City of Ithaca
Regular Meeting June 24, 1970 7:30 P.M.
PRESENT: Chairman Putney, Mice Chairman Doney, Messrs. Burns, Conley, Reps and Schmidt.
ALSO: Planning Director Kasprzak, Asst. Planner Meigs, Planning Tech. Lawrence, City
Engineer Schlieder, Mr. and Mrs. W. Ewald, Atty D. B. Lee and members of the
press and radio.
ABSENT: Mr. Korf (out-of-country)
MINUTES of the last Regular meeting of the Board, May 27, 1970, were approved as published.
SPECIAL ORDER OF BUSINESS:
Attorney D. Boardman Lee expressed his interest in beautification of the city,
especially at present time in getting electrical wires placed underground. He said he
understands the Planning Board is about to propose an ordinance to the Common. Council on
the subject; he also hopes that there will be a policy recommended that all wires will be
placed underground from now on. He further stated that he believes the Electric & Gas
Company is willing to cooperate with the developer to the extent that nearly all the cost
to the developer will be reimbursed after a house has been built on a lot (approximately
$300 will be actual cost to developer of $2,400 per lot required deposit).
Mr. Burns stated that he does not believe the consumer should be required to pay the
utility company for this type of service, although he, too, would like the utilities
placed underground.
Mr. Conley MOVED, "Director Kasprzak be sent, as representative of the City of Ithaca
Planning Board, to the Public Service Commission hearings which are currently taking place
on the subject." Seconded by Mr. Schmidt. CARRIED.
Mr. Reps suggested that Common Council appbizt a second city representative (perhaps
City Attorney Weinstein) to attend the hearings. He would like to see the State's
recommendations before the city decides on a course of action.
COMMUNI CATIONS:
1. Telegram regarding approval of CRP.--Director Kasprzak read the telegram of June
10 from Congressman Robison, and letter of June 18 from Department of Housing and Urban
Development, transmitted by Urban Renewal Administrator Daley, advising that the Federal
Grant for Community Renewal Program in Ithaca has been approved in the amount of $73,35+,
and that a proposed contract will be forwarded in the near future to be executed by the
City of Ithaca and returned to HUD office for execution by the Federal Government.
Approved budget and explanation was enclosed.
Director Kasprzak asked for permission of the Board for Asst. Planner Meigs and him-
self to visit the New York City Regional Office of HUD for instructions concerning the
CRP Program.
Mr. Schmidt MOVED, "Director Kasprzak and Asst. Director Meigs be authorized to
travel to New York City for purpose of exploring CRP Program, and report back to Board."
Seconded by Mr. Reps. CARRIED.
2. Tompkins County Department of Planning.--Director Kasprzak read memorandum from
Tompkins County Planning Director Liguori, addressed to himself and representatives of
other concerned local agencies, regarding Crime Control Planning, inviting thea to attend
an organizational meeting to be held on June 25, 1970 at 10:00 A.M. in the County Court
House.
It was felt by the Board that Chairman Putney should attend this meeting also, and
he accepted the invitation. Mr. Conley wondered if Alderman Sullivan as representative
of Public Safety Committee of Common Council, had received an invitation to this meeting.
3. City-County Committee on Functions.--Director Kasprzak read memorandum from Allan
Feldt on behalf of City-County Committee on Functions, addressed to City, County and
Town Planning Directors, requesting advice and consultation on the DeWitt High School site.
He requested a review and report from the 3 planning agencies as to the desirability,
importance and feasibility of use by any or all of the 3 governmental jurisdictions con-
cerned.
Mr. Conley MOVED, "the Board refers memorandum to Community Facilities and Services
Committee for study and to obtain advice from the City Attorney." Seconded by Mr. Schmidt.
CARRIED.
4. New York State Department of Transportation.--For information of the Board,
Director Kasprzak read letter from New York State Department of Transportation, inviting
him and all interested to attend Corridor Public Hearing regarding Improvement of Routes
13 and 96 from Newfield Hill through the City to Trumansburg, Tompkins County, on July 9,
1970 at 7:30 p.m. at Kulp Auditorium, Ithaca High School.
COMMITTEE REPORTS:
1. Housing and Redevelopment Committee.--Mr. Conley presented the Committee's Report
of the Elmira Road Study to the Board and commended Planning Tech. Lawrence for the
excellent study. Mr. Lawrence then briefly discussed the study which has been distributed
to Board members. Director Kasprzak read comments of City Engineer Schlieder regarding
the Elmira Road problems.
Mr. Conley MOVED, "to recommend submitting the study to the B.P.W. , Elmira Rd.
Business Men's Assoc. , and property owners for their reaction and if they submit additional
recommendations, the Board then review the study and submit to Common Council for their
approval and possible implementation." Seconded by Mr. Reps. CARRIED.
2. Codes and Ordinances Committee.--Mr. Schmidt presented recommendation of the
Committee regarding the ordinance for the underground utilities in new subdivisions and
a study with the proposed ordinance for the conversion of the existing utility lines to
an underground system (see Committee file). He then MOVED, "the proposed Amendment to
Subdivision Regulations be approved by this Board, subject to the endorsement by the
Common Council; also that the study with proposed ordinance be transmitted to the Common
Co8ncil as .requested by them in October 1969." Seconded by Mr. Conley. CARRIED.

MISCELLANEOUS:
Review of Zoning Cases:
1. Request for special permit to erect two signs totaling 195 sq. ft. which is in
excess of that size permitted by Sect. 7, Col. 4 of Ordinance. B-2 district - 517 W.,
State Street - Ithaca, N. Y. B.Z.A. #885:.
The request for a Special Permit to Section 7, Col. 4 of the Zoning Ordinance has
been reviewed in accordance with Section 12-C. The Board has reviewed this appeal and
feels that due to lack of information on the request the- Board cannot make its recommenda-
tion until additional information, as to the location, height, appearance of the signs,
is provided.
2. Request for exception to Sect. 7, paragraphs 5 and 9 of Ordinance for parking and
number of stories at Titus Flats - by Ithaca Housing Authority - B.Z.A. #883.
Mr. Schmidt MOVED, "Planning Board approves the granting of exception." Seconded by
Mr. Conley. CARRIED.
3. Request (ex post facto) for exception to Sect. 7, Col. 7 of Ordinance for 3
apartments to be allowed where 2 are permitted by law. R-3 district - 103 E. York St..
B.Z.A. #882.
Mr. Doney MOVED, "Planning Board does not approve request." Seconded by Mr. Schmidt.
Vote: yes - (5 ) Messrs. Doney, Conley, Schmidt, Reps, Putney.
Opposed by Mr. Burns because of lack of information.
