HomeMy WebLinkAbout1976-01-12 TOWN OF DANBY TOWN BOARD MINUTES January 12 , 1976 The regular meeting of the Danby Town Board was called to order at 8 : 05 P . M . at the Danby Elementary School , Gunderman Road , Town of Danby , Tompkins County , New York on January 12 , 1976 . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith • Justice Floyd Dorn Justice Milton Todd Others present : Ed Slights , Robert Snedden , Jim Murinchack , Joseph Hulbert , Gordon Roberts , Ernest Cole , Alfred Sebesta . Justice Milton Todd made the motion to approve the minutes of the December 8 , 1975 meeting as presented . The motion was seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter from the Tompkins County Personnel Department asking for payroll certifications not received . 2 . A letter from Albert Shepardson stating that he is interested in tearing down the house purchased by the town . 3 . A letter from the County of Tompkins Division of Assessment stating that according to law the town is liable for taxes on the recently purchased Van de Bogart property until the exemption is granted in June of 1976 . 4 . A letter from the Tompkins County Board of Representatives asking for input by the municipalities of their concerns on matters before the County Board . 5 . Agenda of the Tompkins County Board of Representatives meeting of December 8 , 1975 . 6 . Agenda of the Tompkins County Board of Representatives meeting of December 22 , 1975 . 7 . A letter from the Department of the Treasury concerned with the Gun Control Act of 1968 with a questionaire attached to be filled out by the town . 411 8 . A letter from the State of New York Department of Audit and Control concerned with the audit recently completed of the revenue sharing funds received by the town . 9 . A letter from Joyce Stafford concerned with the snowplows knocking down her mail box . 10 . Minutes of the meeting of the Danby Board of Zoning Appeals hearing held December 10 , 1975 . I 1 I 1 Minutes ofi the Town of Danby Board meetin of January 12 , 1976 Page 2 P RIVILEGE OF THE FLOOR : Justice Floyd Dorn gave a report of his expenses and the cases he handled in1 1975 . Justice Milton Todd gave a report of his expenses and the cases he h andled in 1975 . G ordon Roberts asked what is being done on the town hall and when will bids be opened . Supervisor A . Francis Wright advised him . t hat the bids will be opened at 8 : 00 P . M . January 14 , 1976 at the Danby Elementary School . • COMMITTEE REPORTS : J im Murinchack , representative to the town board from the Danby Community Council , reported on the recent elections and stated that the council is presently working on a creative playground on the school property and also a community sign board at the corner of Gunderman Road and Route 96B on the fire district property . Bob Snedden the Town ' s representative to the Inviromental Manag - ement Council discussed what the council is and what is done by t he council . He said imput is needed from the town and would appreciate comments and questions . He also discussed recent hearings . Highway report - Councilman Ralph Wilbur said that there is a problem with the cinder spreader . Possibly the town will need to purchase another cinder spreader by late summer of 1976 . . Another problem is cars parking on the road making it very difficult to clear the snow away . Paul Smith , Chairman of the building committee reported on the progress of the renovation plans for the town hall . Bids for renovation of the town hall will be openned January 14 , 1976 at 8 : 00 P . M . at the Danby Elementary School . Alfred Sebesta reported that the state has rejected the application submitted by the town for extension of cable T . V . service in the Town of Danby . The application was rejected because not all the cable companies were notified and the boardering towns had not been contacted . Supervisor A . Francis Wright made the motion to thank Mr . Sebesta for the work he has done to get the cable T . V . service extended in the Town of Danby and also authorize payment of expenses he incurs . The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes . Supervisor A . Francis Wright asked that the committees for 1976 remain the same as they were in 1975 unless someone has a request for a change . Justice Milton Todd reported that there was a bad break in the water line in West Danby and there has been a problem getting replacement parts . OLD BUSINESS : H ighway Superintendent - No report . Minutes of the Town of Danby Board Meeting of January 12 , 1976 Page 3 O ld Business Continued : Zoning Officer ' s report - Gordon Roberts reported on the business done by his office in 1975 and then compared it to 1974 business . He stated that the business of a telephone for his office has been taken care of . The attorney has not given the town the go ahead to clean up the Bell property yet . The airstrip violation is ready for trial . The decision as to whether to go to trial or not will be made January 20 , 1976 . The Maycumber case will be taken care of in January . No action has been taken in the Makarainen case . A special permit for a nursery and garden store in an R- 2 district in the town was discussed . Appeals Board - No names have been submitted for a replacement for Roland Neefe who is resigning . P lanning Board Chairman - No minutes of the last meeting were available as the secretary has been ill . The board is moving along well with the revision of the zoning ordinance . Articles concerning the revision of the zoning ordinance will be published in the next Danby Area News . The next meeting of the board will be January 15 , 1976 . Supervisor A . Francis Wright said that according to the records at t he Tompkins County Personnel Office the. office of town constable in the Town of Danby is not a certified position . Justice Milton Todd made the motion to certify the position of constable in the Town of Danby . The motion was seconded by Councilman Ralph Wilbur . RESOLUTION # 1 CERTIFY THE POSITION OF TOWN CONSTABLE IN THE TOWN OF DANBY Roll Call Vote : Wright aye Wilbur - aye Smith - aye Todd - aye Dorn - aye Carried by a vote of five ayes and no noes . Councilman Ralph Wilbur moved a resolution to certify the position of Deputy Town Clerk of the West Danby Water District for billing and receiving monies . Justice Milton Todd seconded the motion . RESOLUTION # 2 CERTIFY THE POSITION OF DEPUTY TOWN CLERK FOR BILLING AND RECEIVING MONIES OF THE WEST DANBY WATER DISTRICT Roll Call Vote : Wright - aye Wilbur - aye Smith - aye Todd - aye Dorn - aye Carried by a vote of five ayes and no noes . Justice Milton Todd moved a resolution to certify the position of Water District Superintendent for the West Danby Water District . Councilman Paul Smith seconded the motion . Councilman Ralph Wilbur moved a resolution to certify the position of laborer in the highway department . Justice Milton Todd seconded the motion . RESOLUTION #4 CERTIFY THE POSITION OF LABORER IN THE HIGHWAY DEPARTMENT Roll Call Vote : Wright - aye Wilbur - aye Smith - aye Dorn - aye Todd - aye Supervisor A . Francis Wright moved a resolution to certify the position of part time M . E . O . in the highway department . Councilman Ralph Wilbur seconded the motion . RESOLUTION #5 CERTIFY THE POSITION OF PART TIME M . E . O . IN THE HIGHWAY DEPARTMENT Roll Call Vote : Wright - aye Wilbur - aye Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . Justice Milton Todd moved a resolution to certify the position of part time laborer in the highway department . Justice Floyd Dorn seconded the motion . RESOLUTION # 6 CERTIFY THE POSITION OF PART TIME LABORER IN THE HIGHWAY DEPARTMENT 110 Roll Call Vote : Wright - aye Wilbur . - aye Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . Minutes of the Town Board Meeting of January 12 , 1976 Page 5 NEW BUSINESS : The following appointments for 1976 were recommended : Water District Clerk , Mary Casterline at a yearly salary of $ 450 . 00 ; Water District Superintendent , Roy Casterline at a salary of $ 1800 . 00 per year ; Zoning Officer , Gordon Roberts at a yearly salary of $ 1500 . 00 ; Town Constable , Francis Carrier at a yearly salary of $ 50 . 00 ; Custodian , Edward Slights at a yearly salary of $ 1 , 000 . 00 ; Deputy Supervisor , Onalee Wright at a yearly salary of $ 1600 . 00 ; Deputy • Town Clerk , Edgar Oltz at a yearly salary of $ 300 . 00 ; Clerk for the Town Clerk ' s office at a yearly salary of $ 300 . 00 . Supervisor A . Francis Wright made the motion that the people recommended by appointed by the Town Board at the salaries already set forth in the budget . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . Justice Milton Todd made the motion that the Tompkins County Trust Company be named the official bank of the town . The motion was seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . Justice Milton Todd amde the motion that Thaler & Thaler be named the Town Attorneys for the town of Danby . Justice Floyd Dorn seconded the motion which was carried by a vote of five ayes and no noes . Justice Floyd Dorn made. the motion to name the Ithaca Journal as the official newspaper of the Town of Danby . Justice Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . . Councilman Paul Smith moved a resolution to authorize the town supervisor to invest idle funds for 1976 . The motion was seconded by Justice Milton Todd . RESOLUTION # 7 AUTHORIZE THE SUPERVISOR OF THE TOWN TO INVEST IDLE FUNDS FOR 1976 Roll Call Vote : Wright - aye Wilbur - aye Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . Councilamn Ralph Wilbur moved a blanket resolution to incumber the • necessary funds to pay the balance of the 1975 bills . The motion was seconded by Justice Milton Todd . RESOLUTION #8 BLANKET RESOLUTION TO INCUMBER THE NECESSARY FUNDS TO PAY THE 1975 BILLS Roll Call Vote : Wright - aye Wilbur = aye Smith - aye Dorn - aye Todd - aye Carried by a vote of five ayes and no noes . Minutes of i the Town of Danby Board Meeting of January 12 , 1976 Page 6 New Business Continued : It was noted that the books of the town officials would be audited at the close of the business meeting . The board gave the clerk authorization to look for a suitable tape recorder for her work as the old one has a broken speaker and, the magazine cartriges can no longer be purchased . Albert Shepardson has asked the board if he could demolish the Van de 'Bogart house for the materials he could get out of it . • The pros and cons of this issue were discussed . It was suggested that the matter be tabled until more information is available . Justice Milton Todd made the motion to table the matter until next month . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . The town would like to pass on to Ray VanHoute that the town would like help from the county in maintaining the roads that are involved in projects created by the county . The town attorney furnished the justices with several different copies of kdog ordinances and asked that they go over these and compare them to the one inacted by the Town of Caroline and decide which one the Town of Danby wants . The attoeney will then draft the ordinance for the town . This matter will be , studied by the justices and discussed at an executive session of the board to be held January 14 , 1976 . General Fund Warrant # 1 in the amount of $ 6 , 041 . 98 was approved to be paid . The motion was made by Councilman Paul Smith and seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . Highway Fund Warrant # 1 in the amount of $ 2 , 743 . 97 was approved to be paid . Councilman Ralph Wilbur made the motion which was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . West Danby Water District Warrant # 1 in the amount of $ 249 . 09 was approved to be paid . Justice Milton Todd made the motion which was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . Councilman Ralph Wilbur made the motion to approve the Supervisor ' s reports as - presented . Justice Milton Todd seconded the motion which was carried by a vote of four ayes and no noes . Justice Milton Todd made the motion to adjourn the meeting at 10 : 30 . 0 The motion was seconded by Councilman Paul Smith and carried by a vote of five ayes and no noes .
