HomeMy WebLinkAbout1977-01-11 TOWN OF DANBY TOWN BOARD MEETING MINUTES January 11 , 1977 The regular meeting of the Danby Town Board was called to order at 8 : 00 P . M . at the Danby Town Hall , 1830 Danby Road , Town of Danby , County of Tompkins , and State of New York on January 11 , 1977 . Board members present : Supervisor A . Francis Wright Councilman Paul Smith • Justice Milton Todd Justice Floyd Dorn Board member absent : Councilman Ralph Wilbur • Others present : Moses Peter , Edward Slights and William Downes . The minutes of the December 13 , 1976 meeting of the board were approved as presented . The motion was made by Justice Milton Todd and seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . COMMUNICATIONS : 1 . A letter from the State Board of Equalization and Assessment concerning Business Investment Exemption Law . 2 . A letter from the Town of Ithaca concerning sales tax apportionment . 3 . A letter from the New York State Department of Enviromental Conservation concerning SEQR . 4 . A letter from Frank R . Liguori , Tompkins County Department of Planning , concerning NYS Enviromental Quality Review Act SEQR . 5 . A letter from the State Board of Equalization and Assessment concerning public hearings regarding the 1977 proposed agricultural factors for computing Agricultural Value Assessment Ceilings . 6 . A letter from NYS Department of Transportation concerning a private airport in Danby . 7 . A letter from Moses Peter concerned with the proposed • amendments to the Danby Zoning Ordinance . 8 . A letter from George Clarkson concerning Planning and Zoning . • 9 . Minutes of the meeting of the Board of Zoning Appeals of the Town of Danby held December 8 , 1976 . PRIVILEGE OF THE FLOOR : Councilman Paul Smith asked who polices snowmobiles and is there a map showing where snowmobiles are allowed ? This matter was discussed . It was noted that there are maps and the conservation officer has authority over the snowmobiles . The status of the TV Cable Franchise was discussed . The complaint procedure has not been resolved . Town Board Meeting Minutes - January 11 , 1977 Page 2 Privilege of the Floor Continued : Justice Milton Todd stated that the applications for dog licenses have n ot been received in West Danby . The clerk will give him applications t o leave at the Post Office and store . He reported on justice business for 1976 . Justice Floyd Dorn read his report of business for 1976 . Moses Peter asked if there will be another public heating on the • proposed zoning ordinance . He stated that the Town Board should ✓ eto the revised ordinance and the job of revising the ordinace should be completely redone . • Health insurance for the highway employees was discussed at length . B ill Downes a representative from the Carey McKinney Insurance Agency told the board what was availalbe through .. the agency . Cost o f this is very close to the coverage offered by the state . A lengthy discussion followed . The plan Mr . Downes offered can become effective in February and includes a small life insurance policy . It was noted that the town cannot pay for life insurance . If the h ighway employees choose to take this policy they will have to pay for the life insurance put the town will pay the entire health insurance premium . Justice Milton Todd made the motion that the e ntire insurance program of the town be reviewed by Bill Downes . The motion was seconded - by Councilman Paul Smith and carried by a ✓ ote of four ayes and no noes . A meeting will be held January20 , 1977 at the Town Hall at 8 : 00P . M . with the highway employees and t he Town Board and Bill Downes to go over the health insurnace and hear any recommendations Mr . Downes has for other town insurance . Supervisor A . Francis Wright reported that Joe Hulbert has Motorola coming from Syracuse to see what they can do for the highway people in the way of radio equipment . The supervisor reported on the state of town business . He gave the balances of the town accounts at the end of 1976 . He mentioned the case of Maycumber which is still pending . OLD BUSINESS : Councilman Paul Smith reported on the County TV Cable task force which is working for a more uniform franchise for the towns , city and villages of Tompkins County . NEW BUSINESS : Supervisor A . Francis Wright said that the town must act on the Business Exemption Law but before they do3this should be discussed w ith the town attorney . After a discussion of whether the .sales tax should be included in the town budget , it was decided that more information is needed to make a decision . The New York State Enviromental Conservation deal was discussed as it is incorporated in the revised zoning ordinance . It was decided that a _ meeting with State Assemblyman Gary Lee should be set up . A copy - of the letter concerning the airport in the Town of Danby will be sent to Charles Currey and to Dick Thaler . Town Board Meeting Minutes - January 11 , 1977 Page 3 The proposed revisions to the Town of Danby Zoning Ordinance were discussed at length . It was decided that no action would be taken until after the meeting with the planning board . The following appointments for 1977 were recommended : Water District II Clerk , Mary Casterline at a salary of $ 500 . 00 per year ; Deputy Supervisor , Onalee Wright at a salary of $ 1800 . 00 per year , Roy Casterline , Water Treatment Operator at a salary of $ 2 , 000 . 00 per year to be paid bi - weekly ; Gordon Roberts , Zoning Officer at III $ 1500 . 00 per year paid quarterly ; Frnacis Carrier , Town Constable at an annual salary of $ 50 . 00 ; Dianne VandeBogart , Town Historian at an annual salary of $ 100 . 00 ; Edward Slights , Custodian at a III salary of $ 1000 . 00 per year to be paid bi - weekly . Justice Milton Todd made the motion that the people recommended be appointed by the Town Board at the salaries set forth in the budget . The motion was seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . Justice Milton Todd made the motion to affirm the actions of the Town Supervisor in increasing the highway employees pay by 25Q an hour retroactive to May 1 , 1976 per the CSEA contract , and increase the pay 17Q per hour more starting January 1 , 1977 . The motion was seconded by Councilman Paul Smith and carried by a vote of four ayes and no noes . Justice Milton Todd made the motion that the Tompkins County Trust Company be named the official bank of the town . The motion was seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . Justice Milton Todd made the motion that Thaler & Thaler be named the Town ' s legal counsel . Councilman Paul Smith seconded the motion which was carried by a vote of four ayes and no noes . Justice Floyd Dorn made the motion to name the Ithaca Journal as the official newspaper of the Town of Danby . Councilman Paul Smith seconded the motion which was carriedby a vote of four ayes and no noes . Supervisor A . Francis Wright moved a resolution to authorize ,the Supervisor to invest idle funds for 1977 . The motion was seconded by Justice Milton Todd . III RESOLUTION # 1 AUTHORIZE THE SUPERVISOR TO INVEST IDLE FUNDS FOR 19 ,7.7 • Roll call vote : Wright - aye , Smith - aye , Todd - aye , Dorn - aye . Carried by a vote of four ayes and no noes . Justice Milton Todd made the motion to set the mileage reimbursement fee for the Town of Danby at 15Q per mile . The motion was seconded by Councilman Paul Smith and carried by a vote of four ayes and no noes . General Fund Warrant # 1 in the amount of $ 401 . 67 was approved to be paid . Councilman Paul Smith made the motion which was seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . Highway Fund Warrant # 1 in the amount of $ 1 , 127 . 78 was approved to be paid . The motion was made by Justice Floyd Dorn and seconded by Councilman Paul Smith and carried by a vote of four ayes and no noes . Smith made the motion which was seconded by Justice Floyd Dorn and carried by a vote of three ayes and no noes . The meeting adjourned at 11 : 00 P .
