HomeMy WebLinkAbout1977-06-13 TOWN OF DANBY SPECIAL BOARD MEETING MINUTES June 13 , 1977 A special meeting of the Danby Town Board was called to order on June 13 , 1977 at the Danby Town Hall at 7 : 15 P . M . The purpose of the meeting was to open bids on a stainless tank trailer and a used tractor truck combination . 1/ Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith Justice Milton Todd • Justice Floyd Dorn Others present : Joseph Hulbert , Dick Watt and Rick Dobson • The following was the only sealed bid received : Dick Watt ( Brockway representative ) $ 3 , 000 . 00 The board discussed the tank and tractor with Mr . Watt . It was decided that the board would meet at the town barn on Monday June 20th and travel as a group to inspect the tractor and tank . Mr . Watt stated that his offer was good until June 23 , 1977 . The decision to purchase the tank and tractor is contingent upon inspection and approval by the Danby Town Board and Highway Super- intendent . Councilman Ralph Wilbur made the motion to adjourn the meeting at 7 : 30P . M . Justice Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby , County of Tompkins and State of New York on June 13 , 1977 . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith Justice Floyd Dorn Justice Milton Todd Others present : Edward Slights , Ernest Cole , Sandy Roberts , Gordon Roberts , Carol Shepardson , Rick Dobson , James Murinchack , Joseph Hulbert , Mr . & Mrs . Melford Oltz , Dan Hoffman , Ms . Chock , Mary Casterline , Roy Casterline , Earl Konchack , Bill Hulbert , Jimmie Miller , Mr . & Mrs . Jackson . Justice Floyd Dorn made the motion to approve the minutes of the May meeting of the Town Board as presented . Justice Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . Agenda of the Tompkins County Board of Representatives Monday May 23rd meeting . 2 . A letter of resignation from John Wilkinson chairman of the Danby Board of Zoning Appeals . 3 . Resolution No . 104 of the Tompkins County Board of Representatives entitled "Apportionment of Mortgage Tax " 4 . The minutes of the ' meeting . of the Danby Board of Zoning Appeals held June 8 , 1977 . PRIVILEGE OF THE FLOOR : Councilman Paul Smith asked that a sign be posted showing the meeting dates of the Town Board , the days and times the justices hold court and the dates and times that the clerk ' s office is open . for business . He also asked the status of the Town Hall parking lot . Joseph Hulbert , highway superintendent , stated that he would try to have the parking lot finished by the end of the year , weather permitting . Mary Oltz , town clerk asked that a bulletin board be purchased for the posting of notices . Also as tax collector for the town , she stated that enough tax money was collected to satisfy the town budget ' and turn $ 11 , 000 . 00 ( over to the county . Carol Shepardson , an employee of the E . O . C . , talked on the county youth budget . Rick Dobson said that his trailer park , " Danby Mobile Home Park " , has been closed by the zoning officer and he wants to know why . Also he stated that closed meetings are being held and this should not be . Town Board Meeting Minutes - June 13 , 1977 Page 2 Privilege of the Floor continued : As so many people attended the meeting asked about the baseball field in West Danby , this matter was taken up . The Town attorney has been contacted and says that it is legal for the town to lease the property for the baseball field . A lease will have to be drawn up and insurance coverage taken into consideration . The supervisor stated that before the town board takes any action in this matter , he would M.- like to see a budget drawn up , a written plan of action , terms and length of the lease and what funds will be expected from the town board . James Murinchack ; stated that the Community Council has set aside $ 350 . 00 for the West Danby ball field . A committee o f Bill Hulbert , James Murinchack and Roy Casterline was named t o draw up a budget and report to the town board at their next ✓ egular meeting . All were asked to attend the next Community Council meeting to be held June 21 , 1977 at 8 : 00 P . M . at . the t own hall . J immie Miller , Danby ' s representative on the County Board of Representatives reported that there was a record number . of 25 resolutions to be acted on at their last meeting . He stated that he has to know by June 24th the feeling of the Danby Town Board concerning a county youth bureau . A representative from Danby should attend the meeting which will be at 4 : 00 P . M . Old Home Day in Danby will be held August 20th , which is the third weekend in August . All seems to be in order . A committee has been set up t o study possible charter changes in county government . Bottle legislation was discussed . As far as the youth legislation is concerned, the City and Town of Ithaca are in favor of the County wide youth program and the towns and villages of the county are not in favor . E rnest Cole reported on the County Planning Board Meeting where the County Youth Program was discussed . Many:.° of the group did not vote on this issue as they did not feel that they knew their municipalities feeling in this matter . He asked for direction from t he town board as to how he should cast his vote at the June 21st meeting of the planning board . It was noted that 51 of the 57 counties in New York State are considering county wide youth bureaus but only 14 or 15 have anything actually under way . The Town Board had no answer for Jimmie Miller or Ernest Cole on the countywide youth bureau at this time . COMMITTEE REPORTS : Highway report - Work is being done on Hornbrook Road and West King Road . It was noted that there is not enough in the budget to complete this years Donovan Plans . Supervisor A Francis Wright moved a resolution as follows : Whereas the King Road completion was inadvertantly left out of the 1977 Town Budget , and whereas an amount of $ 3 , 240 . 00 should have been appropriated for this road work be it resolved that this amount be transferred from Highway Fund Item 1 to Highway Fund Item 1A . M . to decide on the purchase of the tank and tracter at the Town Hall immediately • preceeding the Community Council meeting . West Danby Water District - Nothing new to report . Insurance - All up to date . Refuse Collection and Disposal - No report . Youth - The dike at the Danby Pond is deteriorating . There will be a pond area clean up . Zoning and Planning - No report . Fire - No report . Cemetaries - Mowing is going on as schedulled . The clean up of the West Danby Methodist cemetary was discussed . Town clean up is done only when a cemetary has been abandoned . OLD BUSINESS : H ighway superintendent - No report . Zoning Officer - There are two appeals pending at the present time . One is the airstrip and the other is the West Danby Post Office . P lanning Board Chairman - The Bruce proposed development was discussed at the last planning board meeting . Mr . Bruce was not there . The board did not feel that they had enough information to make a decision . They authorized the secretary to write a letter to Mr . B ruce and ask him for more information to be presented at the • June meeting . Supervisor A . Francis Wright moved a resolution concerning the Youth Budget as follows : Whereas the Town of Danby youth program is participating in a work study program and whereas Ithaca College and Cornell University will reimburse the Town of Danby in the amount of $ 3 , 801 . 60 , be it resolved that the youth budget be increased by $ 3 , 801 . 60 . The gasoline tank for the highway department is on its way and will cost apporXimately $ 800 . 00 . There are , now , no problems of . leaking with the town barn roof . The highway superintendent was asked to get estimates on repairung the roof and submit them at the next town board meeting . . The money for the repairs can be taken out of Federal Recession Funds , which are now available . Draperies for the town hall were discussed . Mary Oltz reported that she has two estimates. ; the first is from Mr . , Dennie Marfurt in the amount of $ 1 , 557 . 57 , the second is from Bob Myers of Ithaca Paint and Wallpaper in the amount of $ 1 , 450 . 50 . Both estimates include rods and complete installation . Mr . Myers estimate does not include a suggested valance . The materials suggested are fire retardant and seem to be much the same . She also reported that the furniture for the town hall will be delivered from the factory July 29 , 1977 . The board looked at the materials and discussed the matter of the drapes . It was decided that the matter be tabled for one month . Councilman Paul Smith was asked to look into the cost of having valances made . NEW BUSINESS : ' The Sunshine Law was read . Justice Milton Todd made the motion to table the matter of any action on this law until the next > ,meeting of the town board . The motion was seconded by Councilman Ralph W ilbur and carried by a vote of five ayes and no noes . The motion was made by Councilman Ralph Wilbur that Ernest Cole be reappointed as chairman of the Town of Danby Planning Board . His t erm will begin July 1 , 1977 and end June 30 , 1984 . The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . An appointment to fill the vacancy made by the resignation of the chairman of the Town of Danby Board of Zoning Appeals , John W ilkinson , was discussed . It was noted that this board cannot act w ith a vacancy . John Wilkinson has recommended that James Murinchack be appointed chairman of the Town of Danby Board of Zoning Appeals as his replacement . Mrs . Hiney has . expressed a w ish to serve on this board and also Rick Dobson would like to serve . It was suggested that appeals board members should be appointed from the , planning board membership . The committee set up to name the roads in the town that have no n ames and suggest name changes will meet at the town hall at 8 : 00P . M . on June 27 , 1977 . . Supervisor A . Francis Wright stated that a study is needed of . : 1 the purchase of land owned by Mr . Donlick that boarders the Town Highway property . A decision , must be . made on this matter by the end of the month . Joseph Hulbert , Floyd Dorn and Ralph Wilbur were asked to work on this and report back to the town board . Supervisor A . Francis Wright moved a resolution to transfer $ 3 . 00 from the General Fund Contingency account No . A1990 . 4 and add this amount to General Fund account No . A9010 . 8 so that there will be sufficient funds in the account to pay the state retirement insurance bill . Councilman Ralph Wilbur seconded the motion . RESOLUTION #1 -5r TRANSFER $ 3 . 00 FROM CONTINGENCY ACCOUNT fA1990 . 4 TO GENERAL FUND ACCOUNT fA9010 . 8 TO PAY BALANCE OF STATE RETIREMENT PLAN . The town board wants to know the proposed design and cost of signs at the town hall and for the bulletin board . Paul Smith and Mary Oltz were asked to take care of getting this information . Rick Dobson reported that he has people ready to move into his trailer park and the zoning officer has advised them not to as this is not a legal trailer park . The board listened to Mr . Dobson and also to the zoning officer . There was a lengthy discussion and it was decided that this is a matter that cannot be acted on by the town board as it is a legal matter . The burden of proof is on Rick Dobson . He should bring proof to the town board • that he does have a legal trailer park . General Fund Warrant ;#6 in the amount of $ 4 , 643 . 62 was approved to be paid . The motion was made by Justice Milton Todd and seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . Highway Fund Warrant r6 in the amount of $ 9 , 013 . 36 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . West Danby Water District Warrant ;- 5 in the amount of $ 400 . 50 was approved to be paid . The motion was made by Justice Milton Todd and seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . The Supervisor ' s reports were approved as presented . Respectfull submitted , at , c • TOWN OF DANBY PUBLIC HEARING ON PROPOSED AMENDMENT TO THE DANBY ZONING ORDINANCE June 13 , 1977 The Town Board of the Town of Danby held a public hearing on the proposed amendment to the Danby Zoning Ordinance to bring the Town of Danby into compliance with SEQRA and to establish land use controls in flood hazard areas in conformance with flood insurance regulations as duly advertised in the Ithaca Journal in the June 3 , 1977 issue . The hearing was held at the Danby Town Hall at 7 : 30 P . M . on June 13 , • 1977 immediately preceeding the regular meeting of the Town Board . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur • Councilman Paul Smith Justice Floyd Dorn Justice ILZilton Todd Others present : Attorney Shirley Egan , Melford and Mary Oltz , Rick Dobson , Joseph Hulbert , James Murinchack , Edward Slights , and Jimmie Miller . The proof of posting and publication was read by the supervisor . He then read the proposed amendment to the Danby Zoning Ordinance . Attorney Shirley Egan explained the implementation of ( SEQRA ) State Enviromental Quality Review Act and what it would mean to the Town of Danby . All persons desiring to be heard , having been heard , Councilman Ralph Wilbur moved the following resolution : The Danby Zoning Ordinace be amended by adding under Article V GENERAL PROVISIONS a new section to be numbered 513 and entitled FLOOD HAZARD AREAS and adding a new Article VIII entitled SPECIAL PERMITS to replace Article VIII entitled STANDARDS FOR SPECIAL PERMITS . This resolution was seconded by Councilman Paul Smith .
