EXECUTIVE SESSION
October 29 , 1975
An executive session of the Danby Town Board was held October 29 ,
1975 , at the home of Supervisor A . Francis Wright .
Members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
Justice Milton Todd
• Member absent : Justice Floyd Dorn
Others present : Telephone Company Representative , Gordon Madison ;
Town Attorney , Richard Thaler ; Joseph Hulbert , Albert Sebesta and
Onalee Wright .
The Proposed Preliminary Budget was completed to be ready for the
public hearing on the budget to be held Thursday , November 6 ,
1975 at the Danby Elementary School .
Telephone cables in the highway right of wayin the town were
discussed . Mr . Madison stated that Code 53 protects both the
town and the telephone company . He also said that there are
very few cables in the highway right of way in the town and
these are labelled and recorded . The town attorney will dicate
a letter for the town to the New York Telephone Company stating
that the town will not expect a bill for any cable cut by a town
employee by accident with reference to statements made by Mr .
Madison at this meeting .
Attorney Richard Thaler is drawing up a dog ordinance for the
town . It should be ready for the board to pass on in December
and in force by January 1 , 1976 .
In reference to CSEA , Town Attorney Richard Thaler stated that
the election held in the town to see if the town highway employees
wanted CSEA to represent them as their bargaining agent may not
have been a valid election as there was no CSEA representative
present at the election . Mr . Thaler has a consent agreement which
would recognize CSEA as the bargaining agent for the highway
people which will be valid only if recognized by 50 per cent of
the highway employees . Milton Todd made the motion to authorize
Town Attorney , Richard Thaler to sign the Consent Agreement with
CSEA . The motion was seconded by Councilman Paul Smith .

Carried by a vote of four ayes and no noes .
Attorney Richard Thaler stated that the papers are all drawn in
the Maycumber case except for the Affidavit to get Injunction and
Show Cause why he shouldn ' t clean up his junk yard . When this is
done Mr . Maycumber will probably be given 20 days to answer . Mr .
Thaler will check with Binghamton to see what license Mr . Maycumber
has to run his business .

The field work on the Town Hall property has been done . The deeds
have been checked and the abstract is ready . Probably the closing
o n the Van de Bogart property can be held after December 15 , 1975 .
The Town Justice must give Joseph Hulbert a written order to clean
up the Bell property in West Danby . Mrs . Bell will be billed for
t his . If it is not paid the bill will be added to her property
tax .
Alfred Sebesta showed the town board a tax map , a soil map and a
copy of a deed to 93 acres of property in West Danby that
possibly could serve as a gravel bank for the town . This is
available at $ 52 , 000 . After looking at the maps and discussing
the matter the board stated that they were thinking in terms of
10 acres of land for seven or eight thousand dollars . The town
can ' t afford $ 52 , 000 .
The estimated cost of repairing the town truck is $ 4 , 632 . 60 .
Justice Milton Todd made the motion to increase the hourly rate
paid to election inspectors from $ 2 . 00 to $ 2 . 50 and the
chairman ' s rate from $ 2 . 00 to $ 2 . 50 . Councilman Paul Smith
seconded the motion which was carried by a vote of four ayes and
n o noes .
The meeting was adjourned at 10 : 10 P . M .
