TOWN BOARD MINUTES
December 8 , 1975
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Elementary School , Gunderman Road , Town of
Danby , Tompkins County , New York , on December 8 , 1975 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Justice Milton Todd
Justice Floyd Dorn
Board member absent : Councilman Paul Smith
Others present : Dan Hoffman , Edward Slights , Moses Peter , Gordon
Roberts , Joseph Hulbert , Alfred Sebesta , Ernest Cole , Joe Short ,
WTKO Bob Lynch .
Councilman Ralph Wilbur made the motion to approve the minutes of the
November 10 , 1975 meeting as presented . The motion was seconded by
Justice Milton Todd and carried by a vote of four ayes and no noes .
COMMUNICATIONS :
1 . Agenda of the Tompkins County Board of Representatives
meeting of Monday , November 24 , 1975 .
2 . Resolution . # 227 moved by the Tompkins County Board of
Representatives at the November 24th meeting , Establishing
County Equalization Rates .
3 . Resolution # 204 moved by the Tompkins County Board of
Representatives at their October 27th meeting entitled
Workmen ' s Compensation Budget and Apportionment - Mutual
Self - Insurance Plan .
4 . Memo to the Danby Town Board from the Zoning Officer of the
town concerned with the problem of carrying on business on
his party telephone line .
5 . A letter to Town Highway Superintendents and Town supervisors
from Howard A . Stevenson , Jr . , Commissioner of Public Works ,
Tompkins County , concerned with snow and ice control
procedures .
6 . Minutes of the Town of Danby Planning Board meeting of
November 20 , 1975 .
7• . Minutes of the Town of Danby Board of Zoning Appeals hearing
of November 12 , 1975 .
PRIVILEGE OF THE FLOOR :
Moses Peter mentioned the change of signs on the Nelson Road . It
now reads Steam Mill Road . Supervisor A . Francis Wright advised
him that the Town Board , by resolution , had changed the name of
the road to Steam Mill Road . Alfred Sebesta who owns property at
the intersection of Steam Mill Road and Danby Road stated that the
change of names eliminates many problems .

Privilege of the Floor Continued :
Joe Short suggested that the people of Danby put on a play as
part of the bicentenial celebration . The main focus will be
around refurbishing the town hall and the church . Possibly
the town could have an antique show .
COMMITTEE REPORTS :
A . Highway Report - Councilman Ralph Wilbur reported that the
damaged truck has been repaired and is in use . The additional
repairs were paid by insurance . The yard at the town barn
is being cleaned up .
B . West Danby Water District - It was noted that the unpaid water
bills were not brought before the town board for their approval
by resolution . There is a charge for a hook up that is causing
a problem that must be cleared with the water commissioners and
then brought before the town board for a ruling .
C . Insurance - A special meeting . was held with an agent from Ithaca
Agency to go over the insurance coverage carried by the town .
D . Refuse Collection and Disposal - No report .
E . Youth - New officers will be voted for at the December meeting .
F . Zoning and Planning - No report .
G . Fire - No report .
H . Cemeteries - No report .
I . Building Committee Report - Supervisor A . Francis Wright said that
he has been in touch with the architect and the plans for the
Town Hall are ready to be submitted to the Town Board . A meeting
o f the Building Committee , Architect and Town Board will be held
D ecember 15 , 1975 , at the home of Councilman Paul Smith at 8 : 00
P . M . The clerk was asked to attend . After the meeting we will
be ready to advertise for bids .
J . Bicentenial Committee - There have been problems getting a
committee together . A . Francis Wright after some discussion
w ith the board and listening to the remarks of the public
n amed Dan Hoffman , Jim Cortright , Mary Oltz , Moses Peter , Janice
Todd , Joe Short , Mildred Miller and Jimmie Miller to form a
committee . The clerk was asked to advise these people of their
appointment and a meeting will be held in January at which time
a chairman will be appointed .
K . Committee on TV Cable Service Franchise - Alfred Sebesta
discussed the progress of his committee so far . He stated that
the appropriate forms have been filled out and are ready to
mail to the State for their approval . Ceracche will negotiate
with the town when state approval is received .

OLD BUSINESS :
Report of Highway Superintendent - There is a problem with phone
calls coming in . The phone at the town barns has an extension at
t he fire house and is sometimes answered by someone there which
delays calls . It was decided to unplug the phone at the fire house
when Justices were not using it when holding court .
Zoning Officer's Report - The attorney is working on the recommendations
made by the Zoning Officer in reference to the Bell property . The
• Dawes Hill people have talked of filing another application for an
accessory structure . Possibly this should be handled as a
planned development . The planning board will look into this
matter . A lengthy discussion followed .
Appeals Board Chairman - There will be a public hearing December
10 , 1975 to hear an appeal for a special permit . There is some question
of postponment because of the Ithaca Journal ' s failure to advertise
this properly . There may soon be a vacancy on the Board of Zoning
Appeals and a possible replacement should be thought of .
P lanning Board Chairman - Ernest Cole reported that the Planning
B oard has a problem of attendance . New members may be needed in
the near future . The next meeting of the Planning Board will be
held December 11 , 1975 , which is one week earlier than usual . Work
is progressing on the revision of the Zoning Ordinance . The County
P lanning Board is being very helpful in this matter . A series of
articles will be printed in the Danby Area News starting in
February .
NEW BUSINESS :
The problem with the phone for the Zoning Officer was discussed .
It was noted that an increase in salary was given to the Zoning
O fficer and would cover the cost of a private line for his zoning
business .
The D ' Ambrose airstrip was discussed . There is a tenative trial date
set for December 16 , 1975 for the zoning violation . Attorney Thaler
feels they might compromise . The ' board does not feel that there
should be a compromise . If there is no approval from - the FAA the
case should be thrown out . The clerk was asked to inform the
attorney by mail that the board does not wish to compromise in this
matter .
Supervisor A . Francis Wright stated that a resolution is needed
approving the youth budget for 1976 and authorizing the supervisor
to apply for state aid . Councilman Ralph Wilbur made the motion
to approve the youth budget and authorize the town - supervisor to
apply for state aid . The motion was seconded by Justice Milton
Todd .

New Business Continued :
Reservations should be made for the Associations of Towns Meeting
to be held in New York City in February . Councilman Ralph Wilbur
made the motion that the Town Board authorize any town officer
who wishes to attend to do so . The motion was seconded by Justice
Floyd Dorn and carried by a vote of four ayes and no noes . The
clerk was asked to make the reservations .
The Tompkins County Municipal Officials dinner will be held
December 17 , 1975 at the Ramada Inn . Councilman Ralph Wilbur
made the motion that those wishing to attend be authorized to do
so by the Town Board . The motion was seconded by Justice Milton
Todd and carried by a vote of four ayes and no noes .
Supervisor A . Francis Wright informed the board that the Municipal
dues account is short $ 12 . 00 . In order to pay the dues for 1976
$ 12 . 00 must be transferred from account A1220 . 4 to account A1920 . 4 .
Councilman Ralph Wilbur made the motion to transfer the necessary
funds in order to pay the 1976 Municipal dues . The motion was
seconded by Justice Milton Todd .

$ 12 . 00 SHORTAGE IN MUNICIPAL
DUES ACCOUNT FOR 1976

Carried by a vote of four ayes and no noes .
Justice Floyd Dorn stated that the dog ordinance is being drafted
by the town attorney with the hopes that it will be approved and
in force by January 1 , 1976 .
Supervisor A . Francis Wright stated that a resolution is needed
to authorize him to proceed with the closing on the VandeBogart
property . Councilman Ralph Wilbur moved the resolution which was
seconded by Justice Floyd Dorn .
RESOLUTION # 28 AUTHORIZE THE TOWN SUPERVISOR TO
REPRESENT THE TOWN AT THE CLOSING
ON THE VANDEBOGART PROPERTY
DECEMBER 17 , 1975 .

Dorn - aye
Todd - aye
Carried by a vote of four ayes and no noes .
General Fund Warrant # 12 in the amount of $ 1 , 322 . 97 was approved
to be paid . The motion was made by Councilman Ralph Wilbur and
seconded by Justice Milton Todd and carried by a vote of four ayes
and no noes .

New Business Continued :
Highway Fund Warrant # 12 in the amount of $ 917 . 50 was approved to
be paid . The motion was made by Justice Milton Todd and seconded
by Justice Floyd Dorn and carried by a vote of four ayes and no noes .
Councilman Ralph Wilbur made the motion to approve the Supervisor ' s
reports as presented . Justice Floyd Dorn seconded the motion which
was carried by a vote of three ayes and no noes .
• A meeting will be held before the end of the year to incumber
funds to pay for the December bills .
The supervisor adjourned the meeting .
