Cable Franchise submitted by Ceracche Television Corporation at the Danby Elementary School , June 14 , 1976 at 7 : 00 P . M . Notice of the public hearing was duly advertised in the Ithaca Journal in the May 24th and June 4th issues as • shown by affidavit presented to the board . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith Justice Milton Todd Justice Floyd Dorn Others present : Moses Peter , Edward Slights , Ernest Cole , Bradley Corbitt , Dan Hoffman , Roy Casterline , John Wilkinson , Mr . Ceracche , Attorney Richard Thaler , James Murinchack , Mr . & Mrs . Wright , Henry Lower , Mr . & Mrs . Shippos , Mr . Jackson , Rick Dobson , Rick Jenson The proposed franchise submitted by Ceracche was read to the public . This included several changes suggested by the Town Attorney . Several parts of this franchise were discussed by the attorney and Mr . Ceracche . The cost of this service and how the cost is computed was discussed at length . A vote was taken . Everyone present voted in favor of the T . V . Cable Franchise . There were no objections . Public hearing was adjourned at 8 : 55 P . M . M . at the Danby Elementary School , Gunderman Road , Town of Danby , Tompkins County , New York , on June 14 , 1976 Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith Justice Milton Todd Justice Floyd Dorn Others present : Moses Peter , Edward Slights , Ernest Cole , Bradley Corbitt , Dan Hoffman , Roy Casterline , John Wilkinson , Attorney Richard Thaler , James Murinchack , Mr . & Mrs . Wright , Henry Lower , Mr . & Mrs . Shippos , Mr . Jackson , Rick Dobson , Rick Jenson . Justice Milton Todd made the motion to approve the minutes of the May 10 , 1976 meeting as presented . The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter inviting the Town of Danby to attend the Bicentennial activities of the Town of Caroline . 2 . A letter from Ernest Cole stating the concerns of the Town Planning Board in connection with recent decisions of the Zoning Board of Appeals . 3 . A letter from Histroic Ithaca concerned with the grant of $ 1 , 000 . 00 to be used in the renovation of the Danby Town Hall . 4 . A note from Shirley Wright stating that trucks may cross her property to clean up the Bell property : 5 . A letter was received from Consolidated Gas Corporation concerning a work permit for them to cross Nelson Road in the Town of Danby . 6 . A letter from the Town of Ithaca Council of Pet Education Inc . telling of the seminar they are sponsoring for Dog Wardens . 7 . A letter from Mr . Schwan concerning the sales tax owed to the Towns and Villages by the City of Ithaca . 8 . A letter from the Tompkins County Department of Social Services concerning work relief program . 9 . A letter from the Tompkins County Municipal Officials Association concerned with the next quarterly meeting to be . held June 23 , 1976 at the Sylvan Hills Restaurant . 10 . The minutes of the May 11 , 1976 Planning Board Meeting . 11 . Minutes of the Zoning Board of Appeals meeting of May 12 , 1976 . 12 . A letter from Bradley Corbitt concerning a federally sponsored program whereby the Community Council can hire a college student to help with the summer recreation program at 20% of the cost . Town Board Meeting Minutes - June 14 , 1976 Page 2 PRIVILEGE OF THE FLOOR : Councilman Ralph Wilbur stated that he felt the Town of Danby should take the sales tax money due them in a lump sum and not apply this to the County tax as is the current policy . This is done by other Towns and Villages . Justice Floyd Dorn stated that business is brisk and he needs help . Asked if he is authorized to hire a clerk ? Moses Peter discussed County Government and how it operates in reference to the assessment office in particular . Can the towns do their own assessing rather than have the county do this ? This matter was discussed at length . Mr . Jackson from West Danby stated that Brown Road where he lives is in bad repair . He feels that this road should have been paved many years ago . Trees are hanging in the road in one area and water runs down the middle of the road in another . Mr . Lowery said that the road needed to be honed down . This matter was discussed at length . Joseph Hulbert the highway superintendent will be notified of this problem . No paving is being done in the town this year as the cost of the oil is so high . Councilman Ralph Wilbur asked about the insurance in connection with the work permit of Consolidated Gas Corporation . This must be taken care of before work begins . The Maycumber case that is pending and the case of the Airport on Gunderman Road were discussed with the town attorney . Attorney Richard Thaler asked that Milton Todd set up a meeting with him one day next week to go over the CSEA contract . COMMITTEE REPORTS : Highway report - Councilman Ralph Wilbur stated that the Highway Superintendent presumably attended the Cornell school and he has not been able to meet with him . West Danby Water District - The district manager has inspected the pump and feels it should be pulled and rebuilt . This will have to be included in the budget for next year . Insurance - No report . Refuse Collection and Disposal - No report . Youth - June 26 , 1976 is the clean up day for the town . The Town Highway Department will be on vacation and will not be able to help . Zoning and Planning - Mr . Campbell who owns the grange hall in West Danby , after appearing in court , agreed to remove all additions he has made to the building so that he will comply with the town 410 law . Mrs . Evelien is coming to court with a complaint about the Maycumbers Fire - Nothing . Cemetaries - All taken care of . ' Bicentennial Committee - The Town Board will be responsible for a program on July 17th . Supervisor A . V . Cable Franchise - Justice Milton Todd made the motion to authorize the supervisor to sign the franchise after several revisions are made and it meets with the approval of Attorney Richard Thaler . The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . OLD BUSINESS : ® Highway Superintendent's report - Absent , no report . Zoning Offices report - Written report submitted . Appeals Board Chairman ' s report - Moses Peter stated that his term of office as a member of the Appeals Board will end June 30th . He has served seven years and is presently chairman of the board . He has enjoyed his term of office . John Wilkinson Vice - Chairman of the board should be appointed chairman and the Town Board will then need to appoint a new member of the board . Supervisor A . Francis Wright moved the following resolution which was seconded by Councilman Ralph Wilbur . RESOLUTION # 21 THANK YOU MOSES PETER FOR SEVEN YEARS OF SERVICE TO THE TOWN OF DANBY AS A MEMBER OF THE BOARD OF ZONING APPEALS Roll Call Vote : Wright - aye Wilbur - aye Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . Supervisor A . Francis Wright made the motion that John Wilkinson be appointed chairman of the Board of Zoning Appeals . The motion was seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . It was noted that a person is being considered by the board to fill the vacancy on the Board of Zoning Appeals . This will be taken up at the July board meeting . Planning Board Chairman - Ernest Cole stated that a Planning Board member will attend all Appeals Board hearings . The zoning ordinance. is almost completed . A meeting should be set up with the Town Board and the Board of Zoning Appeals to go over this before a hearing date is set . This should be set up for two / consecutive evenings . ' The meeting will be held at the County Planning Office . After some ) discussion the" ! 1•9th and 20th . of ' July weretthe dates set for the meeting , the be 8 : 00 P . M . A resolution was passed by the Town Board at their May meeting to use the next allotment of revenue sharing funds to purchase office furniture for the new offices at the Town Hall : Since that ' timec Supervisor A . Francis Wright has found that these funds cannot be used for furniture as this is not a priority need . The parking area at the Town Hall is considered a priority need and the funds could be used for this . This was discussed at length . The motion was made by Justice Milton Todd to recind Resolution # 20 setting up Revenue Sharing funds in the amount of $ 6 , 746 . 00 to purchase furniture for the town hall . Councilman Ralph Wilbur seconded the motion which was carried by a vote of fivee ' ayes and no noes . Town Board Meeting Minutes - June 14 , 1976 Page 4 Possibly money from the contingency fund can be used for the purchase o f furniture . After some discussion Councilman Paul Smith moved the following resolution which was seconded by Justice Floyd Dorn . RESOLUTION # 22 FEDERAL REVENUE SHARING FUNDS IN THE AMOUNT OF $ 6 , 746 . 00 BE USED , TO CONSTRUCT A PARKING AREA ADJACENT TO THE TOWN HALL . Roll Call Vote : Wright - aye Wilbur - aye 411 Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . Two bids were received for cleaning up the Bell property in West Danby . These bids were opened . The first from Carpenters Backhoe and Dozer Service was in the amount of $ 2 , 400 . 00 . The second was from Roy Casterline in the amount of $ 1 , 475 . 00 . Councilman Ralph Wilbur made the motion to accept the low bid submitted by Roy Casterline . The motion was seconded by Justice Floyd Dorn and carried by a vote o f five ayes and no noes . Justice Milton Todd made the motion to authorize the Supervisor to inact the contract for cleaning up the Bell property . The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . NEW BUSINESS : A resolution was moved by Supervisor A . Francis Wright to thank Historic Ithaca for the $ 1 , 000 . 00 donated towards the renovation o f the town hall . Councilman Paul Smith seconded the motion . RESOLUTION # 23 THANK YOU FOR THE DONATION OF $ 1 , 000 . 00 FOR THE TOWN HALL RENOVATION . Roll Call Vote : Wright - aye . Wilbur - aye Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . Councilman Ralph Wilbur made the motion to write a letter to the county representative asking him to advise the board of the proceedure to be followed to draw the town ' s share of the sales tax directly and ask him to report to the board at their July meeting . Councilman Paul Smith seconded the motion which was carried by a vote of five ayes and no noes . The work relief program was discussed . It was decided that the Supervisor would write a letter for more information . Republican Committee Chairman Wendell Bryce approved a list of election inspectors fromthe republican party to serve a one year term . These are being presented to the town board for their approval and are as follows : District I ; Mrs . Mildred Weitzel , Adella Dorn , Rhoda Larson , Alternate Joan Barber ; District II ; Mrs . Merriam Crance , Helen Fairchild , Alternate Janice Todd . The motion was made by . Councilman Ralph Wilbur to appoint Town Board Meeting Minutes. June 14. , .1976 . . _ . . Page 5 New Business Continued : 1 , these people as election inspectors . The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . The motion was made by Justice Floyd Dorn that the Town Clerk be authorized to appoint election inspectors from the Democratic party to serve for one year . There is no local chairman and the County Chairman has been contacted and has not submitted any names . Justice Milton Todd seconded the motion which was carried • by a vote of five ayes and no noes . A letter was written to the Town Board asking for their support of a project af the Community Council where by under a Federally Sponsored program a college student can be hired for ten weeks and Community Council would only be responsible for 20 % of the cost . The Community Council budget cannot obligate this amount of funding . $ 240 . 00 is needed to support this project . Councilman Paul Smith made the motion to set aside $ 240 . 00 for this project . The motion was seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . A motion was made by Justice Milton Todd to transfer $ 240 . 00 from the contingency fund to the beautification fund . The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . Supervisor A . Francis Wright announced that the Town Hall will be finished and available for use after the 4th of July . II The Town Board decided that they would authorize payment for gas used by the trucks on Danby Clean Up Day . Milton Todd made the motion that Edgar Oltz be reappointed for a term of seven years as member of the Town of Danby Planning Board . The motion was seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . Bradley Corbitt invited the Town Board to attend the Community Council meeting to be held June 15 , 1976 as Mr Desrochers will be their and explain the new County Wide Program for Youth . It was suggested that someone from the assessment department attend a town board meeting and explain the methods used in property assessment . Supervisor A . Francis Wright stated that he will ask Tom Payne to attend for this purpose . General Fund Warrant #6 in the amount of $ 21 , 266 . 22 was approved to III be paid . The motion was made by Councilman Ralph Wilbur and seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . Highway Fund Warrant #6 in the amount of $ 1 , 289 . 25 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . West Danby Water District Warrant # 6 in the amount of $ 217 . 83 was approved to be paid . The motion was made by Justice Floyd Dorn and seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . Councilman Ralph Wilbur made the motion to accept the Supervisor ' s reports as presented .
