TOWN BOARD MINUTES
March 8 , 1976
The regular meeting of the Danby Town Board was called to order at
8 : 05 P . M . at the Danby Elementary School , Gunderman Road , Town of
Danby , Tompkins County , New York, on March 8 , 1976 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith

Others present : Gordon Roberts , Mary Casterline , Roy Casterline ,
Alfred Sebesta , Moses Peter , Ernest Cole , Edward Slights , James
Murinchack , Jimmie Miller , Rick Jenson Ithaca Journal reporter,
Justice Milton Todd made the motion to approve the minutes of the
February 9 , 1975 meeting as presented . The motion was seconded by
Councilman Paul Smith and carried by a vote of five ayes and no
noes .
COMMUNICATIONS :
1 . Agenda of the Tompkins County Board of Representatives
meeting of March 8 , 1976 .
2 . A letter from the Association of New York State Youth
Bureaus concerned with Governor Carey ' s proposed budget
that will substantially cut funds for local youth programs .
3 . A resolution from the Tompkins County Municipal Officials
Association relating to the Enviromental Quality Review Act .
4 . A notice of the quarterly meeting of the Tompkins County
Municipal Officials Association to be held March 17 , 1976 .
5 . A note from a property owner on Eastman Hill Road asking
to have the road scraped to his property .
6 . A letter from Bradley Corbitt concerned with the lease for
the Danby Pond swimming area .
7 . Minutes of the Town of Danby Planning Board meeting of
January 28 , 1976 . .
8 . Minutes of the special meeting of the West Danby Water
. Commissioners held February 18 , 1976 .
9 . Minutes of the meeting of the West Danby Water Commiss -
ioners held March 3 , 1976 .
PRIVILEGE OF THE FLOOR :
Councilman Paul Smith said that dogs had come into his barn and
killed his peacocks . The town should draw up a dog ordinance .
He, also felt that cars parking in the saftely lane on Route 96B
was illegal and something should be done about it .
Justice Milton Todd stated that the sheriff ' s office has been
ticketing�p~A'rked on 96B in the saftey lane but following through
is a long slow process .

Privilege of the floor continued :
Justice Floyd Dorn stated that complaints have been filed against
six dogs that have caused damage in the last month . This is a
real problem but there are no laws to enforce the confinement of
t hese dogs .
James Murinchack reported that the funds have been appropriated by
the Danby Community Council for a community sign board . The app -
roval of the Appeals Board is now needed . He asked if the stone
now by the Danby IGA with a plack concerning the " REDMEN " could be
moved to the location of the sign when it is installed . 411
Moses Peter commented on County Government as if affects the towns .
J immie Miller stated that the Tompkins County Board of Represent -
atives meeting was very general but he will answer questions if
their are any .
Supervisor A . Francis Wright made a statement concerning adverse
publicity concerning the recent town audit of town accounts published
by the newsimedia . He invited questions and the matter was discussed
at length .
COMMITTEE REPORTS :
Highway report - The ususal work is being done . There has been a
problem with the grader . A radio system for the Highway Department
was discussd . Joe Hulbert has checked prices on a CB system and
a system similar to what the county has . Joe would like to look
further before deciding on a system for Danby . This was discussed
at length . A light truck is needed . A truck has been . found that
can be purchased for $ 4 , 500 . 00 . This figure is negotiable . There
is a problem with the septic system at the town barns . The agree —
ment to spent Highway funds must be signed and sent to the county .
A meeting is needed with the Town Supervisor , Highway Committee and
Superintendent of Highways to discuss payroll .
West Danby Water District - No report .
Insurance - No report .
Refuse Collection and Disposal - No report .
Youth - The budget for 1977 is being made ready to submit to the
United Way for approval .
Zoning and Planning - Justice Floyd Dorn mentioned that parking

should be considered in drawing up the revised zoning ordinance .
Fire - Councilman Ralph Wilbur reported that the West Danby Fire
D istrict ha not paid their water bill . There is a problem about
using fire hydrants that needs to be straightenA out . When this
matter is cleared up they will pay the bill . Billing for justice
court will be brought up to date and the town will be billed
quarterly . The problem of getting the bunkers to keep the walks
cleared off in bad wheather is being worked on .

Committee Reports continued :
Bicentexia-1 Committee - Jimmie Miller reported that the date for the
celebration in the Town of Danby has been set for the week of July
11 -17 . The kick off will be an old fashion camp meeting followed by
a barbeque . Sporting events will take place and a play directed by
Joe Short called " Our Town " will be presented . Perhaps there will be
a parade and band concert and dedication of the renovated town hall .
T . V . Cable report - Al Sebesta reported that the application for the
extension of T . V . Cable service in the Town of Danby is ready for
• typing and should be in the mail by the next meeting . Councilman
Ralph Wilbur made the motion to authorize the supervisor to sign the
second application for T . V . Cable service for the entire Town of
Danby .
OLD BUSINESS :
Report of the Highway Superintendent - Superintendent absent , no report .
Zoning Officers report - A contract will be drawn up to have the Bell
property in West Danby cleaned up . The hearing on the airstrip on
Gunderman Road was discussed and mention was made of a Map of Ithaca
that shows an airstrip on Gunderman Road .
Appeals Board Chairman - Moses Peter said that things are running
smoothly . There will be two appeals heard before the board on March
10 , 1976 . One will be the sign for the Danby Community Council and
the other is the Lawn and Garden Store for James and Joanne Wilcox .
Mr . Peter stated that his term at a member of the Appeals Board will
expire at the end of June and he will not accept another term .
Planning Board Chairman - Ernest Cole reported that the Planning
Board is still meeting twice a month and are progressing slowly on
the zoning ordinance . Late in the spring they will be ready for a
joint meeting with the Town Board and Board of ' Zoning Appeals .
NEW BUSINESS :
The financing of the renovation of the town hall was discussed . The
total of the money spent so far and the funds that are available
were given to the board for their consideration and study . Possibly
some money will have to be borrowed . There have been problems in the
renovation of the town hall . Paul Smith reported that there are
three change orders .
1 ) Change order for the septic system pipes that had to be reset
at a cost of $ 715 . 00 .
2 ) The temporary ceiling will be removed and the old wood ceiling
will be used . This will change the insulation and possibly
the lights, the price to be negotiable .
3 ) The steel stairs will be put in instead of the wooden ones .
• There will be an executive session of the Town Board at the home of
the supervisor March 9 , 1976 at 8 : 00 P . M .
I/ Supervisor A . Francis Wright stated that a resolution was needed to
transfer funds to pay Social Security . The motion was made by
Councilman Paul Smith to transfer $ 2 , 300 . 00 from General Fund Account
A9030 . 8 to Highway Fund Account DS9030 . 8 to make funds available
to pay Social Security . The motion was seconded by Justice Milton
Todd .

Carried by a vote of five ayes and no noes .
A dog ordinace for the Town of Danby was discussed at length . An
o rdinancelis needed that can be enforced . A committee consisting 411
o f Justice Floyd Dorn and Councilman Paul Smith will get together
with the town attorney and develope an ordinance .
Cars pang in the saftley lane was discussed .
Moving the monument with the inscription about the Redmen ' s Club
will be looked into by Councilman Ralph Wilbur and James
Murinchack and they will report their findings to the board in
April atlitheir regular meeting . The town will make sure they
have the authority to move the stone .
General Fund Warrant #3 in the amount of $ 6 , 946 . 91 was approved to
be paid . The motion was made by Justice Milton Todd and seconded
by Justice Floyd Dorn and carried by a vote of five ayes and no noes .
Highway Fund Warrant #3 in the amount of $ 2 , 381 . 26 was approved to
be paid . ! The motion was made by Justice Floyd Dorn and seconded by
Justice Milton Todd and carried by a vote of five ayes and no noes .
West Danby Water District Warrant #3 in the amount of $456 . 61 was
approved to be paid . The motion was made by Justice Milton Todd
and seconded by Supervisor A . Francis Wright and carried by a vote
o f five ayes and no noes .
The supervisor ' s reports were approved as presented . The motion
was madeiby Justice Milton Todd and seconded by Justice Floyd
Dorn and carried by a vote of four ayes and no noes .
Supervisor A . Francis Wright declared the meeting adjourned at 10 : 20 P . M ,

A PETITION TO THE DANBY TOWN BOARD
We earnestly request the Danby Town Board to purchase the parcel
of land • immediately , south of the Town Hall if this can be done at a reasonable
price " Removal of the derelict house on the site would make the Town of Danby
more attractive and provide greatly needed additional parking facilities for the
Town Hall .
When restoring the historical Town Hall , the Town purchased
the property immediately to the north which has greatly improved the appearance
. of the Town Hall and the historical area in which it is located and at the same
time has provided parking facilities . Nov the Tcwn Hall needs additional parking
which the area to the South would provide very- nicely .

BOND ANTICIPATION NOTE RESOLUTION DATED MAY 8 ,
1978 FOR ISSUANCE AND SALE OF A NOTE OF THE TOWN
OF DANBY , TOMPKINS COUNTY , NEW YORK IN ANTICIPATION
OF THE SALE OF $ 5 , 000 . 00 SERIAL BONDS FOR THE PUR-
POSE OF PROVIDING FUNDS TO PURCHASE PROPERTY ,
RENOVATE AND CONSTRUCT THE THE TOWN HALL FOR
THE TOWN OF DANBY .
WHEREAS , The Town Board of the Town of Danby has heretofore
duly adopted a resolution authorizing a special election for the purpose
o f determining the proposition of issuing Town of Danby Bonds or Notes in
an amount not to exceed $ 47 , 000 . 00 for the purpose of constructing a new
Danby Town Hall or renovating the present structure which Resolution
authorizing the referendum was passed on June 9 , 1975 , and
WHEREAS , pursuant to notice duly published in the Ithaca Journal
the special election was held on July 5 , 1975 which resulted in the vote of a
majority of the eligible voters in the Town of Danby voting in favor of the
renovation of the present Danby Town Hall for an amount not to exceed $ 94 , 000 . 00 ,
plus interest on any Bonds issued , the total of which Bonds were to be
limited to the amount of $ 42 , 000 . 00 , and
WHEREAS , pursuant to said special election the Town Board of the
Town of Danby passed a Resolution dated April 12 , 1976 authorizing the renovation
o f the present Danby Town Hall for a sum not to exceed $ 94 , 000 . 00 of which
said sum the Resolution authorized the issuance of certain Serial Bonds not
to exceed $ 42 , 000 . 00 , and
WHEREAS , the Town Board of the Town of Danby passed a Resolution
authorizing a Bond Anticipation note in the amount of $ 25 , 000 . 00 for the
purpose of providing funds to purchase property , renovate and construct the
Town Hall for the Town of Danby on April 12 , 1976 and did issue said note
o n April 30 , 1976 , and
WHEREAS , the Town Board of the Town of Danby passed a Resolution
authorizing a Bond Anticipation Note int.: the amount of $ 30 , 000 . 00 for the
purpose of providing funds to purchase property , renovate and construct
the Town Hall for the Town of Danby on May 9 , 1977 and did issue said Note
o n April 30 , 1977 , and

WHEREAS , the Town Board of the Town of Danby desires now to
provide for the issuance of a form of Bond Anticipation Note in anticipation
of the sale of the aforesaid Bonds and other matters in connection therewith ;
be it this 8th day of May , 1978 ,
RESOLVED by the Town Board of the Town of Danby , Tompkins County ,
New York , as follows :
SECTION I : A BOND ANTICIPATION NOTE IN THE AMOUNT OF $ 5 , 000 . 00
SHALL BE ISSUED BY THE TOWN OF DANBY , TOMPKINS COUNTY , NEW YORK FOR THE PURPOSE
AFORESAID AND ANTICIPATION OF THE SALE OF SERIAL BONDS OF THIS TOWN IN THE
AMOUNT OF $ 5 , 000 . 00 AS AFORESAID HERETOFORE AUTHORIZED BY SAID RESOLUTION
ADOPTED AT A MEETING HELD APRIL 12 , 1976 WHICH RESOLUTION WAS ENTITLED
" BOND RESOLUTION OF THE TOWN OF DANBY , TOMPKINS COUNTY , NEW YORK' ADOPTED
APRIL 12 , 1976 AUTHORIZING THE ISSUANCE OF SPECIAL OBLIGATION BONDS OF THE TOWN
OF DANBY , TOMPKINS COUNTY , NEW YORK IN THE PRINCIPAL AMOUNT OF NOT TO EXCEED
$ 42 , 000 . 00 FOR THE PURPOSE OF PROVIDING FUNDS TO PURCHASE PROPERTY , CONSTRUCT
AND RENOVATE THE PRESENT DANBY TOWN HALL FOR AN ESTIMATED MAXIMUM COST OF
$ 94 , 000 . 00 .
SECTION 2 : Such note shall be dated April 30 , 1978 held such
later date as the Supervisor by his execution thereof will determine , will
mature on April 30 , 1979 , will bear interest at the rate of not exceeding 5%
per annum payable at maturity , will be payable as to both principal and
interest in lawful money of the United States of America , at the City of
Ithaca , County of Tompkins , New York , and will be signed in the name of the Town
of Danby by the Supervisor of said Town and by the Clerk and will be sealed
with the seal of said Town .
SECTION 3: The said Bond Anticipation Note will be substantially
the following terms , form and content , to wit :

UNITED STATES OF AMERICA , STATE OF NEW YORK ,
COUNTY OF TOMPKINS , TOWN OF DANBY , CAPITAL ,
NOTE , 1978
$ 5 , 000 . 00
The Town of Danby , Tompkins County , State of New York , hereby
acknowledges itself indebted and for value received , promises to pay to
the bearer of this note , or if it be registered , to the registered holder ,
pr . .

the sum of FIVE THOUSAND DOLLARS ( $ 5 , 000 . 00 ) on the 30th day of April ,
1979 together with interest thereon from the date hereof at the rate of
5% per annum , payable at maturity . Both principal of and interest on this
note will be paid in lawful money of the United States of America at
the office of the Town of Danby , Tompkins County , New York , or at the
option of the holder , at the Tompkins County Trust Company in the City
of Ithaca , New York .
At the request of the holder , the Town Supervisor shall convert
this note into a registered note by registering it in the name of the holder
in the books of the Town of Danby , kept in the office of such Town Supervisor ,
and endorsing a certificate of such registration thereon , after which both
principal of and interest on this note shall be payable only to the
registered holder , his legal representatives , successors or transferees ..
1 This note shall then be transferable only upon presentation to such Town
Supervisor with a written transfer of title and such Town Supervisor shall
thereupon register this note in the name of the transferee in his books and
shall endorse a certificate of such registration thereon . Such transfer
shall be dated and signed by the registered holder or his legal representatives ,
and it shall be duly acknowledged or proved , or in the alternative , the
signature thereto shall be certified as to its genuineness by an officer of a
bank or trust company located and authorized to do business in this State .
This note is issued pursuant to the provisions of resolutions
entitled " BOND RESOLUTION OF THE TOWN OF DANBY , TOMPKINS COUNTY , NEW YORK ,
ADOPTED APRIL 12 , 1976 AUTHORIZING THE ISSUANCE OF SPECIAL OBLIGATION BONDS
OF THE TOWN OF DANBY , TOMPKINS COUNTY , NEW YORK IN THE PRINCIPAL AMOUNT OF

the 9th day of May , 1977 and the 8th day of May , 1978 . The full faith
and credit of such Town are hereby irrevocably , pledged for the punctual
payment of the principal of and interest on this note according to its
terms .
IN WITNESS WHEREOF , the Town of Danby has caused this note to
be signed by its Supervisor and Town Clerk and its corporate seal to be
hereunto attached and attested by its Town Clerk , and this note to be
dated as of the 30th day of April , 1978 .

SECTION 4 : The faith and credit of said Town are hereby pledged
for the principal of and interest on such Bond Anticipation Note . Such Bond
Anticipation Note shall be paid from the proceeds derived from the sale of
said bonds or may be redeemed as provided by the Local Finance Law of, the State
of New York .
SECTION 5 : The Supervisor of the Town is hereby authorized to
sell such Bond Anticipation Ncte at private sale for not less than par and
accrued interest not exceeding the rate above specified , and the Supervisor
is authorized to deliver such Bond Anticipation Note to the purchaser upon payment of
the purchase price and accrued interest as above specified . The receipt of
the Supervisor shall be full acquittance to the purchaser who shall not be
obligated to see to the application of the purchase money .
SECTION 6 : This resolution shall take effect immediately .

the bearer of this Note , or if it be registered , to the registered holder ,
the sum of FIVE THOUSAND DOLLARS ( $ 5 , 000 . 00 ) on the 30th day of April ,
1978 , together with interest thereon from the date hereof at the rate of
five percent ( 5 % ) per annum , payable at maturity . Both principal of and
interest on this Note , will be paid in lawful money of the United States
of America , at the office of the Town of Danby , Tompkins County , New
York , or at the option of the holder , at the Tompkins County Trust Company ,
in the City of Ithaca , New York .
At the request of the holder , the Town Supervisor shall convert
this Note into a Registered Note , by registering it in the name of the holder
in the books of the Town of Danby , kept in the office of such Town Supervisor
and endorsing a certificate of such registration hereon , after which both
principal of and interest on this Note shall be payable only to the registered
holder , his legal representatives , successors or transerees . This note shall
then be transferrable only upon presentation to such Town Supervisor with a
written transfer of title and such Town Supervisor shall thereupon register
this Note in the name of the transferee on his books and shall endorse a
certificate of such registration thereon . Such transfer shall be dated and
signed by . the registered holder , or his legal representative , and it shall
be duly acknowledged or proved , or in the alternative , the signature thereto
shall be certified as to its genuineness by an officer of a bank or trust
company located and authorized to do business in this State .

WHEREAS , the Town Board of . the -Town of Danby has
heretofore duly adopted a resolution authorizing a special election
for the purpose of determining the propositionof issuing Town
of Danby Bonds or Notes in an amount not to exceed $47 , 000 . 00
for the purpose of constructing a new Danby Town Hall or reno -
vating the present structure . which Resolution authorizing the
referendum was passed on June 9 , 1975 , . and
WHEREAS , pursuant to notice duly published in the
Ithaca Journal the special election was held on Julyl5 , 1975
which resulted in the vote of a majority of the eligible voters
in the Town of Danby voting in favor of the renovation of the !-

now to provide for the issuance of a form of Bond Anticipation
Note in anticipation. of the sale of the aforesaid Bonds and other
matters in connection therewith ; be it this 12th day of April ,

the proceeds derived from the sale of said bonds or may be redeemed
as provided by the Local Finance Law of the State of New York .

for not less than par and armed interest not exceeding the rate
above specified , and the Supervisor is authorized to deliver

receipt of the Supervisor shall be full acquittance to the pure
chaser who shall not be obligated to see to the application of
the purchase money . .
