TOWN BOARD MINUTES
November 10 , 1975
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Elementary School , Gunderman Road , Town of
Danby , Tompkins County , New York on November 10 , 1975 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
SJustice Milton Todd
Board member absent : Justice Floyd Dorn
Others present : Edward Slights , Joseph Hulbert , Roy Casterline ,
Mary Casterline , Ernest Cole , Alfred Sebesta , Debora Linker , Joe
Short , Ithaca Journal reporter , Rick Jenson , Erie J . Miller and
and Dan Hoffman .
Justice Milton Todd made the motion to approve the minutes of the
October 13 , 1975 meeting as presented . The motion was seconded by
Councilman Paul Smith and carried by a vote of four ayes and no noes .
COMMUNICATIONS :
1 . A letter from Mike Babbitt concerning the poor condition of
Comfort Road .
2 . Minutes of the meeting of the 'Jest Danby Water Commissioner ' s
held November 5 , 1975 .
3 . Minutes of the meeting of the Town of Danby Planning Board
held October 16 , 1975 .
4 . Agenda of the Tompkins County Board of Representatives
meeting of Monday , November 10 , 1975 .
5 . A letter from the Human Services Coalition asking for the
Town of Danby ' s participation in helping them with their
budget .
6 . A resolution and warrant from the Tompkins County Board of
Representatives concerning Mortgage Tax Apportionment for
Tompkins County .
7 . Notice of quarterly meeting of the Tompkins County
• Municipal Officials Association .
8 . A news release from the Susquehanna River Basin Commission
telling of their monthly meeting to be held November 13 , 1975 .
9 . Minutes of the Board of Zoning Appeals hearing held October
8 , 1975 .
PRIVILEGE OF THE FLOOR :
Erie J . Miller representative from the Town of Danby on the Tompkins
County Board of Representatives stated that there was a public hearing
on the proposed Ag District in the Town of Danby November 10 , 1975 .
The budget has taken most of the board ' s time this month . He also
reported that a Bicentenial Committee has not been appointed yet .

COMMITTEE REPORTS :
A . Highway report - Councilman Ralph Wilbur reported that the
highway work is going on as usual . Some signs have been put
up . The truck that was damaged is being painted and should be
back on the road soon . Mr . Sebesta ' s request to extend the 45MPH
speed zone further south has been looked into and the recommendation
made that the town board study this further .
B . West Danby Water District - It was recommended that George
Armstrong be reappointed to the Board of Water Commissioners
for a five year term . His new term to become affective
January 1 , 1976 . Justice Milton Todd made the motion to 411
appoint George Armstrong for another five year term as water
commissioner . The motion was seconded by Councilman Ralph
Wilbur and carried by a vote of four ayes and no noes .
C . Insurance - Justice Milton Todd has checked the insurance policies
and everything is in order . The town has been reimbursed for
the damage to the town truck .
D . Refuse Collection and Disposal - No report .
E . Youth - Councilman Paul Smith reported that the proposed park was
discussed and Bradley Corbitt will head a committee to study this
further .
F . Zoning and Planning - No report .
G . Fire - No report .
H . Cemetaries - No report .
I . Building Committee for the Town Hall - Nothing new to report .
Waiting to hear from the architect .
J . Committee on TV Cable _Service Franchise - Alfred Sebesta reported
t hat a step forward has been made but things are moving slowly .
Approval will be needed from the state but not from FCC . Because
West Danby would also like cable service it was suggested that the
t own ask for the extension of cable service for the Town of Danby
that is not presently serviced . This would include West Danby .
The matter was discussed at length . Justice Milton Todd made the
motion to authorize the Supervisor to sign the application to
extend TV Cable service in the Town of Danby not now serviced .
The motion was seconded by Councilman Paul Smith .

OLD BUSINESS :
Report of Highway Superintendent - No report .

Old Business Continued :
Zoning Office /as Report - A jury has been drawn in the airstrip case and
w ill be heard sometime in December . All the necessary background work
has been done and now the Town Board should instruct the Highway
Superintendent to clean up the Bell property in West Danby or Contract
the work out . Written agreement should be obtained from the Wright ' s
in case of damage to their property . Trucks must cross the Wright
property to get to the Bell property for the clean up work . Supervisor
A . Francis Wright asked that Joseph Hulbert check this matter out with
Howard Stevenson to get his opinions and check also with the Wright ' s
410 for written approval to cross their property to do the job . Joseph
Hulbert will bring whatever information he gets to an executive session
o f the Town Board to be held Monday , . November 17 , 1975 at the home of
Supervisor A . Francis Wright so that a decision can be made in this
matter .
Appeals Board Chairman - No report .
Planning Board Chairman - Ernest Cole reported on the progress of the
board in revision the Town of Danby Zoning Ordinance .
NEW BUSINESS :
Councilman Paul Smith made the motion to authorize the Supervisor to
purchase 1500 stamped window< to" JW°ff ed by the tax collector . Justice
Milton Todd seconded the motion which was carried by a vote of four
ayes and no noes .
Councilman Ifj4phalbur made the ,mo,tio,n to appoint Jean Pepper and
Kim Davis of Lansing to serve as Voting Machine Custodians for the
Town of Danby . Justice Milton Todd seconded the motion which was
carried by a vote of four ayes and no noes .
Supervisor A . Francis Wright stated that the highway machinery budget
n eeds to be modified . This would mean the transfer of $ 200 . 00 from
the equipment purchasing account #DM5130 . 2 to the interest account
#DM9710 . 7 . Justice Milton Todd made the motion to transfer the funds .
Councilman Ralph Wilbur seconded the motion .

Supervisor A . Francis Wright reported that the improvement program has
been completed for the year . There is $ 16 , 256 , 14 left in the account .
Joseph Hulbert has recommended that $ 11 , 311 . 00 of this amount be
t ransferred • to . machinery account #DM5130 . 4 and $ 4 , 945 . 14 be transferred
to account #DR5110 . 4 Item 1. Justice Milton Todd made the motion to
transfer the funds . Councilman Ralph Wilbur seconded the motion .

Carried by a vote of four ayes and no noes .
Supervisor A . Francis Wright said that it was necessary for the
Town Board to adopt the 1976 Town budget . He went over the budget
for the benefit of the people attending the meeting . He stated
that the required public hearing had been held November 6 , 1975 .
Councilman Ralph Wilbur made the motion to adopt the budget as
presented . Councilman Paul Smith seconded the motion .
RESOLUTION # 25 ADOPT THE 1976 BUDGET
Roll Call Vote : Wright - aye
Wilbur - aye
Smith - aye .
Todd - aye
Carried by a vote of four ayes and no noes .
General Fund Warrant # 11 in the amount of $ 2 , 391 . 07 was approved to
be paid . The motion was made by Councilman Paul Smith and seconded
by Justice Milton Todd and carried by a vote of four ayes and no noes .
Highway Fund Warrant # 11 in the amount of $ 3 , 830 . 95 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and seconded
by Justice Milton Todd and carried by a vote of four ayes and no noes .
West Danby Water District Warrant #9 in the amount of $ 30 . 15 was
approved to be paid . Justice Milton Todd made the motion which was
carried by a vote of four ayes and no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports . Justice Milton Todd seconded the motion which was carried
by a vote of three ayes and no noes .
The meeting was adjourned at 9 : 45 P . M .
