HomeMy WebLinkAbout1977-08-08 TOWN OF DANBY TOWN BOARD MEETING MINUTES August 8 , 1977 The regular meeting of the Danby Town Board was called to order at 8 : 00 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby , County of Tompkins and State of New York on August 8 , 1977 . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith Justice Floyd Dorn Board member absent : Justice Milton Todd • Others present : Jimmie Miller , Mike Wiese , Mr . & Mrs . Shippos , Edward Slights , Mrs . Hulbert , Ernest Cole , James Murinchack , Edward and Dorothy Roberts , Edward Dick , Roy Hornbrook , Jim Metz , Dan Hoffman , Rick Dobson , John Benjamin . Justice Floyd Dorn made the motion to approve the minutes of the July 11 , 1977 meeting as presented . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter from Ron Donlick with a counter offer on property the : town : wishes _ to purchase from him . r 2 . Agenda of the Tompkins County Board of Representatives meeting of Monday August 8 , 1977 . 3 . Minutes of a special meeting of the Tompkins County Planning Department held June 23 , 1977 . 4 . A letter from the Office of the Secretary of the Treasury , Washington D . C . concerning revenue sharing payments . 5 . A letter from the State of New York . Department of Audit and Control concerning the /Abandoned Property Law . 6 . Agenda of the Tompkins County Board of Representatives meeting of Monday , July 11 , 1977 . • 7 . A letter from the Board of Representatives of Tompkins County concerning the establishment of a . County Youth Bureau . 8 . A public notice advising of monies available under the Emergency Jobs Program Extension Act of 1976 to fund work projects in Tompkins County . 9 . Town Board Meeting Minutes - August 8 , 1977 Page 2 PRIVILEGE OF THE FLOOR : Councilman Paul Smith brought up the problem of the bridge at the Speech Clinic . It is the understanding of the Speech Clinic people that the fire trucks will not cross this bridge . The matter was discussed at length . It was suggested that Justice Floyd Dorn and Councilman Paul Smith check into this matter and i . set a date for a special meeting with the county engineer and the Speech Clinic people . Councilman Paul Smith advised the board of what he has done in t he past month concerning cable T . V . in the Town of Danby . A letter was written to Mr . Korte in Albany . Contractor Jjohn Novarr will be contacted about escaping heat in t he town hall through an opening from `.the floor to the ceiling t hat needs to be closed . Justice Floyd Dorn stated that justice court has been very busy . Jim Metz stated that he is running for town justice and will be attending town board meetings to get to know more of the people . Mr . & Mrs . Shippos stated that they had come to the meeting to see what is being done about cable T . V . in the Town of Danby . J immie Miller , Tompkins County Board of Representatives member from Danby commented that the Speech Clinic is a good thing . Old Home Day in Danby will not be held this year . The change orders at the hospital were discussed . Also the salaries of county officials and the county youth bureau were discussed . COMMITTEE REPORTS : H ighway Report - Councilman Ralph Wilbur stated that the town must use the tank and tractor to make it worth the investment . West Danby Water District - When the fire department uses water it makes it unusable for the water customers for the whole day it is so riled up . Insurance - A refund of $ 728 . 00 has been received due to rate changes for compensation insurance . Refuse collection and disposal - No report . Youth - The summer program is going well . Zoning and Planning - The reports of the meeting were received and read . Fire - No report . Cemetaries All in good order . OLD BUSINESS : Highway superintendents report - Absent , no report . Town Board Meeting Minutes - August 8 , 1977 Page 3 Old Business Continued : Zoning Officer ' s report - Written report submitted . Appeals Board Chairman - Jim Murinchack was surprised by the resig- nation of Kurt Bogart . There is a hearing scheduled for September Planning Board Chairman - Ernest Cole stated that no decision has been made in the request for a special permit for an airstrip which was referred to the planning board by the Danby Board of zoning Appeals . There was not a quorm at the last meeting . This matter will • be taken care of at the August meeting . The offer by the town and the counter offer of Ron Donlick for the purchase of property owned by Mr . Donlick was discussed . Councilman • Ralph Wilbur made the motion that the clerk be instructed to write a letter to Mr . Donlick stating that the town ' s offer still stands . If he wishes to accept it , he should answer the letter in 30 days . The motion was seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . Appointments to fill vacancies on the planning board were discussed . There is one vacancy and possibly , there will be a second . A committee of Ernest Cole , Ralph Wilbur and Paul Smith was set up to find candidates to fill these vacancies . James Murinchack suggested that a fee be charged for variances . Sup - ervisor A . Francis Wright made the motion that the Town Board authorize the planning board to make recommendations in the form of an amendment to the Danby Zoning Ordinance in regards to fees for Board of Zoning Appeals hearings . The motion was seconded by Councilman Paul Smith and carried by a vote of four ayes and no noes . This ._ amendment should be based on the schedule that was originally set up . The two estimates received for replacing the Town Garage Roof were discussed . The first from E . H . Lang was in the amount of $4 , 960 . 00 . Secord presented a bid of $ 4 , 600 . 00 . Possibly funds for this project can be used from Revenue Sharing Funds . Justice Floyd Dorn made the motion that a public hearing be held to determine how the Revenue Sharing Funds should be used . Councilman Paul Smith seconded the motion . RESOLUTION #21 PUBLIC HEARING BE HELD ON PROPOSED BUDGET OF REVENUE SHARING FUNDS Roll Call Vote : Wright - aye Wilbur - aye Smith - aye Dorn - aye • Carried by a vote of four ayes and no noes . • A committee meeting will be held August 16 , 1977 to discuss the possible use of the Revenue ''haring Funds and the proper way to set up a budget . This meeting will be held at the Town Hall . A public hearing will be held August 30 , 1977 at 8 : 00 P . M . at the Town Hall on the use of the Revenue Sharing Funds . Drapes and the accustical problem at the Town Hall were discussed at length . It was decided that an opinion was needed and that it must be determined how much the town could pay for such an opinion . The West Danby Ball Field was discussed . Ernest Cole stated that students may be available in the fall to help with this project . James Murinchack stated that he feels that some decision should be made as the land to be used for the ball field before anyting else 1 p { I Town Board Meeting Minutes - August 8 , 19 ? 7 Page 4 is done . A person in West Danby has offered land to be used as a ball field and it can be obtained for as low as $ 50 . 00 per year , possibly with the option to purchase after ten years . After a lengthy discussion it was decided that Councilman Ralph Wilbur would work on this with James Murinchack . Rick Dobson stated that he himself would pay $ 50 . 00 a year to see this ball field started . Ida Hulbert stated that the West Danby Auxiliary has raised $ 300 . 00 for this purpose and Community Council is donating $ 350 . 00 . Councilman Paul Smith reported that Mr . Hovanec will build a 32 " by 48 " sign for the town for $ 375 . 00 . This sign will be double faced . After some disussion the matter of the sign was tabled for the time being . The Deputron Hollow Road problem was discussed at length . It was decided that this is a matter to be settled in Court not by the Town Board . The Court in turn will tell the Town Board what must be done . Councilman Paul Smith made the motion to table the matter for one month . The motion was seconded by Justice Floyd Dorn and carried by a! vote of four ayes and no noes . NEW BUSINESS : An appointment to the County Youth Bureau was discussed . The community council will make recommendations , but the people whose names have been submitted have not all been contacted . All candidated will be interviewed . This matter was tabled until September . A date must be set for highway employee negations . It was decided that Justice: Milton Todd would be contacted and asked to set a date • for a meeting to take care of this matter . General Fund Warrant #8 in the amount of $ 712 . 67 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . Highway ,Fund Warrant #8 in the amount of $ 1 , 235 . 42 was approved to be paid . the motion was made by Councilman Ralph Wilbur and seconded by Councilman Paul Smith and carried by a vote of four ayes and no noes . West Danby Water District Warrant #7 in the amount of $ 32 . 70 was approved to be paid . The motion was made by Justice Floyd Dorn and seconded by by Councilman Paul Smith and carried by a vote of four ayes and no noes . The Supervisor ' s reports were accepted as presented . The motion was made by Councilman Ralph Wilbur and seconded by Councilman Paul Smith and carried by a vote of three ayes and no noes . The meeting was declared adjourned at 10 : 30 P . M .
