Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York with Supervisor Williams presiding. Members present: Supervisor, Thomas A. Williams Councilman, David J. Linda Burghardt informed the Board she was a volunteer, and not a spokesperson, with “New York Citizens Audit”, which is a “citizen’s group organized for the purpose of performing an open-source audit of the New York State Board of Elections, to ensure our elections are valid”. She provided the Board with summary sheets prepared by the group regarding New York’s 2020 and 2022 General Elections and provided information on the group’s findings regarding deficiencies and apparent violations of NYS Election Law. She stated that the group felt the NYS Election Database needs to have an audit as it has never been audited by an outside source. At the end of her presentation, Ms. Burghardt asked for the Town Board’s support in signing/adopting a resolution supporting an audit of the NYS Board of Elections regarding voter registration. She explained that the resolution was supported by eleven towns in Broome County and by four municipalities in Cortland County. Supervisor Willaims thanked Ms. Burghardt for the presentation and indicated that the Board would look at the proposed resolution and discuss it at their next meeting. Councilman Leach made a motion, seconded by Councilman Guido, to receive and file correspondence from Charter Communications, dated December 28, 2023, regarding programming services. All voting aye, the motion was carried. Supervisor Williams offered privilege of the floor to Jennifer Hillman. Jennifer Hillman, Emergency Preparedness Coordinator at the Cortland County Health Department (CCHD), was in attendance to discuss the proposed Memorandum of Agreement (MOA) between the CCHD and the Town for the “Operation of Closed Points of Dispensing”. She explained that the proposal was first presented to the Town in the Spring 2023; no action was taken. Ms. Hillman explained that the County’s resolution authorizing the agreement (adopted by the County Legislature August 25, 2022) would be in place for 5 years and will expire December 31, 2027. If the Board was in favor of the agreement, the MOA would first be signed by the County Administrator and returned to the Town to be signed. She explained that the purpose of the agreement was for the operation of a closed point of dispensing (POD) clinic under the management of CCHD and the Town during public health emergencies. The agreement would allow CCHD to provide the Town with medical countermeasures to provide to employees and family members instead of going to an open POD. The CCHD would provide materials to the Town to be handed out to employees , which would help relieve the burden on the CCHD during an emergency and would help the Town as they know their employees/families are getting the supplies they need and are not waiting in line. Ms. Hillman explained that if the Town opted into the agreement the County would provide training to the Town. Supervisor Williams recalled that the Board discussed the agreement in the past and was generally in favor of it. He asked if there would be environmental issues/needs such as refrigeration. Councilman Leach asked if the Town would have to manage inventory and provide manpower and asked why the Cortlandville Fire Department (CVFD) was not doing this. He also commented on the CCHD covid vaccination clinic at SUNY Cortland during the pandemic, which he stated was professionally run and appreciated. Ms. Hillman explained that the CVFD has their own agreement with the County for the closed POD; the Town would have its own agreement as it was for town employees and their families. The CCHD would provide the Town with the product during a public emergency (such as for masks or pills). If there was anything that would prohibit the Town from storing materials, there would be a conversation. JANUARY 3, 2024 TOWN BOARD MEETING PAGE 4 RESOLUTION #05 AUTHORIZE SUPERVISOR TO ENTER INTO THE MEMORANDUM OF AGREEMENT BETWEEN CORTLAND COUNTY HEALTH DEPARTMENT AND THE TOWN OF CORTLANDVILLE FOR THE OPERATION OF CLOSED POINTS OF DISPENSING (POD) Motion by Councilman Leach Seconded by Councilman Donlick VOTES: AYE – Williams, Donlick, Guido, Leach, Reisweber NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to execute the Memorandum of Agreement between the Cortland County Health Department (“CCHD”) and the Town of Cortlandville (“Town”) for the operation of a closed point of dispensing (POD) clinic(s) under the joint management of the CCHD and the Town that will meet the needs of the population served by CCHD and the Town during public health emergencies, and it is further RESOLVED, this agreement shall be in effect upon signing by the Cortland County Administrator and the Cortlandville Town Supervisor until December 31, 2027. Under new business Town Clerk Rocco-Petrella welcomed Councilman Reisweber as the newest member of the Town Board. She informed those in attendance that the 2024 Cortlandville Town/County tax bills and 4th Quarter Water/Sewer bills were mailed on December 29, 2023. Bills are due by January 31, 2024 without penalty. She also requested the Board receive and file the Supervisor’s monthly report for the month of November 2023, which was previously provided to the Board but not on the agenda. Councilman Donlick made a motion, seconded by Councilman Reisweber, to receive and file the Supervisor’s monthly report for the month of November 2023. All voting aye, the motion was carried. Attorney DelVecchio reported: GLSC Planning & Feasibility Study (ESD Grant #135,435): Attorney DelVecchio recalled that at the last meeting the Board received and filed the proposals solicited from the RFP for an updated Feasibility Study for Gutchess Lumber Sports Complex (GLSC). The Town received a 50/50 matching grant from NYS ESD to help pay for the updated study, however the Town initially expected the study to cost more than the proposals came in at, which was $28,500 for the lowest bidder (plus up to $5,000 in travel reimbursement). He suggested the Board ask Thoma Development if the Town could request ESD fund the entire amount as it was less than the total grant award. The Board agreed to ask Thoma Development to request the full grant amount from ESD before moving forward with the award of the proposal for the study. Gutchess Lumber Sports Complex – Phase 2 Construction of Concessions Building: Attorney DelVecchio reported that a preliminary meeting was held between the Town and the contractor for the construction of the concessions building at GLSC. The process would start in early to mid-February. There will be some necessary coordination between the Town and the contractor; the best thing to do was to keep the Board abreast of obligations and to make sure that the work is done according to the law and to get reimbursed by the State for the grant that was awarded for Phase 2. Town Board reports: Councilman Donlick asked for an update regarding the recent request for a reduction of speed limit (Highland Road). Supervisor Williams explained that a petition with over 50% of the people residing on the road, along with the new form adopted by the Town Board, must be presented to the Town for consideration. JANUARY 3, 2024 TOWN BOARD MEETING PAGE 5 Councilman Leach asked if the Town could request a reduction of speed limit on East River Road, a County Road, between US Route 11 past Loring Crossing to the Town of Cortlandville/Town of Homer line (near Parks Road). Supervisor Williams stated that the Town can encourage the County to review the speed limit and consider an appropriate reduction. RESOLUTION #06 REQUEST THE CORTLAND COUNTY HIGHWAY SUPERINTENDENT REVIEW THE POSTED SPEED LIMIT ON EAST RIVER ROAD, BETWEEN US ROUTE 11 AND THE TOWN OF CORTLANDVILLE/TOWN OF HOMER LINE, AND REQUEST CONSIDERATION FOR AN APPROPRIATE REDUCTION IN THE SPEED LIMIT Motion by Councilman Leach Seconded by Councilman Donlick VOTES: AYE – Williams, Donlick, Guido, Leach, Reisweber NAY – 0 ADOPTED BE IT RESOLVED, the Town Board hereby requests the Cortland County Highway Superintendent review the posted speed limit on East River Road, a County Road located in the Town of Cortlandville, between US Route 11, past Loring Crossing, to the Town of Cortlandville/Town of Homer line, and request consideration for an appropriate reduction in speed limit, and it is further RESOLVED, the Town Clerk is hereby directed to provide a certified resolution to the Cortland County Highway Superintendent and the Chair of the Cortland County Legislature. Supervisor Williams reported: Supervisor Williams welcomed Councilman Reisweber to the Town Board. He also announced that he was happy to be back in the office after his recent back surgery. Transfer of Funds for GLSC: Supervisor Williams stated that the Town would soon be incurring expenses associated with the construction of the concessions building for GLSC. He requested the Board authorize the transfer of $100,000 from excess sales tax revenue to the HG capital project account for the GLSC. He explained that when the Town receives the grant funds (after the completion of the project) the funds could be reimbursed. RESOLUTION #07 AMEND BUDGET AND AUTHORIZE TRANSFER OF FUNDS FROM GENERAL FUND B TO THE HG CAPITAL PROJECT FUND FOR GUTCHESS LUMBER PARK DEVELOPMENT – PHASE 2 CONSTRUCTION OF CONCESSIONS BUILDING Motion by Councilman Guido Seconded by Councilman Leach VOTES: AYE – Williams, Donlick, Guido, Leach, Reisweber NAY – 0 ADOPTED BE IT RESOLVED, the Town Board hereby authorizes and directs the Supervisor the amend the 2024 Budget and transfer funds from General Fund B (B1120 – Non property tax) to the HG Capital Project fund (HG201) to be used expenditures for the Gutchess Lumber Park Development – Phase 2 Construction of Concessions Building. Proposed Dog Park: Supervisor Williams informed the Board that the Dog Park Committee would like to come to a future board meeting and explain their vision for a dog park to be located on Town property on Fairview Drive. The proposed parcel is located next to the Cortland County airport and is used for stormwater management purposes. Supervisor Williams stated that the Town mows the JANUARY 3, 2024 TOWN BOARD MEETING PAGE 6 property which costs thousands of dollars per year. A dog park was suggested for the site. Councilman Donlick suggested the committee investigate the availability of grant funds for such a project from big box stores. Eliminate Second Deputy Town Supervisor: Supervisor Williams explained that when he became Town Supervisor, he requested the appointment of two Deputy Town Supervisors, and he appointed Councilman Guido and former Councilman Cobb to the positions. The salary provided for one Deputy Supervisor was split in half and provided to each Deputy. Deputy Supervisor Guido has since retired from his full-time career and Deputy Supervisor Cobb’s term expired and he did not run for re-election. Supervisor Williams requested the Board eliminate the second Deputy Supervisor position, authorize the salary be combined, and that it be provided to Deputy Supervisor Guido. RESOLUTION #08 ELIMINATE THE SECOND DEPUTY SUPERVISOR POSITION AND AUTHORIZE THE SALARY OF DEPUTY SUPERVISOR, JEFFREY D. GUIDO BE $10,721.74 AS PROVIDED FOR IN THE 2024 TOWN BUDGET Motion by Councilman Reisweber Seconded by Councilman Williams VOTES: AYE – Williams, Donlick, Leach, Reisweber NAY – 0 ABSTAIN – Guido ADOPTED BE IT RESOLVED, the Town Board does hereby eliminate the Second Deputy Supervisor position, established by Town Board Resolution #12 of 2020, adopted January 8, 2020, as there is no longer a need to split the responsibility, and it is further RESOLVED, the Town Board hereby authorizes a salary of $10,721.74 for Deputy Supervisor, Jeffrey D. Guido as provided for in the 2024 Town Budget. At this time in the meeting, the Board proceeded with the new business items. Regarding the adoption of the 2024 contracts, Councilman Donlick commented on the contract between the City of Cortland Youth Bureau and the Town which increased from the 2023 requested contract. He stated that he was for promoting youth development but found issue with the items proposed to be funded in the contract, namely for the purchase of a new truck which he stated should come from the City’s operating budget. Councilman Donlick asked if the City could revise the contract and present it differently and asked that they provide information as to what programs are being funded and how many Town residents are participating in the programs. Councilman Leach stated that in the past funding was requested for Wickwire Pool. He was also interested in knowing how many Town residents were being served. Supervisor Williams explained that prior to his term in office the Town’s contract with the City was a set dollar amount for recreational services. Instead, he requested the Town be provided with a list of items that were funded with the Town’s contract money to show what it was funding. He indicated that he spoke with the Recreation Director at the time, who was now the Town’s Recreation Director, and was provided with estimates that about 25% of the children involved in the programs were Cortlandville residents. The Board suggested the contract be tabled to allow Supervisor Williams to get more information and an itemized list of what the funding would support. Also under contracts, Supervisor Williams requested the Board table action on the CHA Consulting, Inc. contract for engineering services. He indicated that the Town has a separate contract with CHA for the South Hill Dump. There was a brief discussion regarding the contract with Plan First Technologies and the email migration project, which Town Clerk Rocco-Petrella indicated would be discussed as a separate agenda item. RESOLUTION #28 APPROVE PROPOSAL FROM PLAN FIRST TECHNOLOGIES TO COMPLETE AN EMAIL MIGRATION PROJECT FOR THE TOWN OF CORTLANDVILLE Motion by Councilman Leach Seconded by Councilman Guido VOTES: AYE – Williams, Donlick, Guido, Leach, Reisweber NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby approve the proposal from Plan First Technologies to complete an email migration project for the Town of Cortlandville, to migrate the Town’s email from Google to Microsoft Outlook, for a cost not to exceed $9,075.00. Attorney DelVecchio explained the final agenda item to the Board regarding a proposed resolution pertaining to the State standard building code for places of public assembly. He explained that CEO Campbell notified him that while conducting fire and safety building inspections (for places of public assembly) she learned that the NYS Department of Labor (DOL) had also been conducting inspections in the last few months and charging fees to the businesses. Attorney DelVecchio researched the matter and learned that the NYS Legislature passed legislation allowing the DOL to conduct building inspections on commercial buildings that have larger occupancy (such as the Route 281 bowling alley). However, the Town has a code enforcement officer that conducts the fire and safety inspections and charges fees for the inspection. Attorney DelVecchio researched the law further and learned the Town can adopt a resolution to assume full responsibility of the inspections; a certified resolution must be sent to the DOL to stop future inspections by the DOL. As a former code enforcement officer, Supervisor Williams commented on a state law relative to asbestos and asbestos abatement, which is not in the building code or heath code. He wanted it to be clear that the DOL is the only department that can inspect asbestos remediation and that the proposed resolution does not apply to inspections. Attorney DelVecchio explained that the resolution specifically targets the town’s local codes and NYS Building Code; the resolution does not pertain to asbestos. Councilman Donlick asked what the number of people was for a place to be considered a public assembly, to which Attorney DelVecchio explained it was for one hundred people. JANUARY 3, 2024 TOWN BOARD MEETING PAGE 13 RESOLUTION #29 RESOLUTION TO ASSUME FULL RESPONSIBILITY FOR ENFORCING THE PROVISIONS OF ARTICLE 17 OF 12 NYCRR 36, REGARDING THE STATE STANDARD BUILDING CODE FOR PLACES OF PUBLIC ASSEMBLY Motion by Councilman Leach Seconded by Councilman Donlick VOTES: AYE – Williams, Donlick, Guido, Leach, Reisweber NAY – 0 ADOPTED WHEREAS, the Industry Inspection Bureau of the New York State Department of Labor enforces regulations for the protection of the public in areas of public assembly with a capacity of 100 or more; and WHEREAS, Section 472 of the Labor Law provides that any town having a department, board or officer charged with the enforcement of building laws or ordinances, which files with the commissioner of labor a duly certified copy of a Town Board resolution assuming full responsibility for enforcing the provisions of this article and the rules adopted thereunder, shall have the powers of the commissioner of labor enforcing the provisions of this article and the rules adopted thereunder; NOW, THEREFORE, BE IT RESOLVED, pursuant to Section 472 of Article 17 of 12 NYCRR 36, the Town of Cortlandville by this resolution of the Town Board hereby assumes full responsibility for enforcing the provision of this Article and the Rules adopted thereunder; and IT IS FURTHER RESOLVED, that the Town Clerk of the Town of Cortlandville shall file a duly certified copy of this Resolution with the Commissioner of Labor forthwith.
