M . at the Danby Town Hall , 1830 Danby Road , Town of Danby County of Tompkins and State of New York on May 9 , 1977 . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith Justice Floyd Dorn Justice Milton Todd Others present : Edward Slights , John Novaar , Gary Evans , Fred Thayer , Jim Murinchack , Gordon Roberts , Sandy Roberts , Joe Hulbert , John Myers , Charlie Bruce . An error was noted in the April Town Board Meeting minutes on Page 4 . Councilman Ralph Wilbur made a motion to approve a plan for a sidewalk at the Town Hall if the price could be kept under $ 1 , 500 . 00 n ot $ 15 , 000 . 00 as was stated in the minutes . Justice Milton Todd made the motion to approve the minutes as corrected . The motion w as seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . Agenda of the Tompkins County Board of Representatives meeting of April 25 , 1977 . 2 . A letter from the Tompkins County Intergovernmental Relations study committee concerned with T . V . Cable task force . 3 . A letter from the Tompkins County Board of Assessment concerning tenative equalization rates . , 4 . A letter from Assemblyman Gary E . Lee concerning 1977 - 78 State Revenue Sharing . 5 . Notice of the May 12th meeting of the Susquehanna River Basin Commission . 6 . Minutes of the meeting of the West Danby Water Commiss - • ioners meeting of May 1977 . 8 . Minutes of the meeting of the Danby Board of Zoning Appeals of April 13 , 1977 . PRIVILEGE OF THE FLOOR : Councilman Paul Smith asked if there are funds available for use by the senior citizens under revenue sharing . Justice Floyd Dorn mentioned that there will be a school for Town Justices at Cornell University on June 6 , 1977 and he w ould like authorization to attend . Town Board Meeting Minutes - May 9 , 1977 Page 2 Privilege of the floor continued : Mary Oltz , clerk stated that the folding chairs that were ordered for the meeting room have been shipped . The order for office furniture has been acknowledged but no shipping date set - yet . Dennis L . Murfurt from Syracuse submitted a price for drapes for the meeting room . The drapes completed and installed will cost $ 1 , 557 . 57 . The clerk also asked that bills submitted for audit before the town board be left at her office on the Friday immediatley proceeding the Monday Town Board Meeting . Gordon Roberts stated that he felt that the members of the Appeals Board should be reimbursed for their services . Sandy Roberts felt that there should be a Town Board Meeting held in West Danby . She also mentioned that possibly the senior citizens would like to make the drapes for the smaller rooms at t he town hall . James Murinchack saidc.: there is a field in West Danby available for lease for a ball field . The people in West Danby would like the Community Council to lease this for the West Danby youth . As the Community Council cannot lease this they would like the t own to consider doing this . Mr . Murinchack also mentioned that ' t he Danby Pond is in very poor condition and another year the installation of a public pool might be considered . J ohn Myers asked if there were any monies left over after paying t he expenses of the bicentennial celebration . Fred Thayer strongly objected to changing the zoning in the area where he lives from residential to commercial . Charles Bruce presented the board with plans for a planned development for their consideration . Joe Short mentioned that there was no deficit in funds for the bicentennial celebration as stated in the Danby Area News and t his should be corrected . J ohn Novaar stated that there is a body shop next door to his h ouse which is not in compliance with the Danby Zoning - Ordinance according to a ruling made by Justice Milton Todd , but seems to be operating anyway . He also stated that he would be willing to help out in the purchase of drapes for the Town Hall meeting room . COMMITTEE REPORTS : H ighway Report - Councilman Ralph Wilbur stated that the highway people have been cleaning ditches and patching roads where n ecessary . The radios Joe Hulbert checked on , are not satisfact - o ry . Only four people showed up to help with the Danby Clean up day . Town Board Meeting Minutes - May 9 , 1977 Page 3 Committee Reports continued : Insurance - Supervisor A . Francis Wright reported that the highway employees have a new health insurance plan . This new coverage went into affect March 28 , 1977 'and the old policy zko with Metropolitan has been canceled . The rates will be going up . Refuse Collection ans Disposal - The question was asked if there is a way to check the increases in refuse collector ' s fees to see if they were proper . This will be looked into . Youth - Because of a question raised about what was being done about cable T . V . in Danby , Councilman Paul Smith submitted an article to the Danby Area News explaining why no recent action has been taken . Zoning and Planning - Justice Floyd Dorn reported that all the municipalities are reviewing the state Enviromental Quality Review Act . In the Town of Danby there has been one public informational meeting held and onother will be held in West Danby on May 17 , 1977 . A public hearing will be held on this matter on May 24 , 1977 at 8 : 00 P . M . at the Danby Town Hall . Justice Milton Todd made the motion to authorize the clerk to post notice of the public hearing . The motion was seconded by Justice Floyd Dorn and carried by a -vote of five ayes and no noes . Fire - Councilman Ralph Wilbur reported that there is a very active group of volunteers in the fire department and they seem to be doing a good job . At the present time they are taking a course in first aid and will be able to help out in emergencies . Cemetaries - The mowing has been started but interupted by snow . OLD BUSINESS : Highway Superintendant's report - Joe Hulbert reported that he has obtained a price on a gas tank that he would like to purchase . The price is $ 650 . 00 . The highway men will install the tank themselves . Zoning Off icei` s report - Gordon Roberts submitted a written report . He stated that he presently is working on issuing house numbers . Also there will be several appeals to be heard in the near future . Appeals Board Chairman - The chairman was absent . Vice - Chairman 411 James Murinchack reported that three hearings were handled in April and there will be no hearings in May . He also mentioned that the chairman ' s term of office ends at the end of June . This resolution was drawn up by the town attorney . Mr . Wright read the resolution . Justice Milton Todd moved the resolution which was seconded by Councilman Paul Smith . Councilman Ralph Wilbur moved a resolution to authorize the supervisor to sign the necessary documents to have the Town of Danby join the Tompkins County T . V . •uCable Commission . The motion was seconded by Justice Milton Todd . RESOLUTION #9 AUTHORIZE THE TOWN OF DANBY SUPERVISOR TO SIGN THE NECESSARY DOCUMENTS TO HAVE THE TOWN JOIN THE TOMPKINS COUNTY TV CABLE COMMISSION Roll Call Vote : Wright - aye Wilbur aye Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . Councilman Ralph Wilbur made the motion to appoint Councilman Paul Smith to be the representative from the Town of Danby to serve as a member of the Tompkins County TV Cable Commission . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . The matter of the drapes for the meeting room was discussed and tabled until another price could be obtained from another source . Justice Milton Todd moved a resolution to amend General Fund Warrant #4 of the year 1977 . - The total of that Warrant will be changed to $ 5 , 869 . 34 . This change is necessary as claim #37 a phone bill was paid twice . Justice Floyd Dorn seconded the motion . RESOLUTION # 10 AMEND WARRANT #4 of 1977 FOR GENERAL 0 FUND TO A TOTAL OF $ 5 , 869 . 34 FROM $ 5 , 932 . 10 . THIS BEING . NECESSARY BECAUSE OF DUPLICATE PAYMENT OF A PHONE BILL . Town Board Meeting Minutes - May 9 , 1977 Page 5 NEW BUSINESS : Gary Evans of the Tompkins County Planning Office presented the Town Board with written recommendations of the Town of Danby Planning Board for the abandonment of certain town roads and I/ recommendations for changing of certain names for town roads and a proposed Official Road Map for the Town . The necessary procedure to make this the official town map are outlined in Section 270 - 273 of the Town Law of the State of New York . • There must be a public hearing prior to its adoption and where properties would become landlocked , the owners must be notified . Also names must be given to spur roads . This matter was discussed at length . Justice Milton Todd made the motion to have the supervisor set up a committee to name spur roads and change names of roads as needed and generally review the ' map and bring their recommendations back to the Town Board . Justice Floyd Dorn seconded the motion which was carried by a vote of five ayes and no noes . The supervisor appointed Councilman Ralph Wilbur , Justice Floyd Dorn , Fred Thayer and Joe Hulbert to serve as this committee . Justice Milton Todd moved a resolution to approve the youth budget submitted by Brad Corbitt for the year 1977 in the amount of $ 4 , 840 . 00 as amended . The resolution was seconded by Councilman Paul Smith . RESOLUTION # 11 APPROVE THE YOUTH BUDGET FOR 1977 IN THE AMOUNT OF $ 4 , 840 . 00 Roll Call Vote : Wright - aye Wilbur - aye Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . James Murinchack brought up the question of whether it is worth the money the town spends on the pond program or not . The pond is in sad condition . It serves outsiders who cannot ._ be charged for the use of the pond . If a pool were built , people could be charged . It was decided that this should be brought up to the Community Council . • The meeting to review equalization rates was set for May 26th at 8 : 00 P . M . at the County Assessment Office . . Supervisor A . Francis Wright made the motion to authorize all town officials to attend the June school held at Cornell University . The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . Expenses incurred to be paid by the town . A ball field for the West Danby Youth was discussed . The board discussed developing town land in the West Danby Water District . The supervisor will check with the town attorney and find out what problems might come up . Roy Casterline will be asked to check the boundaries of the town owned property . Town Board Meeting Minutes - May 9 , 1977 Page 6 New Business continued : The supervisor read the letter from Charles Bruce asking for rezoning of property for a planned development . This was discussed . Councilman Paul Smith made the motion to refer this application to the Danby Town Planning. General Fund Warrant ## 5 in the amount of $ 2196 . 32 was approved • to be paid . The motion was made by Justice Milton Todd and seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and noes . Highway Fund Warrant #5 in the amount of $ 4 , 215 . 20 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Justice Milton Todd and carried by a - vote of five ayes and no noes . West Danby Water District Warrant # 5 in the amount of $ 344 . 07 was approved to be paid . The motion was made by Justice Milton Todd and seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . The Supervisor ' s reports were approved as presented . The motion was made by Justice Floyd Dorn and seconded by Justice Milton Todd and carried by ' a vote of four ayes and no noes . Justice Milton Todd made the motion to adjourn the meeting at 10 : 30 P . M . Supervisor A . Francis Wright seconded the motion which was carried by a vote of five ayes and no noes .
