for the Community Council Youth program cannot be paid until official approval is received from the state . OLD BUSINESS : Report of Highway Superintendent - Roy Hornbrook asked who owned the barrel that is used for fuel storage at the town barns . He wants to change fuel dealers and it is necessary that he knows who owns the tank before de does this , • Town Board Meeting Minutes - February 13 , 1978 Page 4 O ld Business Continued : Appeals Board Chairman - Absent no report . P lanning Board Chairman - Vice - chairman Donald Graham attended in E rnest Cole ' s place . All matters pertaining to this board have been covered . Zoning Officer - A written report was submitted . The Zimmer case will be heard this . week Thursday . Gordon Roberts strongly urged the board not to amend the Zoning Ordinance a section at a time because of the problems it will create for the zoning officer over the years . Two estimates were received for bi - fold doors and storm windows for the offices . After discussion by the board Councilman Ralph Wilbur • made the motion to accept the bid of Richard Walker for the doors and storm windows with screens for the price of $493 . 41 . Justice Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . Rules and regulations for the use of the Town Hall were discussed . It was decided that the Town Board meet with the Community Council officers and discuss the matter . After discussion of possible ways to use the antirecession funds , Justice Milton Todd moved a resolution to put these funds amounting to $ 4 , 711 . 00 in the snow removal fund . The motion was seconded by Councilman Ralph Wilbur . RESOLUTION # 9 USE ANTIRECESSION FUNDS IN TEL AMOUNT OF $4 , 711 . 00 TO REPLENISH THE SNOW REMOVAL FUND ACCOUNT . Roll Call Vote : Wright - aye Wilbur - aye Murinchack - aye Roberts - aye Todd - aye Carried by a vote of five ayes and no noes . The issuing of parking permits for the handicapped was discussed . The motion was made by Councilman Ralph Wilbur to authorize the town clerk to issue these permits . The motion was seconded by Justice Milton Todd. and carried by a vote of five ayes and no noes . An appointment of a representative to sit on the Human Services Coalition Board and Executive Committee will be made at the next town board. meeting The Town Historian will be contacted by the town clerk to see what the Tompkins County Library wants in the way of records of the town . Stanley Kirk has asked to be replaced on the Planning Board as he no longer wishes to serve as a member of that board . Candidates for the vacated position will be considered . G eneral Fund Warrant #2 in the amount of $ 2636 . 71 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by J ustice Milton Todd and carried by a vote of five ayes and no noes . Highway Fund Warrant # 2 in the amount of $4252 . 38 was approved to be paid . The motion was made by Councilman Dorothy Roberts and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . • Town Board Meeting Minutes - February 13 , 1978 Page 5 New Business continued : West Danby Water District Warrant ##2 in the amount of $ 330 . 92 was approved to be paid . The motion was made by Justice Milton Todd and. seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . Justice Hilton Todd made the motion to approve the Supervisor ' s reports as presented . The motion was seconded by Councilman Dorothy Roberts and carried by a vote of four ayes and no noes .
