PRESENT: Supervisor- Liz Thomas 1St Deputy Supervisor- Nancy Zahler Board members- Michael Boggs, Rich Goldman Clerk- Carissa Parlato 2nd Deputy Supervisor- Michelle Wright Attorney for the Town- Mariette Geldenhuys Code Enforcement/Building Inspector- Tom Myers ABSENT: Board Member- John Hertzler OTHERS PRESENT: (none) OPENING STATEMENT BY SUPERVISOR THOMAS: The subject of this public hearing is the proposed Local Law to Amend Chapter 80 of the Code of the Town of Ulysses ("the Code"), which provides for the Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code, the New York State Energy Conservation Construction Code and the Property Maintenance Code of New York. MOTION TO OPEN HEARING: Ms. Zahler made a motion to open the hearing, seconded by Mr. Goldman and passed unanimously. CONTINUING REMARKS BY SUPERVISOR THOMAS: In 2007 the Town passed a local law to implement enforcement of the State Building and Fire Prevention Codes. It was amended in 2014 to provide the Town with more tools to address unsafe structures and properties with significant exterior maintenance violations, such as accumulation of junk on a property. This law adds additional provisions to make the enforcement of the local law more effective, particular in the event of multiple violations that continue for an extended period of time. Specifically, this local law adds references to the Property Maintenance Code of New York State, and other codes enforced by the Code Enforcement Officer, to clarify that violations of any of these codes are subject to the provisions of the local law. It explicitly states that no one may construct, alter, repair, move, remove, demolish, equip, occupy, use, or maintain any building, structure, or portion thereof in violation of any provision of the applicable codes. It changes the civil penalty provisions by increasing the amount from $200 to $250, and specifying that the minimum penalty is $100 for each offense. The previous local law already specifies that the penalty applies for each day or part thereof during which violations continue. Copies of the proposed Local law are available at the back of the room. The date of this public hearing was set by resolution of the Town Board on June 9, 2016 and a notice of this hearing was published in the Ithaca Journal on June 22, 2016. The purpose of this public hearing is to afford the general public an opportunity to make statements and comments about the Local Law. The hearing will remain open until all members of the public who are present at the hearing have been given an opportunity to make statements or comments TOWN BOARD MEETING June 28, 2016 CLOSING THE HEARING: Ms. Thomas made a motion to close the hearing at 6:45 pm, seconded by Mr. Goldman and passed unanimously.
